Notice is hereby given that effective immediately, the Bureau of Land Management (BLM), Monticello Field Office, is closing 1,835 acres of public lands in Bluff, Utah, to Off Road Vehicle (ORV) use. The public lands affected by this closure are in the following sections of T. 40 S., R. 21 E., SLB&M: Section 14, E\1/2\; Section 22, All; Section 23, NE(f), W\1/2\, N\1/2\SE\1/4\, N\1/2\S\1/2\SE\1/4\, S\1/ 2\S\1/4\SE(f); Section 26, NW\1/4\NE\1/4\(f), N\1/2\NW\1/4\(f) Section 27, N\1/2\N\1/2\NE\1/4\, S\1/2\NW\1/4\NE\1/4\, N\1/2\NW\1/4\(f) ((f) fractional portion). The purpose of the closure is to protect soils, vegetation and cultural resources that have been adversely impacted or are at risk of being adversely impacted by ORV use. The closure will remain in effect until the considerable adverse effects giving rise to the closure are eliminated and measures are implemented to prevent recurrence of these adverse effects.

The Bureau of Land Management (BLM) Redding Field Office intends to amend the Redding Resource Management Plan (RMP), changing the existing language of the RMP which specifies that the primary means for land tenure adjustment will be through land exchanges. At present land sales are allowed only for small-acreage, low-value parcels. The proposed change would enable disposal of lands by sales or exchanges, or by legislative transfer. This amendment would not change the status of lands presently identified for retention or for disposal in the RMP. Sale proceeds will be used in the same manner as exchange properties, for the acquisition of lands in those areas identified for acquisition in the RMP, pursuant to the Federal Land Transaction Facilitation Act (FLTFA), dated July 25, 2000.

We, the U.S. Fish and Wildlife Service (Service), in cooperation with the States of Tennessee and Alabama and with Conservation Fisheries, Inc., a nonprofit organization, plan to reintroduce one federally listed endangered fish, the boulder darter (Etheostoma wapiti), and one federally listed threatened fish, the spotfin chub (Cyprinella (=Hybopsis) monacha), into their historical habitat in Shoal Creek (a tributary to the Tennessee River), Lauderdale County, Alabama, and Lawrence County, Tennessee. Based on the evaluation of species' experts, these species currently do not exist in this reach or its tributaries. These two fish are being reintroduced under section 10(j) of the Endangered Species Act of 1973, as amended (Act), and would be classified as a nonessential experimental population (NEP). The geographic boundaries of the NEP would extend from the mouth of Long Branch, Lawrence County, Tennessee (Shoal Creek mile (CM) 41.7 (66.7 kilometers (km)), downstream to the backwaters of the Wilson Reservoir at Goose Shoals, Lauderdale County, Alabama (approximately CM 14 (22 km)), and would include the lower 5 CM (8 km) of all tributaries that enter this reach. These reintroductions are recovery actions and are part of a series of reintroductions and other recovery actions that the Service, Federal and State agencies, and other partners are conducting throughout the species' historical ranges. This rule provides a plan for establishing the NEP and provides for limited allowable legal taking of the boulder darter and spotfin chub within the defined NEP area. In addition, we are changing the scientific name for spotfin chub, from Cyprinella (=Hybopsis) monacha to Erimonax monachus, to reflect a recent change in the scientific literature, and adding a map to the regulation for a previously created NEP including one of these fishes for the purposes of clarity.

The U.S. Fish and Wildlife Service (Service or we) is establishing migratory bird subsistence harvest regulations in Alaska for the 2005 season. This final rule prescribes frameworks, or outer limits, for dates when harvesting of birds may occur, species that can be taken, and methods and means that would be excluded from use. These regulations were developed under a co-management process involving the Service, the Alaska Department of Fish and Game, and Alaska Native representatives. These regulations are intended to provide a framework to enable the continuation of customary and traditional subsistence uses of migratory birds in Alaska. The rulemaking is necessary because the regulations governing the subsistence harvest of migratory birds in Alaska are subject to annual review. This rulemaking establishes regulations that start on April 2, 2005, and expire on August 31, 2005, for the subsistence harvest of migratory birds in Alaska.

The Minerals Management Service is issuing this notice to advise the public that MMS has prepared an environmental assessment (EA) for proposed Outer Continental Shelf (OCS) oil and gas Lease Sale 196 in the Western Gulf of Mexico (GOM) (Lease Sale 196) scheduled for August 2005. Proposed Lease Sale 196 is the fourth Western Planning Area (WPA) lease sale scheduled in the Outer Continental Shelf Oil and Gas Leasing Program: 2002-2007 (5-Year Program, OCS EIS/EA MMS 2002- 006). The preparation of this EA is an important step in the decisionmaking process for Lease Sale 196. The proposal for Lease Sale 196 (the offering of all available unleased acreage in the WPA) and its alternatives (the proposed action excluding the unleased blocks near biologically sensitive topographic features and no action) were identified by the MMS Director in January 2002 following the Call for Information and Nominations/Notice of Intent to Prepare an Environmental Impact Statement (EIS) and were analyzed in the Gulf of Mexico OCS Oil and Gas Lease Sales: 2003-2007; Central Planning Area Sales 185, 190, 194, 198, and 201; Western Planning Area Sales 187, 192, 196, and 200Final Environmental Impact Statement; Volumes I and II (Multisale EIS, OCS EIS/EA MMS 2002-052). The Multisale EIS analyzed the effects of a typical WPA lease sale by presenting a set of ranges for resource estimates, projected exploration and development activities, and impact-producing factors for any of the proposed WPA lease sales. The level of activities projected for proposed Lease Sale 196 falls within these ranges. In this EA, which tiers from the Multisale EIS and incorporates that document by reference, MMS reexamined the potential environmental effects of the proposed action and its alternatives based on any new information regarding potential impacts and issues that were not available at the time the Multisale EIS was prepared. No new significant impacts were identified for proposed Lease Sale 196 that were not already assessed in the Multisale EIS. As a result, MMS determined that a supplemental EIS is not required and prepared a Finding of No New Significant Impact (FONNSI).

Conservation Helium Sale

The purpose of this action is to continue implementation of the terms of the Helium Privatization Act (HPA) of 1996 dealing with the disposal of the Conservation Helium Reserve. The HPA requires the Department of the Interior to offer for sale, beginning no later than 2005, a portion of the Conservation Helium stored underground at the Cliffside Field, north of Amarillo, Texas. The Department of the Interior, in consultation with the private helium industry, has determined that private companies, with refining capacity along the crude helium pipeline, will need a supply of helium in excess of that available from their own storage accounts and that available from crude helium extractors in the region. Given the current market, Conservation Helium sold in this sale will cause minimal market disruption.

The RMPA will allow for selection of an alternate route for the Trail that will consider reducing mileage of the trail and reducing agency costs and timeframes associated with development of the Continental Divide National Scenic Trail. The public is invited to participate in the scoping process to identify issues and planning criteria to be considered in the development of the RMPA/EA. The BLM will maintain a mailing list of parties and persons interested in being kept informed about the RMPA/EA.

The lessee paid the required rental accruing from the date of termination. No Leases were issued that affect these lands. The lessee met the requirements for reinstatement of the Lease per Sec. 31 (d) and (e) of the Mineral Leasing Act of 1920 (30 U.S.C. 188). We, the U.S. Fish and Wildlife Service (Service), are designating no critical habitat pursuant to the Endangered Species Act of 1973, as amended (Act), for Astragalus jaegerianus (Lane Mountain milk-vetch). In our April 6, 2004 proposed rule, we identified 29,522 acres (ac) (11,947 hectares (ha)) of habitat essential for the conservation of A. jaegerianus located in the Mojave Desert in San Bernardino County, California. However, as a result of our evaluation of the relationship of essential habitat to sections 3(5)(A), 4(a)(3), and 4(b)(2) of the Act, we designate a total of zero acres (0 ac) (zero hectares (0 ha)).

We, the Fish and Wildlife Service (Service), establish an additional manatee protection area in Lee County, Florida (Pine Island- Estero Bay Manatee Refuge). This action is authorized under the Endangered Species Act of 1973, as amended (ESA) and the Marine Mammal Protection Act of 1972, as amended (MMPA), to further recovery of the Florida manatee (Trichechus manatus latirostris) by preventing the taking of one or more manatees. We are designating an area in Lee County as a manatee refuge in which certain waterborne activities will be regulated. Specifically, watercraft will be required to proceed at either ``slow speed'' or at not more than 25 miles per hour, on an annual or seasonal basis, as described in the rule. We also announce the availability of a final environmental assessment for this action.

The National Park System Advisory Board completed a servicewide review of the process used by NPS to determine the cultural affiliation of human remains and other cultural items as required under the Native American Graves and Protection Repatriation Act (25 U.S.C. 3001 et seq.) in June 2002. The final report contains five recommendations that are being implemented by revising and updating Appendix R of the Cultural Resource Management Guideline under Director's Order 28. The revised draft ``Guidance for Compliance with the Native American Graves Protection and Repatriation Act by National Park Service Offices and UnitsNPS Cultural Resource Management Guideline, Appendix R'' is now available for public comment.
General Management Plan, Final Environmental Impact Statement, Rio Grande Wild and Scenic River, Texas

Pursuant to section 102(2)(C) of the National Environmental Policy Act of 1969, codified as amended at 42 U.S.C. 4332(2)(C), the National Park Service announces the availability of the Record of Decision for the Final Environmental Impact Statement, General Management Plan for Rio Grande Wild and Scenic River, Texas. On February 8, 2005, the Associate Regional Director, Intermountain Region approved the Record of Decision for the project. As soon as practicable, the National Park Service will begin to implement the General Management Plan, described as the Preferred Alternative contained in the Final Environmental Impact Statement issued on January 7, 2005. The following course of action will occur under the preferred alternative. The protection of natural and cultural resources will be emphasized throughout the river corridor, as well as providing opportunities for traditional visitor uses. As mandated by the Wild and Scenic Rivers Act, a permanent boundary for the wild and scenic river is established for protection and management of the outstandingly remarkable values. The National Park Service will negotiate and implement cooperative agreements with nonfederal landowners that specify the rights and responsibilities of the National Park Service and each landowner. A river use plan and resource management plan will be developed for the entire river. The NPS will cooperate with other U.S agencies and the appropriate agencies in Mexico to maintain or enhance water quality and minimum flows in the river. The preferred alternative also recommends to Congress that the upstream segment of the Rio Grande in Big Bend National Park be designated as part of the Wild and Scenic River. The selected action and one other alternative were analyzed in the draft and final environmental impact statements. A full range of foreseeable environmental consequences was assessed. The full Record of Decision includes a statement of the decision made, synopses of other alternatives considered, the basis for the decision, a finding of non- impairment of park resources and values, a listing of measures to minimize environmental harm, and an overview of public involvement in the planning process.

The U.S. Fish and Wildlife Service (hereinafter the Service or we) proposes to establish annual hunting regulations for certain migratory game birds for the 2005-06 hunting season. We annually prescribe outside limits (frameworks) within which States may select hunting seasons. This proposed rule provides the regulatory schedule, describes the proposed regulatory alternatives for the 2005-06 duck hunting seasons, requests proposals from Indian tribes that wish to establish special migratory game bird hunting regulations on Federal Indian reservations and ceded lands, and requests proposals for the 2006 spring/summer migratory bird subsistence season in Alaska. Migratory game bird hunting seasons provide hunting opportunities for recreation and sustenance, aid Federal, State, and tribal governments in the management of migratory game birds, and permit harvests at levels compatible with migratory game bird population status and habitat conditions.

The prospective exclusive license will be royalty-bearing and will comply with the terms and conditions of 35 U.S.C. 209 and 37 CFR 404.7. While the primary purpose of this notice is to announce Reclamation's intent to grant an exclusive license to practice the above listed patent, it also serves to publish the availability of this patent for licensing in accordance with law. The Fish and Wildlife Service announces that a Draft Comprehensive Conservation Plan and Environmental Assessment for Lake Ophelia National Wildlife Refuge are available for review and comment. The National Wildlife Refuge System Administration Act of 1966, as amended by the National Wildlife Refuge System Improvement Act of 1997, requires the Service to develop a comprehensive conservation plan for each national wildlife refuge. The purpose in developing a comprehensive conservation plan is to provide refuge managers with a 15-year strategy for achieving refuge purposes and contributing toward the mission of the National Wildlife Refuge System, consistent with sound principles of fish and wildlife management, conservation, legal mandates, and Service policies. In addition to outlining broad management direction on conserving wildlife and their habitats, the plan identifies wildlife-dependent recreational opportunities available to the public, including opportunities for hunting, fishing, wildlife observation and photography, and environmental education and interpretation. Significant issues addressed in the draft plan include: Threatened and endangered species; waterfowl management; neotropical migratory birds; bottomland hardwood restoration; agriculture; visitor services (hunting, fishing, wildlife observation, wildlife photography, and environmental education and interpretation); funding and staffing; cultural resources; land acquisition; and forest and fragmentation. Reports from the subcommittees, brief overview of local BLM and FS funding for this year and next year and other issues that may come before the Council. The Ordinance regulates and controls the possession, sale and consumption of liquor within land under the jurisdiction of the Samish Indian Nation. The land to which this Ordinance applies is in trust. This Ordinance will increase the ability of the tribal government to control the tribe's liquor distribution and possession, and at the same time will provide an important source of revenue for the continued operation and strengthening of the tribal government and the delivery of tribal services.
