Electronic Payment of Fees for Outer Continental Shelf Activities
The MMS proposes that all lessees, operators, permittees, and rights-of-way holders pay all fees for processing plans, applications, and permits electronically. The MMS believes this proposed rule would aid industry in payment processing, and reduce payment processing errors. This proposed rule would improve MMS processing efficiency and facilitate the correction of industry payment errors. The MMS would not accept checks, money orders, or cashier's checks for payment of fees after the effective date of the final rule.
Royalty Relief for Deepwater Outer Continental Shelf (OCS) Oil and Gas Leases-Conforming Regulations to Court Decision
This proposed rule would amend 30 CFR parts 260 and 203 to conform the regulations to the decision of the United States Court of Appeals for the Fifth Circuit in Santa Fe Snyder Corp., et al. v. Norton (the Decision). That decision found that certain provisions of the MMS regulations interpreting section 304 of the Deep Water Royalty Relief Act are contrary to the requirements of the statute.
Extension of Post-Sale Evaluation Period for Central Gulf of Mexico Lease Sale 205
This notice extends by 45 days, the post-sale evaluation period for Central Gulf of Mexico Lease Sale 205. The Minerals Management Service (MMS) will complete evaluating all the bids received in this sale by February 15, 2008. This action is necessary due to the unusually high number of bids received in this lease sale.

Indian Oil Valuation
The Minerals Management Service (MMS) is amending the existing regulations regarding valuation, for royalty purposes, of oil produced from Indian leases. These amendments will clarify and update the existing regulations.
MMS Information Collection Activity: NEW Information Collection; Lease of Submerged Lands for Alternative Energy Activities on the OCS; Comment Request
To comply with the Paperwork Reduction Act of 1995 (PRA), MMS is inviting comments on a collection of information that we will submit to the Office of Management and Budget (OMB) for review and approval. The information collection request (ICR) concerns the paperwork requirements that address new Form MMS-0001, Lease of Submerged Lands for Alternative Energy Activities on the Outer Continental Shelf (OCS), which is printed within this Federal Register notice. This form is used to enter into a leasing agreement between MMS and a respondent to conduct data collection and/or technology testing on the OCS. The MMS is also asking for comments on the lease form. Section 388 of the Energy Policy Act of 2005 (Pub. L. 109-58), amended section 8 of the OCS Lands Act (43 U.S.C. 1337(p)) and gave responsibility to MMS to grant a lease, easement, or right-of-way on the OCS for alternative energy-related uses not otherwise authorized under the Lands Act.

States' Decisions on Participating in Accounting and Auditing Relief for Federal Oil and Gas Marginal Properties
The Minerals Management Service (MMS) published final regulations on September 13, 2004 (69 FR 55076), codified at 30 CFR 204.200-215, to provide accounting and auditing relief for marginal Federal oil and gas properties. The rule requires MMS to publish in the Federal Register the decisions of the states concerned to allow or not to allow one or both forms of relief in their state. As required in the rule, MMS provided states receiving a portion of the Federal royalties with a list of qualifying marginal Federal oil and gas properties located in their state so that each affected state could decide whether to participate in one or both relief options. This notice provides the decisions by the states concerned to allow one or both types of relief.
Preparation of an Environmental Assessment (EA) for Proposed Outer Continental Shelf (OCS) Oil and Gas Lease Sale 207 in the Western Gulf of Mexico (GOM) Planning Area (2008)
The MMS is issuing this notice to advise the public, pursuant to the National Environmental Policy Act of 1969 (NEPA), as amended, 42 U.S.C. 4321 et seq., that MMS intends to prepare an EA for proposed OCS Oil and Gas Lease Sale 207 in the Western GOM Planning Area (Lease Sale 207) scheduled for August 2008. The MMS is issuing this notice to facilitate public involvement. The preparation of this EA is an important step in the decision process for Lease Sale 207. The proposal for Lease Sale 207 was identified by the Call for Information and Nominations published in the Federal Register on April 28, 2006, and was analyzed in the Gulf of Mexico OCS Oil and Gas Lease Sales: 2007- 2012; Western Planning Area Sales 204, 207, 210, 215, and 218; Central Planning Area Sales 205, 206, 208, 213, 216, and 222Final Environmental Impact Statement; Volumes I and II (Multisale Environmental Impact Statement (EIS), OCS EIS/EA MMS 2007-018). This EA for proposed Lease Sale 207 will reexamine the potential environmental effects of the proposed lease sale and its alternatives (excluding the unleased blocks near biologically sensitive topographic features, use of a nomination and tract selection leasing system, and no action) based on any new information regarding potential impacts and issues that were not available at the time the Multisale EIS was prepared.
Environmental Assessment (EA), Liberty Development and Production Plan (DPP) Ultra Extended Reach Drilling From Endicott Satellite Drilling Island (SDI)-MMS 2007-054
The Minerals Management Service (MMS) is in receipt of a Development and Production Plan (DPP) from British Petroleum (BP) that proposes an ultra extended reach drilling project in the Beaufort Sea Outer Continental Shelf (OCS) scheduled for construction in 2009. In accordance with the National Environmental Policy Act (NEPA), MMS has prepared an environmental assessment (EA) that concludes that with required mitigation no significant adverse effects (40 CFR 1508.27) on the quality of the human environment would occur. Therefore MMS has issued a Finding of No Significant Impact (FONSI). In accordance with 40 CFR 1501.4(e)(2)(i), MMS is making the FONSI available for public review for 30 days before making a final determination whether to prepare an EIS and before taking final action on the proposed Liberty DPP.

Notice on Outer Continental Shelf Oil and Gas Lease Sales
Pursuant to the authority vested in the Director of the Minerals Management Service by the joint bidding provisions of 30 CFR 256.41, each entity within one of the following groups shall be restricted from bidding with any entity in any other of the following groups at Outer Continental Shelf oil and gas lease sales to be held during the bidding period November 1, 2007, through April 30, 2008. The List of Restricted Joint Bidders published in the Federal Register on April 17, 2007, covered the period May 1, 2007, through October 31, 2007.
Environmental Assessment (EA), Beaufort Sea Outer Continental Shelf (OCS) Deep-Penetration Seismic Survey-2007
The Minerals Management Service (MMS) has prepared an environmental assessment (EA) for Shell Offshore, Inc's. (SOI) proposed seismic surveys in the Beaufort Sea Outer Continental Shelf (OCS) in 2007. The EA concludes that with required mitigation no significant adverse effects (40 CFR 1508.27) on the quality of the human environment would occur. Therefore MMS issued a Finding of No Significant Impact (FONSI). Based on the FONSI, MMS issued to SOI the Geological and Geophysical (G&G) Permit 2007-04, which contained mitigation measures to ensure that the Beaufort Sea's fish, wildlife, and Alaska Native subsistence resources would not be adversely impacted.
Notice of Public Workshop To Discuss the Possible Need for Suspension of Operations Specifically Related to High Pressure or High Temperature Equipment
The MMS will hold a workshop to discuss the possible need to develop a new regulation allowing for a Suspension of Operations, specifically related to high pressure or high temperature equipment needed for safe drilling, completion, or production operations. This Suspension of Operations would allow for an extension of a lease when the modification of existing technology is considered necessary in order to operate in frontier areas due to unexpected high temperatures or high pressures encountered on your lease. This type of Suspension of Operations would not apply to the initial design, development, or manufacturing of new technology. Request for Information and Nominations of Areas for Leases Authorizing Alternative Energy Resource Assessment and Technology Testing Activities Pursuant to Subsection 8(p) of the Outer Continental Shelf Lands Act, as Amended
The Minerals Management Service (MMS) invites comments concerning the authorization of activities on the Outer Continental Shelf (OCS) involving the installation of meteorological or marine data collection facilities to assess alternative energy resources (e.g., wind, wave, and ocean current) or to test alternative energy technology to produce or support production of alternative energy. The MMS intends to adopt an interim policy to authorize such facilities (e.g., meteorological towers or wave and current data collection instruments and wave or current generators or other developing technology) under subsection 8(p) of the OCS Lands Act, as amended by section 388 of the Energy Policy Act of 2005. Parties wishing to obtain such authorizations should submit detailed and specific nomination and application information as described below.
Alternative Energy and Alternate Use Final Programmatic Environmental Impact Statement
The MMS has prepared a final programmatic EIS in support of the establishment of a program for authorizing alternative energy and alternate use activities on the Outer Continental Shelf (OCS), as authorized by Section 388 of the Energy Policy Act of 2005 (EPAct), and codified in subsection 8(p) of the Outer Continental Shelf Lands Act (OCSLA). Pursuant to the regulations implementing the National Environmental Policy Act (NEPA), the MMS is announcing the availability of this final programmatic EIS. As part of its efforts to develop a regulatory program for alternative energy and alternate use activities, this final programmatic EIS examines the potential environmental effects of the program on the OCS and identifies policies and best management practices that may be adopted for the program. Several alternatives available to the MMS for implementing an alternative energy and alternate use program on the OCS are analyzed in this final programmatic EIS, including the ``no action'' alternative. The MMS intends to prepare a separate NEPA analysis, tiered from this EIS, to evaluate the environmental impacts of the proposed rule for alternative energy and alternate use activities on the OCS. Further, separate lease sale, activity-specific, and proposal-specific NEPA analyses will be prepared as appropriate.
Outer Continental Shelf (OCS), Scientific Committee (SC)
The MMS is seeking interested and qualified individuals to serve on its OCS SC during the period of April 29, 2008 through April 28, 2010. The initial 2-year term may be renewable for up to an additional 4 years. The OCS SC is chartered under the Federal Advisory Committee Act to advise the Secretary of the Interior through the Director of the MMS on the appropriateness, feasibility, and scientific value of the OCS Environmental Studies Program (ESP) and environmental aspects of the offshore energy and marine minerals programs. The ESP, which was authorized by the OCS Lands Act as amended (Section 20), is administered by the MMS and covers a wide range of field and laboratory studies in biology, chemistry, and physical oceanography, as well as studies of the social and economic impacts of OCS energy and marine minerals development. Currently, the work is conducted through award of competitive contracts and interagency and cooperative agreements. The OCS SC reviews the relevance of the information being produced by the ESP and may recommend changes in its scope, direction, and emphasis. The OCS SC comprises distinguished scientists in appropriate disciplines of the biological, physical, chemical, and socioeconomic sciences. Currently, the OCS SC has four vacancies in the following disciplines: Biological oceanography/marine biology; economics; and physical oceanography. The selections are based on maintaining disciplinary expertise in all areas of research, as well as geographic balance. Demonstrated knowledge of the scientific issues related to OCS oil and gas development is essential. Selections are made by the Secretary of the Interior on the basis of these factors.
Outer Continental Shelf (OCS), Eastern Gulf of Mexico (GOM) Planning Area, Proposed Oil and Gas Lease Sale 224, March 2008
The MMS has prepared a Final SEIS on a tentatively scheduled 2008 oil and gas leasing proposal (Sale 224) in the Eastern GOM Planning Area, off the States of Louisiana, Mississippi, Alabama, and Florida. As mandated in the recently enacted Gulf of Mexico Energy Security Act (GOMESA) of 2006 (Pub. L. 109-432, December 20, 2006), MMS shall offer a portion of the ``181 Area,'' located in the Eastern Planning Area, more than 125 miles from Florida for oil and gas leasing.
Notice of Availability of the Proposed Notice of Sale for Outer Continental Shelf (OCS) Oil and Gas Lease Sale 224 in the Eastern Planning Area (EPA) in the Gulf of Mexico
The MMS announces the availability of the proposed Notice of Sale for proposed Sale 224 in the EPA. This notice is published pursuant to 30 CFR 256.29(c) as a matter of information to the public. With regard to oil and gas leasing on the OCS, the Secretary of the Interior, pursuant to section 19 of the OCS Lands Act, provides the affected States the opportunity to review the proposed Notice. The proposed Notice sets forth the proposed terms and conditions of the sale, including minimum bids, royalty rates, and rentals.

The MMS is issuing this notice to advise the public, pursuant to the National Environmental Policy Act of 1969 (NEPA), as amended, 42 U.S.C. 4321 et seq., that the MMS has prepared an EA for proposed OCS oil and gas Lease Sale 206 in the Central GOM Planning Area (Lease Sale 206) scheduled for March 2008. The preparation of this EA is an important step in the decision process for Lease Sale 206. The proposal for Lease Sale 206 was identified by the Call for Information and Nominations published in the Federal Register on April 28, 2006, and was analyzed in the Gulf of Mexico OCS Oil and Gas Lease Sales: 2007- 2012; Western Planning Area Sales 204, 207, 210, 215, and 218; Central Planning Area Sales 205, 206, 208, 213, 216, and 222Final Environmental Impact Statement(EIS); Volumes I and II (Multisale EIS, OCS EIS/EA MMS 2007-018). The proposal does not include approximately 5.8 million acres located in the southeastern part of the Central Planning Area which the Gulf of Mexico Energy Security Act of 2006 opened to leasing after many years of appropriations Acts containing leasing moratoria. Because of the limited geological and geophysical data available to industry and the limited environmental review for this area, the MMS has decided that it would be premature to offer this area in proposed Lease Sale 206. Before the area is offered for lease, the MMS will conduct a separate NEPA review to reevaluate the expanded CPA sale area. This EA for proposed Lease Sale 206 reexamined the potential environmental effects of the proposed lease sale and its alternatives excluding the unleased blocks near biologically sensitive topographic features; excluding the unleased blocks within 15 miles of the Baldwin County, Alabama Coast; and no action based on any new information regarding potential impacts and issues that were not available at the time the Multisale EIS was prepared. No new significant impacts were identified for proposed Lease Sale 206 that were not already assessed in the Multisale EIS. As a result, the MMS determined that a Supplemental EIS is not required and prepared a Finding of No New Significant Impact (FONNSI).

Oil and Gas and Sulphur Operations in the Outer Continental Shelf-Pipelines and Pipeline Rights-of-Way
This proposed rulemaking completely revises the MMS Outer Continental Shelf pipeline and pipeline Rights-of-Way (ROW) regulations, and brings them up to date with current industry practices and technology. The proposed rule incorporates parts of several new and revised industry standards into the regulations. It also incorporates several conditions of approval for pipelines, plus guidance from various Notices to Lessees and Operators (NTLs) and one Letter to Lessees and Operators (LTL) into one set of comprehensive pipeline regulations. The proposed regulations would eliminate several NTLs and the LTL, and have been rewritten in plain language.

Outer Continental Shelf (OCS), Alaska OCS Region, Beaufort Sea and Chukchi Sea, Proposed Oil and Gas Lease Sales for Years 2007 to 2012
On August 23, 2007, pursuant to 30 CFR 256 and 40 CFR 1501.7 as a matter of information to the public, the MMS published in the Federal Register a Call for Information and Nomination and Notice of Intent to Prepare an EIS for the Beaufort Sea and Chukchi Sea OCS planning areas. The Call is the initial step of a multiple sale process that incorporates planning and analysis for the Alaska lease sales included in the proposed final OCS Oil and Gas Leasing Program 2007- 2012. We inadvertently omitted a page-size map of the Beaufort Sea Planning Area which should have accompanied a page-size map of the Chukchi Sea Planning Area and instead included two duplicate page-size maps of the Chukchi Sea Planning Area. The correct Beaufort Sea Planning Area map accompanies this notice.
Outer Continental Shelf (OCS), Western and Central Gulf of Mexico (GOM), Oil and Gas Lease Sales for Years 2009-2012
On April 28, 2006, MMS issued a Call for 11 lease sales in the Western and Central GOM planning areas included in the draft proposed 2007-2012 OCS Oil and Gas Leasing Program. After that Call the Congress enacted a mandate, in the Gulf of Mexico Energy Security Act of 2006 (GOMESA) (Pub. L. 109-432, December 20, 2006), that MMS offer, as soon as practicable, approximately 5.8 million acres located in the southeastern part of the Central Planning Area (CPA) referred to as the ``181 South Area.'' Central GOM Sale 208 (March 2009) will be the first sale to include the ``181 South Area.'' The purpose of this Call is to gather information on oil and gas leasing, exploration, and development that might result from the four Central GOM OCS oil and gas lease sales tentatively scheduled in 2009-2012, in particular regarding the ``181 South Area.'' This Call for Information and Nominations (hereinafter referred to as ``Call'') is the initial step in a multiple-sale process that incorporates planning and analysis for lease sales in the Beaufort Sea and Chukchi Sea planning areas included in the proposed final OCS Oil and Gas Leasing Program 2007-2012 (see 72 Federal Register (FR) 24326, May 2, 2007). Four lease sales are addressed in this Call; two in the Beaufort Sea (sales 209 and 217) and two in the Chukchi Sea (sales 212 and 221). (Sale 193 in the Chukchi Sea is a carryover from the Program for 2002-2007 and is not addressed by this Call.) Simultaneously with this Call, MMS is giving notice of its intent to prepare a multiple-sale EIS for the four sales.

The MMS announces the availability of the Proposed Notice of Sale for Oil and Gas Lease Sale 193 in the Chukchi Sea. This Notice is published pursuant to 30 CFR 256.29(c) as a matter of information to the public. With regard to oil and gas leasing on the OCS, the Secretary of the Interior, pursuant to section 19 of the OCS Lands Act, provides the affected States the opportunity to review the Proposed Notice. The Proposed Notice sets forth the proposed terms and conditions of the sale, including minimum bids, royalty rates, and rentals.

Outer Continental Shelf (OCS), Eastern Gulf of Mexico (GOM), Proposed Oil and Gas Lease Sale 224, March 2008
The MMS has prepared a draft supplemental environmental impact statement (SEIS) on a tentatively scheduled 2008 oil and gas leasing proposal (Sale 224) in the Eastern GOM, off the States of Louisiana, Mississippi, Alabama, and Florida. As mandated in the recently enacted Gulf of Mexico Energy Security Act (GOMESA) of 2006 (Pub. L. 109-432, December 20, 2006), the MMS shall offer a portion of the ``181 Area,'' located in the Eastern Planning Area, more than 125 miles from Florida for oil and gas leasing. The proposed action involves 130 tracts.

Preparation of an Environmental Assessment for Proposed Outer Continental Shelf Oil and Gas Lease Sale 206 in the Central Gulf of Mexico (2008)
The Minerals Management Service (MMS) is issuing this notice to advise the public, pursuant to the National Environmental Policy Act of 1969 (NEPA), as amended, 42 U.S.C. 4321 et seq., that MMS intends to prepare an environmental assessment (EA) for proposed Outer Continental Shelf (OCS) oil and gas Lease Sale 206 in the Central Gulf of Mexico (GOM) scheduled for March 2008. The MMS is issuing this notice to facilitate public involvement. The preparation of this EA is an important step in the decision process for Lease Sale 206. The proposal for Lease Sale 206 was identified by the Call for Information and Nominations published in the Federal Register on April 28, 2006, and was analyzed in the Gulf of Mexico OCS Oil and Gas Lease Sales: 2007- 2012; Western Planning Area Sales 204, 207, 210, 215, and 218; Central Planning Area Sales 205, 206, 208, 213, 216, and 222Final Environmental Impact Statement; Volumes I and II (Multisale EIS, OCS EIS/EA MMS 2007-018). The proposal does not include approximately 5.8 million acres located in the southeastern part of the Central Planning Area (CPA) which the Gulf of Mexico Energy Security Act of 2006 opened to leasing after many years of appropriations Acts containing leasing moratoria. Because of the limited geological and geophysical data available to industry and the limited environmental review for this area, the MMS has decided that it would be premature to offer this area in proposed Lease Sale 206. Before this area is offered for lease, the MMS will conduct a separate NEPA review to reevaluate the expanded CPA sale area. This EA for proposed Lease Sale 206 will reexamine the potential environmental effects of the proposed lease sale and its alternatives (excluding the unleased blocks near biologically sensitive topographic features; excluding the unleased blocks within 15 miles of the Baldwin County, Alabama, coast; use of a nomination and tract selection leasing system; and no action) based on any new information regarding potential impacts and issues that were not available at the time the Multisale EIS was prepared.
