This notice publishes the Secretary's certification of the Nottawaseppi Huron Band of the Potawatomi Indian Liquor Ordinance. The Ordinance regulates and controls the possession, sale, and consumption of liquor within the tribal lands. The tribal lands are located in Indian Country and this Ordinance allows for possession and sale of alcoholic beverages within their boundaries. This Ordinance will increase the ability of the tribal government to control the tribe's liquor distribution and possession, and at the same time will provide an important source of revenue for the continued operation and strengthening of the tribal government and the delivery of tribal services.

This notice publishes an amendment to the Salt River Pima- Maricopa Indian Community's Code of Ordinances, Chapter 14, Articles I and II. This amended Code of Ordinances was last published on May 8, 1998 (63 FR 25516). Chapter 14 of the Code regulates and controls the possession, sale and consumption of liquor within the Salt River Pima- Maricopa Indian Community's trust lands specified in Attachment A of Article II. The Code allows for the possession and sale of alcoholic beverages within Salt River Pima-Maricopa Indian Community trust lands. This Code will increase the ability of the tribal government to control the distribution and possession of liquor within its reservation and at the same time will provide an important source of revenue and strengthening of the tribal government and the delivery of tribal services.

This notice informs the public that the Deputy Assistant Secretary for Policy and Economic Development proclaimed approximately 351.8363 acres, more or less, to be added to the Pueblo of Laguna Reservation (Laguna), New Mexico.

This notice publishes an amendment to the Tulalip Tribe's Liquor Control Ordinance published in the Federal Register September 16, 1977 (42 FR 46612). The amendment regulates and controls the possession and consumption of liquor within the tribal lands. The tribal lands are located in Indian country and this amended Ordinance allows for possession of alcoholic beverages within their boundaries. This Ordinance will increase the ability of the tribal government to control liquor sales, possession and consumption by the community and its members.

The Energy and Mineral Development Program (EMDP) provides funding to tribes with the mission goal of assessing, evaluating, and promoting energy and mineral resources on Indian trust lands for the economic benefit of Indian mineral owners. To achieve these goals, the Department of the Interior's Office of Indian Energy and Economic Development (IEED), through its Division of Energy and Mineral Development (DEMD) office, is soliciting proposals from tribes. The Department will use a competitive evaluation process to select several proposed projects to receive an award.

In compliance with the Paperwork Reduction Act of 1995, this notice announces that the Bureau of Indian Affairs is seeking to extend clearance for an information collection request. The information collection, Tribal Reassumption of Jurisdiction over Child Custody Proceedings, is cleared under OMB Control Number 1076-0112. Interested parties are invited to comment on this collection.

In accordance with the Federal Advisory Committee Act, the Bureau of Indian Education (BIE) is announcing that the Advisory Board for Exceptional Children will hold its next meeting in Albuquerque, New Mexico. The purpose of the meeting is to meet the mandates of the Individuals with Disabilities Education Improvement Act of 2004 on Indian children with disabilities.

In this notice, the Office of Self-Governance (OSG) establishes a March 2, 2009, deadline for Indian tribes/consortia to submit completed applications to begin participation in the tribal self-governance program in fiscal year 2010 or calendar year 2010.

The Bureau of Indian Affairs (BIA) is seeking comments from the public on a renewal of an information collection from Indian tribes participating in and Indian tribes seeking to participate in the Tribal Self-Governance, as required by the Paperwork Reduction Act. The information collected under OMB Clearance Number, 1076-0143, will be used to meet reporting requirements of the Tribal Self-Governance Act and implement requirements for entry into a pool of qualified applicants to be selected to begin participation in Tribal Self- Governance. The information collection requirements are periodically reviewed because the number of Indian tribes participating in Tribal Self-Governance increases over time and the number of Indian tribes requesting to be selected to begin participation in Tribal Self- Governance may vary over time. This action is being taken to make sure that the requirements are not burdensome.

This notice publishes the Secretary's certification of the Navajo Nation Liquor Regulations. These Regulations regulate and control the possession, sale and consumption of liquor within the Navajo Nation. The Navajo Nation is located on extensive reservation lands, and these Regulations establish a legal framework for licensing the transportation and sale of alcoholic beverages within the exterior boundaries of the Nation. These regulations will ensure the ability of the tribal government to control the distribution and possession of liquor within the reservation and at the same time will provide an important source of revenue. These Regulations provide solely for civil enforcement (fines) imposed on parties whose actions are subject to the licensing provisions set forth herein. Any violation of these regulations may also result in prosecution under other sections of the Navajo Nation Code, or under relevant State or Federal law.

In compliance with the Paperwork Reduction Act, this notice announces that the Bureau of Indian Affairs is submitting an information collection to the Office of Management and Budget for renewal. The collection concerns Reindeer in Alaska, OMB Control 1076-0047. We are requesting a renewal of clearance and requesting comments on this information collection.

This rule establishes procedures for Indian tribes and States to submit Tribal-State compacts and compact amendments, governing the conduct of class III gaming activities on the tribe's Indian lands located within that State, for review and approval by the Secretary of the Interior.

This final rule amends several Bureau of Indian Affairs (BIA) and Office of the Secretary regulations related to Indian trust management in the areas of probate, probate hearings and appeals, tribal probate codes, and life estates and future interests in Indian land. This rule allows the Secretary to further fulfill his fiduciary responsibilities to federally recognized tribes and individual Indians and to meet the Indian trust management policies articulated by Congress in the Indian Land Consolidation Act (ILCA), as amended by the American Indian Probate Reform Act of 2004 (AIPRA).

This publishes notice of an Amendment to a Compact between the Pokagon Band of Potawatomi Indians and the State of Michigan providing for the conduct of Tribal-State Class III gaming by the Pokagon Band of Potawatomi Indians taking effect.

The Secretary of the Interior is announcing the Department's intent to form a negotiated rulemaking committee to develop recommendations for proposed regulations regarding Bureau of Indian Education (BIE)-funded school facilities under the No Child Left Behind Act of 2001. As required by the No Child Left Behind Act, the Secretary will select representatives of Indian tribes for the committee from among individuals nominated by tribes whose students attend BIE-funded schools either operated by the bureau or by the tribe through a contract or grant. To the maximum extent possible, the proportional representation of tribes on the committee will reflect the proportionate share of students from tribes served by the BIE-funded school system. In addition, the Secretary will consider the balance of representation with regard to geographical location, size, and type of school and facility, as well as the interests of parents, teachers, administrators, and school board members, in selecting tribal committee representatives. As required in the NCLB Act, the committee shall prepare and submit to the Secretary of the Interior a report or reports setting out: A method for creating a catalog of school facilities; The school replacement and new construction needs of the interested parties, and a formula for the equitable distribution of funds to address those needs; The major and minor renovation needs of the interested parties, and a formula for the equitable distribution of funds to address such needs; and Facilities standards for home-living (dormitory) situations.

This publishes notice of the 2008 Class III Gaming Compact between the Nez Perce Tribe and the State of Idaho taking effect.

This notice advises the public that the Bureau of Indian Affairs (BIA) has replaced the National Indian Gaming Commission (NIGC) as lead agency in the preparation of an Environmental Impact Statement (EIS) for a proposed casino and hotel project to be located near Friant, in Fresno County, California. The BIA, with the Big Sandy Rancheria Band of Western Mono Indians (Tribe) as a cooperating agency, intends to gather information necessary for preparing the EIS. The NIGC initiated the public scoping process, including a public scoping meeting on September 15, 2005, to determine the issues, concerns and alternatives to be included in the EIS. The BIA is hereby continuing that process, but as project plans have not changed since the September 15, 2005, meeting, will not be holding additional public scoping meetings.

This notice advises the public that the Bureau of Indian Affairs (BIA), in cooperation with the Joint Business Council of the Eastern Shoshone and Northern Arapaho Tribes, Bureau of Land Management and U.S. Environmental Protection Agency (EPA), intends to file a Final Environmental Impact Statement (FEIS) with EPA for the proposed coal bed natural gas and conventional gas development project, and that the FEIS is now available to the public.

The Bureau of Indian Affairs published a document in the Federal Register of August 13, 2008, concerning the amended Metlakatla Indian Community Alcohol Possession Code. The document included a section deleted in the original.

In compliance with the Paperwork Reduction Act, this notice announces that the Bureau of Indian Affairs (BIA) is proposing to renew the information collections for OMB Control Number 1076-0114, Application for Admission to Haskell Indian Nations University (HINU) and Southwestern Indian Polytechnic Institute (SIPI); OMB Control Number 1076-0134, Student Transportation Form, Subpart H, 25 CFR 39; and OMB Control Number 1076-0122, Data Elements for Student Enrollment in Bureau-funded Schools. These collections help support the educational efforts for Native American students from elementary through post-secondary levels. These collections help fulfill the trust responsibility of the Secretary of the Department of the Interior. We are requesting comments on these information collections.

On July 2, 2008, the Bureau of Indian Affairs (BIA) proposed a rule to establish procedures for Indian tribes and States to submit Tribal-State compacts and compact amendments, governing the conduct of class III gaming activities on the tribe's Indian lands located within that State, for review and approval by the Secretary of the Interior (see 73 FR 37907). This notice extends the comment period for that proposed rule by 20 days, to September 22, 2008.
