The Office of Justice Programs (OJP) of the U.S. Department of Justice published the proposed rule for the Public Safety Officers' Benefits (PSOB) Program on July 10, 2008, 73 FR 39632. During the comment period, OJP received comments on its proposed rule from numerous parties. After further review of the proposed rule and careful consideration and analysis of all comments, OJP has made amendments that are incorporated into this final rule, which is intended (insofar as consistent with law) to be effective and applicable to all claims from and after the effective date hereof, whether pending (in any stage) as of that date or subsequently filed.

The Office of Justice Programs (OJP) announces that the Review Panel on Prison Rape (Panel) will hold a hearing in Culpeper, Virginia on November 14, 2008. The hearing time and location are noted below.The purpose of the hearing is to assist the Bureau of Justice Statistics (BJS) in identifying common characteristics of victims and perpetrators of rape in county jails, and the characteristics of U.S. jails with the highest and lowest incidence of rape, based on an anonymous survey by BJS of inmates in a representative sample of jails. On June 25, 2008, BJS issued the report Sexual Victimization in Local Jails Reported by Inmates, 2007. The report provides a listing of local jails grouped according to the prevalence of reported sexual victimization, and it formed the basis of the Panel's decision about which facilities would be the subject of testimony.

The Office of Juvenile Justice and Delinquency Prevention (OJJDP) is announcing the fall meeting of the Federal Advisory Committee on Juvenile Justice (FACJJ), which will be held in San Diego, CA October 19-21, 2008. Dates and Locations: The meeting will be held at the Courtyard Marriot San Diego-Old Town, 2345 Jefferson Street, San Diego, CA 92110 at the following times: Sunday, October 19, 2008, 4 to 5:15 p.m,; Monday, October 20, 2008, 8:30 a.m. to 12:15 p.m. and 1:45 to 5:30 p.m; and Tuesday, October 20, 2008; 8 to 11 a.m.. The meeting is open to the public. On Sunday, October 19th, there will be a meeting of the FACJJ steering sub-committee from 5:30 to 8 p.m. that will be open to the public. Criminal Intelligence Systems Operating Policies

The Office of Justice Programs is publishing this proposed rule to amend its regulations that govern the operating policies of criminal intelligence systems that receive federal funding under the Omnibus Crime Control and Safe Streets Act of 1968, as amended (``Crime Control Act''). The regulations were issued pursuant to 42 U.S.C. 3789(g), which requires that ``criminal intelligence systems'' receiving Crime Control Act support must collect, maintain, and disseminate criminal intelligence information ``in conformance with policy standards which are prescribed by the Office of Justice Programs.'' The statute specifies that the policy standards must be written to assure that the funding and operation of the systems further the purpose of the funding provisions and assure that such systems ``are not utilized in violation of the privacy and constitutional rights of individuals.'' The existing regulations were last revised in 1993 and the purpose of the revisions proposed in this document is to clarify and update the regulations in light of the new, post-9/11 information sharing environment and investigative policies aimed at preventing terrorism.

The Office of Justice Programs of the U.S. Department of Justice proposes this rule to amend the regulation that implements the Public Safety Officers' Benefits Act and associated or related statutes. Generally speaking, these laws provide financial support to certain public safety officers, or their survivors and families, when such officers die, or become permanently and totally disabled, as a result of line-of-duty injuries, or when they die of heart attacks or strokes sustained within statutorily-specified timeframes of engaging or participating in certain line-of-duty activity. The proposed rule would amend the implementing regulation to reflect internal agency policy and practice, recent statutory enactments and court decisions, and to make certain technical changes, in order to keep the regulations comprehensive and current.

The Office of Justice Programs (OJP) announces the second and third hearings of the Review Panel on Prison Rape (Panel), which will be held in Washington, DC, on March 11-14, 2008, and in Houston, Texas on March 27-28, 2008. The hearing times and location are noted below. The purpose of the hearings is to assist the Bureau of Justice Statistics (BJS) in identifying common characteristics of victims and perpetrators of prison rape, and prison systems with the highest and lowest incidence of prison rape. On December 16, 2007, BJS issued the report Sexual Victimization in State and Federal Prisons Reported by Inmates, 2007. The report presents data from the National Inmate Survey, 2007 conducted in 146 state and federal prisons. The report provides a listing of state and federal prisons ranked according to the incidence of prison rape as required by the Prison Rape Elimination Act of 2003. The Panel is required to conduct separate public hearings on the operations of the three prisons with the highest incidence of prison rape and the two prisons with the lowest incidence of prison rape.
