We, the U.S. Fish and Wildlife Service (Service), determine threatened species status under the Endangered Species Act of 1973 (Act), as amended, for a subspecies of butterfly (Speyeria nokomis nokomis), a silverspot butterfly from Colorado, New Mexico, and Utah. We also finalize a rule issued under the authority of section 4(d) of the Act that provides measures that are necessary and advisable to provide for the conservation of this subspecies. We have determined that the designation of critical habitat is not prudent.

This rule revises U.S. Department of the Interior regulations implementing the Native American Graves Protection and Repatriation Act (NAGPRA) to provide for annual adjustments of civil penalties to account for inflation under the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 and Office of Management and Budget guidance. The purpose of these adjustments is to maintain the deterrent effect of civil penalties and to further the policy goals of the underlying statute.

The United States Department of the Army, Corps of Engineers (USACE), has filed an application with the Bureau of Land Management (BLM) requesting that the Secretary of the Interior extend Public Land Order (PLO) No. 7608 for an additional 20-year term. Subject to valid existing rights, PLO No. 7608 withdrew 400.27 acres of public lands from settlement, sale, location, or entry under the general land laws, including the United States mining laws, and transferred jurisdiction over those lands to the Department of the Army for the Chief Joseph Dam Additional Units Project for a period of 20 years. This notice advises the public of a 90-day opportunity to comment on the withdrawal extension application and to request a public meeting.
