We, the U.S. Fish and Wildlife Service (Service), announce 90- day findings on two petitions to list two species (Flat-tailed tortoise (Pyxis planicauda) and Spider tortoise (Pyxis arachnoides)) as endangered or threatened and one petition to list one species (Pygmy three-toed sloth (Bradypus pygmaeus)) as endangered under the Endangered Species Act of 1973, as amended (Act). Based on our review, we find that these petitions present substantial scientific or commercial information indicating that the petitioned actions may be warranted. Therefore, with the publication of this document, we are initiating a review of the status of these species to determine if the petitioned actions are warranted. To assure that the best scientific and commercial data informs the status review and, if warranted, the subsequent listing determinations, and to provide an opportunity for all interested parties to provide information for consideration for the status assessment, we are requesting information regarding these species (see Request for Information, below). Based on the status reviews, we will issue 12-month findings on the petitions, which will address whether the petitioned action is warranted, as provided in section 4(b)(3)(B) of the Act.

Notice is hereby given that effective with this publication, the following NAD 27-based Outer Continental Shelf (OCS) Official Protraction Diagrams (OPDs) and Supplemental Official OCS Block Diagrams (SOBDs) located in the Gulf of Mexico with revision date as indicated, are now available. The BOEM, in accordance with its authority and responsibility under the Outer Continental Shelf Lands Act, 43 USC 1331 et seq., is updating the basic record used for the description of renewable energy, mineral, and oil and gas lease sales in the geographic areas they represent. Specifically, the 1.4 nautical mile ``Area'' designation as described in Article IV, Paragraph 1, of the Treaty between the United States of America and the United Mexican States on the delimitation of the continental shelf in the Western Gulf of Mexico beyond 200 nautical miles, signed June 9, 2000, has been removed from the Keathley Canyon, Sigsbee Escarpment, and Amery Terrace OPDs and associated SOBDs. Other information associated with the ``Area'' has been removed as well. Article IV, Paragraph 1, prohibited exploration and development in the ``Area.'' Pursuant to a Note signed by the U.S. and Mexico on June 22, 2010, Article IV, Paragraph 1, of the 2000 Treaty was due to expire on January 17, 2014. The expiration date was extended by exchange of diplomatic notes on January 17, 2014, to July 17, 2014, or until the day the Agreement between the United States of America and the United Mexican States Concerning Transboundary Hydrocarbon Reservoirs in the Gulf of Mexico enters into force, whichever is sooner. Due to the upcoming expiration of Article IV, Paragraph 1, of the Treaty, BOEM is updating relevant OPDs and SOBDs accordingly.
Deepwater Horizon Oil Spill; Final Programmatic and Phase III Early Restoration Plan and Final Early Restoration Programmatic Environmental Impact Statement

In accordance with the Oil Pollution Act of 1990 (OPA) and the National Environmental Policy Act (NEPA), notice is hereby given that the Federal and State natural resource trustee agencies (Trustees) have prepared a Final Programmatic and Phase III Early Restoration Plan and Final Early Restoration Programmatic Environmental Impact Statement (Final Phase III ERP/PEIS). The Final Phase III ERP/PEIS considers programmatic alternatives comprised of early restoration project types that would restore natural resources, ecological services, and recreational use services injured or lost as a result of the Deepwater Horizon oil spill and related response actions. The Trustees additionally propose to select 44 specific early restoration projects for implementation that are consistent with the proposed preferred early restoration program alternative. The Trustees have developed restoration alternatives and projects to utilize funds for early restoration being provided under the Framework for Early Restoration Addressing Injuries Resulting from the Deepwater Horizon Oil Spill (Framework Agreement) discussed below. The Final Phase III ERP/PEIS evaluates these programmatic restoration alternatives and projects under criteria set forth in the natural resource damage assessment regulations and the Framework Agreement. The Final Phase III ERP/PEIS also evaluates the environmental consequences of the restoration alternatives and projects under NEPA. The purpose of this notice is to inform the public of the availability of the Final Phase III ERP/PEIS.

On April 8, 2014, we, the U.S. Fish and Wildlife Service (Service), announced a reopening of the public comment period on the October 28, 2013, proposal to list the Bi-State distinct population segment (DPS) of greater sage-grouse (Bi-State DPS; Centrocercus urophasianus) as threatened under the Endangered Species Act of 1973, as amended, with a special rule, and the proposed designation of critical habitat. This document announces an extension of the comment period on the proposed critical habitat rule. We also announce the availability of a draft economic analysis (DEA) of the proposed designation of critical habitat for the Bi-State DPS and an amended required determinations section of the proposal. We are extending the comment period to allow all interested parties an opportunity to comment simultaneously on the proposed critical habitat rule, the associated DEA, and the amended required determinations section. Comments previously submitted need not be resubmitted, as they will be fully considered in preparation of the final critical habitat rule. The comment period on the associated proposed listing rule is not being extended and closes on June 9, 2014.

2014 Final Fee Rate and Fingerprint Fees

Notice is hereby given, pursuant to 25 CFR 514.2, that the National Indian Gaming Commission has adopted its 2014 final annual fee rates of 0.00% for tier 1 and 0.070% (.00070) for tier 2. These rates shall apply to all assessable gross revenues from each gaming operation under the jurisdiction of the Commission. If a tribe has a certificate of self-regulation under 25 CFR part 518, the 2014 final fee rate on Class II revenues shall be one-half of the annual fee rate, which is 0.035% (.00035). The final fee rates being adopted here are effective June 1st, 2014 and will remain in effect until new rates are adopted. Pursuant to 25 CFR 514.16, the National Indian Gaming Commission has also adopted its fingerprint processing fees of $22 per card, which is the same as the fingerprint fees announced in March 2014.

The National Geospatial Advisory Committee (NGAC) will meet on June 24-25, 2014 at the South Interior Building Auditorium, 1951 Constitution Avenue NW., Washington, DC 20240. The meeting will be held in the first floor Auditorium. The NGAC, which is composed of representatives from governmental, private sector, non-profit, and academic organizations, was established to advise the Federal Geographic Data Committee (FGDC) on management of Federal geospatial programs, the development of the National Spatial Data Infrastructure (NSDI), and the implementation of Office of Management and Budget (OMB) Circular A-16. Topics to be addressed at the meeting include: Leadership Dialogue. FGDC Report (National Geospatial Data Asset Management Plan, Geospatial Platform). NSDI Strategic Plan Implementation. NGAC Subcommittee Reports. 3D Elevation Program Update. FirstNet Update. The meeting will include an opportunity for public comment on June 25. Comments may also be submitted to the NGAC in writing. Members of the public who wish to attend the meeting must register in advance. Please register by contacting Arista Maher at the U.S. Geological Survey (703-648-6283, amaher@usgs.gov). Registrations are due by June 20, 2014. While the meeting will be open to the public, registration is required for entrance to the South Interior Building, and seating may be limited due to room capacity.

We, the U.S. Fish and Wildlife Service (Service), announce the reopening of the public comment period on the August 2, 2013, proposed designation of critical habitat for the Physaria globosa (Short's bladderpod), Helianthus verticillatus (whorled sunflower), and Leavenworthia crassa (fleshy-fruit gladecress) under the Endangered Species Act of 1973, as amended (Act). We also announce the availability of a draft economic analysis (DEA) of the proposed designation for these species as well as an amended required determinations section of the proposal. We also propose to increase the proposed designation of critical habitat for Leavenworthia crassa by approximately 0.04 hectare (0.1 acre) by adding one unit in Lawrence County, Alabama. We are reopening the comment period to allow all interested parties an opportunity to comment simultaneously on the revised proposed rule, the associated DEA, and the amended required determinations section. Comments previously submitted need not be resubmitted, as they will be fully considered in preparation of the final rule.

This order extends the duration of the withdrawal created by Public Land Order No. 7393, which was issued effective May 28, 1999, for an additional 15-year period. The extension is necessary to continue protection of the Spencer Glacier Material Site, which was established on behalf of the United States Forest Service in order to make high quality rock and gravel available from the site to nearby communities for private and public works projects.
Notice of Designation of Potential Wilderness as Wilderness, Congaree National Park, South Carolina

The Congaree Swamp National Monument Expansion and Wilderness Act of 1988 (Pub. L. 100-524, October 24, 1988) designated approximately 15,010 acres of Congaree Swamp National Monument, now Congaree National Park, as wilderness, and approximately 6,840 acres as potential wilderness additions. Section 2(b) of Public Law 100-524 authorizes the Secretary of the Interior to convert any designated potential wilderness at Congaree National Park to designated wilderness upon publication in the Federal Register of a notice that any non- Federal interests in land have been acquired and all uses thereon prohibited by the Wilderness Act of 1964 (Pub. L. 88-577) have ceased. Accordingly, this notice hereby converts approximately 6,690 acres of designated potential wilderness at Congaree National Park to designated wilderness. The converted acreage comprises all but about 60 acres of designated potential wilderness in the park that have been acquired to date by the United States. The approximately 90 acres of private land still remaining within the park's designated potential wilderness are not affected by this Notice. These private lands, if acquired by the United States, may be converted to designated wilderness at a later date. A map showing the lands hereby converted to designated wilderness is on file at the administrative office of Congaree National Park. All interests in the lands converted to designated wilderness via this Notice have been acquired by the United States, and there are no current, or proposed, uses of the 6,690 acres that are incompatible with wilderness designation. These 6,690 acres shall be added to the 15,010 acres of designated wilderness within the Congaree National Park Wilderness and managed in accordance with the Wilderness Act of 1964.

Pursuant to 102(2)(C) of the National Environmental Policy Act of 1969, 42 U.S.C. 4332(2)(C), the National Park Service (NPS), announces the availability of the Final Environmental Impact Statement (FEIS) for the Fishery Management Plan (FMP) for Biscayne National Park (Park), Florida. The authority for publishing this notice is 40 CFR 1506.6. The FMP is designed to guide fishery management decisions in the park for the next five to ten years. An FMP is needed to guide sustainable use of the Park's fishery-related resources, as recent studies suggest that many of these resources are in decline. The development of the alternatives and the identification of the preferred alternative were based on a combination of public input from three public comment periods and three series of public meetings, the input of the FMP Working Group, inter-agency meetings, and environmental and socioeconomic analyses.
