Notice of Availability of Draft Director's Order #77-10 Concerning National Park Service Policies and Procedures Governing Benefits Sharing
The National Park Service (NPS) is proposing to adopt a Director's Order setting forth policies and procedures that guide NPS practices to implement benefits sharing in accordance with the National Parks Omnibus Management Act of 1998 (16 U.S.C. 5935(d)) that authorizes the Secretary of the Interior to enter into negotiations with the research community and private industry for equitable, efficient benefits-sharing arrangements. Benefits sharing occurs when NPS receives monetary or other benefits from a discovery or invention with a commercial application resulting from research originating under an NPS Scientific Research and Collecting Permit, or other permit or authorization.
List of Units of the National Park System Exempt From the Provisions of the National Parks Air Tour Management Act
The National Parks Air Tour Management Act (NPATMA) requires the Federal Aviation Administration (FAA) and National Park Service (NPS) to develop an air tour management plan for units of the national park system where an operator has requested authority to provide commercial air tours. The FAA Modernization and Reform Act of 2012 amended various provisions of NPATMA. One provision exempted national park units with 50 or fewer annual flights from the provisions of NPATMA and requires FAA and NPS to jointly publish a list of exempt parks. This notice includes an initial list of parks that are exempt from the provisions of the NPATMA.

Native American Graves Protection and Repatriation Review Committee Findings Related to the Identity and Return of Cultural Items in the Possession of the University of Pennsylvania Museum of Archaeology and Anthropology, Philadelphia, PA
The Native American Graves Protection and Repatriation Review Committee (Review Committee) was established by Section 8 of the Native American Graves Protection and Repatriation Act (NAGPRA; 25 U.S.C. 3006), and is an advisory body governed by the Federal Advisory Committee Act (5 App. U.S.C. 1-16). At its November 17-19, 2010 public meeting in Washington, DC, and acting pursuant to its statutory responsibility to convene the parties to a dispute relating to the identity and return of cultural items, and to facilitate the resolution of such a dispute, the Review Committee heard a dispute between the Hoonah Indian Association, joined by the Huna Totem Corporation, and the University of Pennsylvania Museum of Archaeology and Anthropology. The issues before the Review Committee were (1) whether, in their request for the repatriation of 38 catalogued objects deriving from the Snail House and one catalogued object deriving from the Eagle's Nest House that are in the possession of the University of Pennsylvania Museum of Archaeology and Anthropology, the requestors proved that all the requested objects are both ``sacred objects'' and objects of ``cultural patrimony,'' as these terms are defined in NAGPRA; and (2) whether, in response to the request for the repatriation of the 39 catalogued objects, the University of Pennsylvania Museum of Archaeology and Anthropology presented evidence proving that the Museum has a ``right of possession'' to any of the objects, as this term is defined in the NAGPRA regulations. The Review Committee found that all of the requested objects are both sacred objects and objects of cultural patrimony, and that the University of Pennsylvania Museum of Archaeology and Anthropology does not have a right of possession to any of those cultural items. Appendix (1988), of a telephonic meeting of the Native American Graves Protection and Repatriation Review Committee (Review Committee). This meeting will be open to the public. Winter Use Plan, Final Environmental Impact Statement Amended Record of Decision, Yellowstone National Park, Idaho, Montana, and Wyoming
Pursuant to Sec. 102(2)(C) of the National Environmental Policy Act of 1969, 42 U.S.C. 4332(2)(C), the National Park Service (NPS) announces the availability of the Amended Record of Decision for the Winter Use Plan for Yellowstone National Park, located in Idaho, Montana, and Wyoming. On December 3, 2012, the Regional Director, Intermountain Region, approved the Amended Record of Decision for the plan. The NPS will implement this decision through an implementing regulation that will take effect on December 15, 2012.
Special Regulations; Areas of the National Park System, Yellowstone National Park
This rule implements the amended Record of Decision for the 2011 Winter Use Plan/Environmental Impact Statement and governs winter visitation and certain recreational activities in Yellowstone National Park for the 2012-2013 winter season. The rule retains, for one additional year, the regulation and management framework that have been in place for the past three winter seasons (2009-2010, 2010-2011, and 2011-2012). Specifically, the rule retains provisions that require most recreational snowmobiles operating in the park to meet certain National Park Service air and sound emissions requirements; requires snowmobiles and snowcoaches in Yellowstone to be accompanied by a commercial guide; sets daily entry limits on the numbers of snowmobiles (up to 318) and snowcoaches (up to 78) that may enter the park; and prohibits traveling off designated oversnow routes.

Minor Boundary Revision of Saratoga National Historical Park
Notice is hereby given that, pursuant to 16 U.S.C. 460l- 9(c)(1)(ii), the boundary of Saratoga National Historical Park is modified to include approximately 21.06 acres of adjacent unimproved land identified as Tract 01-157 (18.89 acres) and Tract 01-158 (2.17 acres). The tracts, owned respectively by Open Space Conservancy, Inc., and the State of New York, will be donated to the United States. The boundary revision is depicted on Map No. 374/112,692 and dated February 2012. Notice of Meeting Preservation Technology and Training Board
Notice is hereby given in accordance with the Federal Advisory Committee Act (FACA) (5 U.S.C. Appendix (1988)), that the Preservation Technology and Training Board (PTT Board) of the National Center for Preservation Technology and Training, National Park Service, will meet on Wednesday and Thursday, November 28-29, 2012, at the Presidio in San Francisco, California. The PTT Board was established by Congress to provide leadership, policy advice, and professional oversight to the National Center for Preservation Technology and Training (NCPTT) in compliance with Section 404 of the National Historic Preservation Act of 1966, as amended, (16 U.S.C. 470x-2(e)). The PTT Board will meet at the Presidio, Long Avenue, Building 989, San Francisco, CA 94129telephone (318) 356-7444. The meeting will run from 9:00 a.m. to 5:00 p.m. on November 28, 2012, and from 9:00 a.m. to noon on November 29, 2012 (PACIFIC). The PTT Board's meeting agenda will include: Review and comment on NCPTT FY2012 accomplishments and operational priorities for FY2013; FY2012 and FY2013 National Center budget and initiatives; recent research; and training programs. The PTT Board meeting is open to the public. Facilities and space for accommodating members of the public are limited; however, visitors will be accommodated on a first-come, first-served basis. Any member of the public may file a written statement concerning any of the matters to be discussed by the PTT Board.
Notice of Intent To Prepare an Environmental Impact Statement for the Paseo del Morro National Recreational Trail Extension, San Juan National Historic Site, San Juan, Puerto Rico
Pursuant to the National Environmental Policy Act of 1969 (42 U.S.C. 4332) (2) (C), the National Park Service (NPS) will prepare an Environmental Impact Statement for the Paseo del Morro National Recreational Trail Extension (EIS). The EIS will include the involvement of multiple entities, including the Municipality of San Juan and the Commonwealth of Puerto Rico and neighborhoods along the trail corridor. Segments of the extension within and outside of the NPS boundary might include several amenities such as: Pedestrian trails, bicycle trail, Plaza, access to the Santa Maria Magdalena Cemetery, viewpoints, pocket seating areas, and drinking fountains. The project would be constructed in four phases according to the segments within the project extension. The first segment would run parallel to the Santa Maria Magdalena Cemetery, the second segment parallel to the community of La Perla, the third segment along the coastal area of Castillo San Cristobal, and the fourth segment through the ``Lomita de Los Vientos''. The characteristics of the trail, such as width of the primary and secondary trails, amenities, complementary programs, activities and methods of construction, would vary in the different segments of the projects. The objectives of the project are: To create public access to the North Coast of the Old San Juan Islet and create recreational public space along coastal area in front of Old San Juan, protect the historic walls of El Morro, encourage educational tourism within the area. The DEIS will assess potential environmental impacts associated with a range of reasonable alternatives for extension of the Paseo del Morro on park resources such as existing flora and fauna, soils, cultural resources, and public safety. Socioeconomic impacts and effects on visitor experience will also be analyzed.
Record of Decision for the Oil and Gas Management Plan, Big South Fork National River and Recreation Area and Obed Wild and Scenic River
Pursuant to the National Environmental Policy Act (NEPA) of 1969, 42 U.S.C. 4332(2)(C), the National Park Service (NPS) announces the availability of the Record of Decision (ROD) for the Oil and Gas Management Plan (Plan) for Big South Fork National River and Recreation Area and Obed Wild and Scenic River. On September 5, 2012, the Southeast Regional Director, approved the ROD for the plan. The ROD identifies Alternative C (Comprehensive Implementation of 9B Regulations, a New Management Framework for Plugging and Reclamation, and Establishment of Special Management Areas) as the NPS's selected action.

Minor Boundary Revision at Minidoka National Historic Site
Notice is hereby given that, pursuant to 16 U.S.C. 460l- 9(c)(1)(ii), the boundary of Minidoka National Historic Site is modified to include 88.51 acres of land identified as Tract 01-107, tax parcels numbered RP08S19E2300A and RP08S19E329001A. A conservation easement interest in the land will be donated to the United States. The land is located in Jerome County, Idaho, immediately adjacent to the current western boundary of Minidoka National Historic Site. The boundary revision is depicted on Map No. 194/114484 dated May 2012. Native American Graves Protection and Repatriation Review Committee: Notice of Nomination Solicitation
The National Park Service is soliciting nominations for one member of the Native American Graves Protection and Repatriation Review Committee. The Secretary of the Interior will appoint the member from nominations submitted by Indian tribes, Native Hawaiian organizations, and traditional Native American religious leaders. The nominee must be a traditional Indian religious leader. Nominations must include the following information: 1. Nominations by traditional religious leaders: Nominations must be submitted with the nominator's original signature and daytime telephone number. The nominator must explain that he or she meets the definition of traditional religious leader. 2. Nominations by Indian tribes or Native Hawaiian organizations: Nominations must be submitted on official tribal or organization letterhead with the nominator's original signature and daytime telephone number. The nominator must be the official authorized by the tribe or organization to submit nominations in response to this solicitation. The nomination must include a statement that the nominator is so authorized. 3. A nomination must include the following information: a. The nominee's name, postal address, daytime telephone number, and email address; and b. The nominee's resume or brief biography emphasizing the nominee's NAGPRA experience and ability to work effectively as a member of an advisory board.
