Endangered and Threatened Wildlife and Plants; 90-Day Finding on a Petition To List Mimulus gemmiparus
We, the U.S. Fish and Wildlife Service (Service), announce a 90-day finding on a petition to list Mimulus gemmiparus (Rocky Mountain monkeyflower; also known as budding monkeyflower, or Weber's monkeyflower) as an endangered or threatened species throughout its entire range and to designate critical habitat under the Endangered Species Act of 1973, as amended (Act). For the purposes of this document, we will refer to Mimulus gemmiparus as Rocky Mountain monkeyflower. Based on our review, we find that the petition presents substantial scientific or commercial information indicating that listing Rocky Mountain monkeyflower may be warranted. Therefore, with the publication of this notice, we will be initiating a review of the status of the species to determine whether listing Rocky Mountain monkeyflower is warranted. To ensure that this status review is comprehensive, we are requesting scientific and commercial data and other information regarding this species. Based on the status review, we will issue a 12-month finding on the petition, which will address whether the petitioned action is warranted, as provided in section 4(b)(3)(B) of the Act. We will make a determination on critical habitat for this species if and when we initiate a listing action.

We, the U.S. Fish and Wildlife Service (Service), announce a 90-day finding on a petition to list the Prince of Wales flying squirrel (Glaucomys sabrinus griseifrons) as an endangered or threatened species under the Endangered Species Act of 1973, as amended (Act), and to designate critical habitat. Based on our review, we find that the petition does not present substantial information indicating that listing this subspecies may be warranted. Therefore, we are not initiating a status review in response to this petition. However, we ask the public to submit to us any new information that becomes available concerning the status of, or threats to, the Prince of Wales flying squirrel or its habitat at any time.

We, the U.S. Fish and Wildlife Service (FWS) and the National Marine Fisheries Service (NMFS) (collectively referred to as the ``Services'' or ``we''), propose to revise our regulations pertaining to impact analyses conducted for designations of critical habitat under the Endangered Species Act of 1973, as amended (the Act). These changes are being proposed as directed by the President's February 28, 2012, memorandum, which directed us to take prompt steps to revise our regulations to provide that the economic analysis be completed and made available for public comment at the time of publication of a proposed rule to designate critical habitat.

Endangered and Threatened Wildlife and Plants; Endangered Status for Four Central Texas Salamanders and Designation of Critical Habitat
We, the U.S. Fish and Wildlife Service (Service), propose to list the Austin blind salamander, Jollyville Plateau salamander, Georgetown salamander, and Salado salamander as endangered under the Endangered Species Act of 1973, as amended (Act), and propose to designate critical habitat for the species. In total, we propose to designate approximately 5,983 acres (2,440 hectares) as critical habitat for the four species. The proposed critical habitat is located in Travis, Williamson, and Bell Counties, Texas.
Texas Mid-Coast National Wildlife Refuge Complex, Brazoria, Fort Bend, Matagorda, and Wharton Counties, TX; Comprehensive Conservation Plan and Environmental Assessment; Correction
On August 15, 2012, we, the U.S. Fish and Wildlife Service, published a notice announcing the availability of a draft comprehensive conservation plan (CCP) and an environmental assessment (EA) for public review and comment. The draft CCP/EA describes our proposal for managing the Texas Mid-Coast National Wildlife Refuge Complex for the next 15 years. In that notice, we gave an incorrect comment-period end date. We are now republishing the notice with the correct date. If you already submitted a comment, you need not resubmit it.
Proposed Safe Harbor Agreement for the Northern Spotted Owl, Skamania, Klickitat, and Yakima Counties, WA, and Hood River and Wasco Counties, OR
SDS Company LLC (SDS) and the Broughton Lumber Company (BLC), hereafter referred to as the applicants, have applied to the U.S. Fish and Wildlife Service (Service) for an enhancement of survival permit (permit) under the Endangered Species Act of 1973, as amended (ESA). The permit application includes a draft Safe Harbor Agreement (SHA) and a draft Implementing Agreement (IA). Pursuant to the Service's responsibility to comply with the National Environmental Policy Act (NEPA), the application package also includes a draft Environmental Assessment (EA). The Service invites the public to review and comment on the draft SHA, the draft IA, and draft EA.
Trinity Adaptive Management Working Group
The Trinity Adaptive Management Working Group (TAMWG) affords stakeholders the opportunity to give policy, management, and technical input concerning Trinity River (California) restoration efforts to the Trinity Management Council (TMC). The TMC interprets and recommends policy, coordinates and reviews management actions, and provides organizational budget oversight. This notice announces a TAMWG meeting, which is open to the public.

Special Purpose Permit Application; Hawaii-Based Shallow-Set Longline Fishery; Final Environmental Assessment and Finding of No Significant Impact
We, the Fish and Wildlife Service, announce the availability of a final environmental assessment (FEA) and finding of no significant impact (FONSI) in our analysis of permitting actions in response to an application under the Migratory Bird Treaty Act of 1918, as amended, from the Pacific Islands Regional Office of the National Marine Fisheries Service (NMFS), Department of Commerce. NMFS applied for a permit for the incidental take of migratory birds in the operation of the Hawaii-based shallow-set longline fishery, which targets swordfish. After evaluating several alternatives in a draft environmental assessment (DEA), we have determined that issuing a permit will not result in significant impacts to the human environment.

We, the U.S. Fish and Wildlife Service (Service), propose to designate critical habitat for the jaguar (Panthera onca) under the Endangered Species Act of 1973, as amended (Act). In total, we propose to designate as critical habitat approximately 339,220 hectares (838,232 acres) in Pima, Santa Cruz, and Cochise Counties, Arizona, and Hidalgo County, New Mexico.
Draft Environmental Assessment and Draft Habitat Conservation Plan for TransCanada Keystone Pipeline's Gulf Coast Project in Oklahoma

Migratory Bird Hunting; Proposed Frameworks for Late-Season Migratory Bird Hunting Regulations
The Fish and Wildlife Service (hereinafter Service or we) is proposing to establish the 2012-13 late-season hunting regulations for certain migratory game birds. We annually prescribe frameworks, or outer limits, for dates and times when hunting may occur and the number of birds that may be taken and possessed in late seasons. These frameworks are necessary to allow State selections of seasons and limits and to allow recreational harvest at levels compatible with population and habitat conditions.

The draft CCP/EA describes two alternatives for managing Presquile NWR for the next 15 years. Alternative B is identified as the Service-preferred alternative. Also available for public review and comment are the draft compatibility determinations, which are included as appendix B in the draft CCP/EA.

Based on our review, we find that the petition requesting listing of the Morand's checkerspot butterfly does not present substantial information indicating that listing that species may be warranted. In addition, based on our review, we find that the petition requesting listing of the two Spring Mountains dark blue butterflies presents substantial scientific or commercial information indicating that listing these species may be warranted. Therefore, with the publication of this notice, we will initiate status reviews of the two Spring Mountains dark blue butterflies to determine whether listing is warranted. To ensure that these status reviews are comprehensive, we are requesting scientific and commercial data and other information regarding these two subspecies. Based on these status reviews, we will issue a 12-month finding on the petition, which will address whether the petitioned action is warranted, as provided in section 4(b)(3)(B) of the Act.

This proposed action is based on a review of the best available scientific and commercial data which indicates that the endangered designation no longer correctly reflects the status of the straight-horned markhor. This proposal constitutes our 12-month finding on the petition to reclassify this subspecies, serves as our 5-year review, and fulfills our obligations under a settlement agreement. We are also proposing a special rule concurrently. The effects of these regulations are to correctly reflect the status of the subspecies and encourage conservation of additional populations of the straight-horned markhor.

We, the U.S. Fish and Wildlife Service, invite the public to comment on the following applications to conduct certain activities with endangered species, marine mammals, or both. With some exceptions, the Endangered Species Act (ESA) and Marine Mammal Protection Act (MMPA) prohibit activities with listed species unless Federal authorization is acquired that allows such activities.

We, the Fish and Wildlife Service (Service), announce the availability of an incidental take permit (ITP) application and Habitat Conservation Plan (HCP). Wayne Cimato (applicant) requests an ITP under the Endangered Species Act of 1973, as amended (Act). The applicant anticipates taking about 1 acre of Florida scrub-jay habitat in Charlotte County, Florida, for the construction of a single-family residence and associated infrastructure. The applicant's HCP describes the minimization and mitigation measures proposed to address the effects of the project on the scrub-jay.
Adoption and Notice of Availability of a Final Environmental Assessment for the Penobscot River Restoration Project
The U.S. Fish and Wildlife Service (Service) hereby gives notice of its intent to adopt the Federal Energy Regulatory Commission's (Commission) existing Final Environmental Assessment (FEA) for the Application for Surrender of License of the Veazie, Great Works, and Howland Projects. The FEA, issued on May 18, 2010, evaluates the environmental impacts that would result from the Commission approving the applications for license surrender. The Penobscot River Restoration Project (PRRP) seeks to restore diadromous fish to the Penobscot River and key tributaries in accordance with the Lower Penobscot River Basin Comprehensive Settlement Agreement (Agreement), to which the U.S. Department of the Interior (Department) is a signatory. The Service intends to approve mechanisms to assist with funding the PRRP because it will provide substantial benefits for diadromous fish. Based on the Service's independent evaluation, adoption of the FEA would meet the Department's and the Service's National Environmental Policy Act (NEPA) procedures and guidelines, as the Service is funding the precise actions, the effects of which have already been analyzed by the Commission. As part of that process, the Service is recirculating the FEA as its final Environmental Assessment in accordance with the Service's adoption requirements.

The applicant anticipates taking about 75 acres of Florida scrub-jay habitat in Lee County, Florida, for the construction of a 215-acre multi-use recreational park, several nearby single-family residences, and associated infrastructure. The applicant's HCP describes the minimization and mitigation measures proposed to address the effects of the project on the scrub-jay.
Endangered and Threatened Wildlife and Plants; Revising the Special Rule for the Utah Prairie Dog
Under the Endangered Species Act of 1973, as amended (ESA), we, the U.S. Fish and Wildlife Service (Service/USFWS), revise our special regulations for the conservation of the Utah prairie dog. We are revising our special regulations to provide limits to the allowable take, including limits to where permitted take can occuragricultural lands, properties within 0.8 kilometers (km) (0.5 miles (mi)) of conservation lands, and areas where Utah prairie dogs cause serious human safety hazards or disturb the sanctity of significant human cultural or human burial sites; the amount of take that can be permitted; methods of take that can be permitted; and seasonal limitations on direct lethal take. We are also allowing entities other than the Utah Division of Wildlife Resources to permit take. We are also issuing new incidental take exemptions for otherwise legal activities associated with standard agricultural practices. All other provisions of the special rule not relating to these amendments remain unchanged.
Endangered and Threatened Wildlife and Plants; Listing the British Columbia Distinct Population Segment of the Queen Charlotte Goshawk Under the Endangered Species Act
We, the U.S. Fish and Wildlife Service, hereby list the British Columbia distinct population segment (DPS) of the Queen Charlotte goshawk (Accipiter gentilis laingi) as threatened under the Endangered Species Act of 1973, as amended (Act). This final rule implements the Federal protections provided by the Act for this subspecies in British Columbia, Canada, on Vancouver Island and the surrounding smaller islands, the Queen Charlotte Islands, and the coastal mainland and adjacent islands west of the crest of the Coast Mountains. Because the British Columbia DPS is entirely outside the United States, we are not designating critical habitat.
