On January 9, 2019, HUD published a Federal Register notice waiving and establishing an alternative requirement for the timing of review of Community Development Block Grant Disaster Recovery (CDBG-DR) Action Plans for Disaster Recovery and Action Plan amendments that were pending approval as of December 22, 2018. HUD took this action due to the lapse in its appropriations for Fiscal Year (FY) 2019 and the resultant inability to satisfactorily complete the review and approval process consistent with HUD's customary timeline. The January 9, 2019 notice stated that HUD would announce a revised time period for completion of the review of pending Action Plans and amendments following enactment of funding for the Department's normal operations. Through this notice, HUD announces the revised review deadline.

This notice governs Community Development Block Grant disaster recovery (CDBG-DR) funds awarded under several appropriations. Specifically, this notice provides waivers and establishes alternative requirements for certain grantees that have submitted waiver requests for grants provided pursuant to Public Laws 112-55, 113-2, 114-113, 114-223, 114-254, 115-31, 115-56 and 115-123. This notice also provides further clarification on the application of the green building standards established by the Department for 2017 CDBG-DR grantees in the February 9, 2018 Federal Register notice (83 FR 5844). Additionally, this notice addresses the availability of an alternative requirement to Section 414 of the Stafford Act and other URA provisions for grantees that received an allocation of CDBG-DR funds under Public Laws 114-113, 114-223, 114-254, and 115-31.

On May 24, 2018, President Trump signed into law the Economic Growth, Regulatory Relief, and Consumer Protection Act (the ``Economic Growth Act''). Section 209 of the Economic Growth Act added section 38 to the United States Housing Act of 1937 and makes several amendments pertaining to small public housing agencies (PHAs) that administer 550 or fewer combined public housing units and vouchers under section 8(o) that predominantly operate in a rural area. Section 209 also requires HUD to develop new information systems for public housing consortia, and to make shared waiting list software available for voluntary use by multiple PHAs and owners of multifamily properties (hereinafter referred to in this Notice as, owners) receiving HUD assistance. Certain statutory amendments made by section 209 became effective 60 days after enactment (July 23, 2018). However, while effective, the provisions require rulemaking or guidance for implementation. The guidance in this Notice, read together with the statutory language, is intended to aid HUD program participants and the public generally in understanding the reasons for deferred action with respect to specific statutory provisions. In addition, HUD seeks comment from the public on appropriate implementation of the section 209 provisions.
