Hours of Service of Drivers: Application for Exemption; Small Business in Transportation Coalition
FMCSA announces that the Small Business in Transportation Coalition (SBTC) has requested an exemption from the electronic logging device (ELD) requirements for all motor carriers with fewer than 50 employees, including, but not limited to, one-person private and for- hire owner-operators of commercial motor vehicles used in interstate commerce. SBTC believes that the exemption would not have any adverse impacts on operational safety as motor carriers and drivers would remain subject to the hours-of-service (HOS) regulations as well as the requirements to maintain paper RODS. Electronic Documents and Signatures; Correction
FMCSA corrects the electronic documents and signatures final rule published on April 16, 2018 that amended FMCSA regulations to allow the use of electronic records and signatures to satisfy FMCSA's regulatory requirements. This document corrects an amendatory instruction, removes two extra commas at the end of two phrases, and adds ``of this section'' to a cross reference in a paragraph. Finally, FMCSA rescinds its January 4, 2011, interpretations and regulatory guidance.
Agency Information Collection Activities; Approval of a New Information Collection Request: Driver Commuting Practices Survey
In accordance with the Paperwork Reduction Act of 1995, FMCSA announces its plan to submit the Information Collection Request (ICR) described below to the Office of Management and Budget (OMB) for review and approval. FMCSA proposes a voluntary survey to inquire about driver commuting practices to fulfill Section 5515 of the Fixing America's Surface Transportation Act, 2015 (FAST Act), which requires FMCSA to conduct a study on the safety effects of motor carrier operator commutes exceeding 150 minutes. The FMCSA Administrator is then required to submit a report to Congress containing the findings of the study. There are no current or future planned regulations associated with this survey, nor does FMCSA plan to actively track driver commutes to obtain data. The survey proposed within this ICR is entirely voluntary, and would gather information on the prevalence of excessive (greater than 150 minutes) commuting of interstate commercial motor vehicle (CMV) drivers, including the number and percentage of drivers who commute; the distances traveled, time zones crossed, time spent commuting, and methods of transportation used; the impact of excessive commuting on safety and CMV driver fatigue; and the commuting practices of CMV drivers and policies of motor carriers.
Agency Information Collection Activities; Renewal of a Currently Approved Information Collection Request: Generic Clearance of Customer Satisfaction Surveys
In accordance with the Paperwork Reduction Act of 1995, FMCSA announces its plan to submit the Information Collection Request (ICR) described below to the Office of Management and Budget (OMB) for its review and approval and invites public comment. The Executive Order directs Federal agencies to provide service to the public that matches or exceeds the best service available in the private sector. In order to work continuously to ensure that our programs are effective and meet our customers' needs, the FMCSA seeks to obtain OMB approval of a currently approved generic clearance to collect feedback on our service delivery. By feedback, we mean information that provides useful insights on perceptions and opinions, but are not statistical surveys that yield quantitative results that can be generalized to the population of study. On January 19, 2018, FMCSA published a notice in the Federal Register allowing for a 60-day comment period on this ICR. The Agency received one comment in response to the notice. The comment was unrelated to the information collection. Therefore, no agency response was necessary.

This ICR will enable FMCSA to document the burden associated with the marking regulations codified in 49 CFR 390.21, ``Marking of Self-Propelled CMVs and Intermodal Equipment.'' These regulations require marking of vehicles and intermodal equipment by motor carriers, freight forwarders and intermodal equipment providers (IEPs) engaging in interstate transportation.

In accordance with the Paperwork Reduction Act of 1995, FMCSA announces its plan to submit the Information Collection Request (ICR) described below to the Office of Management and Budget (OMB) for its review and approval and invites public comment. The FMCSA requests approval to revise and extend the ``Annual Report of Class I and Class II Motor Carriers of Property'' ICR, OMB Control No. 2126-0032. This ICR is necessary to ensure that motor carriers comply with FMCSA's financial and operating statistics requirements at chapter III of title 49 CFR part 369 titled ``Reports of Motor Carriers.'' This ICR is being revised to incorporate the OMB approved ``Annual Report of Class I Motor Carriers of Passengers'' ICR, OMB Control No. 2126-0031, for use of the MP-1 form, the ``Annual Report Form (Motor Carriers of Passengers),'' which resulted in only two respondents and one burden hour per year. Through the proposed merger of the two ICRs, FMCSA would rename the 2126-0032 ICR as the ``Annual Report of Class I and Class II For-Hire Motor Carriers'' ICR. And such a merger with the new title will clarify that the combined ICR addresses both for-hire property and passenger carriers, but not private motor carriers. Additionally, after the merger of the ICRs, FMCSA intends to request withdrawal of the previously approved ``Annual Report of Class I Motor Carriers of Passengers'' ICR, OMB Control No. 2126-0031.

The Federal Motor Carrier Safety Administration (FMCSA) requests public comment on an application for exemption from Castignoli Enterprises (Castignoli) to allow a sleeper berth to be installed in the bed of a Ford F350 pickup truck that, when operated in combination with certain trailers, is a commercial motor vehicle (CMV) under the Federal Motor Carrier Safety Regulations (FMCSR). A sleeper berth installed in the bed of the pickup truck does not meet the access, location, exit, communication, or occupant restraint requirements for sleeper berths in the FMCSRs. Castignoli believes that the sleeper berth installed in the bed of the pickup truck will maintain a level of safety that is equivalent to, or greater than, the level of safety achieved without the exemption.
