The Department of Defense (Department or DoD) is giving concurrent notice of a new Department-wide system of records pursuant to the Privacy Act of 1974 for the DoD-0020, "Military Human Resource Records" system of records and this proposed rulemaking. In this proposed rulemaking, the Department proposes to exempt portions of this system of records from certain provisions of the Privacy Act because of national security requirements, and to prevent the undermining of evaluation materials used to determine potential for promotion.

DoD, GSA, and NASA are issuing a correction to FAC 2024-05; Technical Amendments (Item II), which was published in the Federal Register on April 22, 2024. This correction makes an update to an OMB number that was recently revised.

The DoD is finalizing amendments to apply offsets for payments made by the U.S. Government for medical malpractice claims to potential economic damages only and not to total potential damages. Under this rule total potential damages will no longer be reduced by offsetting most of the compensation otherwise provided or expected to be provided by DoD or the Department of Veterans Affairs (VA) for the same harm that is the subject of the medical malpractice claim. Instead, only economic damages will be reduced by offsetting most of the compensation otherwise provided or expected to be provided by DoD or the VA for the same harm that is the subject of the medical malpractice claim. This rule also clarifies future lost earnings may be awarded until the time DoD determines that the claimant is, or is expected to be, medically rehabilitated and able to resume employment; in cases of permanent incapacitation, until expiration of the claimant's work-life expectancy; or, in cases of death, until the expiration of the claimant's work-life expectancy, after deducting for the claimant's personal consumption.

The DoD is publishing this notice to announce that the following Federal Advisory Committee meeting of the Defense Health Board (DHB) will take place.

In accordance with the Privacy Act of 1974, the DoD is establishing a new system of records titled, "All-domain Anomaly Resolution and Anomalous Phenomena (AARO) Program Records," AARO-0001. This system of records describes the AARO's collection, use, and maintenance of correspondence and reports submitted from current or former U.S. government employees, service members, or contractors with direct knowledge of U.S. Government programs or activities related to Unidentified Anomalous Phenomenon (UAP) dating back to 1945. This system also includes correspondence and reports submitted from members of the general public and government-affiliated personnel on reported events related to UAP. The submitted information will be used to carry out AARO's mission, including to inform AARO's congressionally directed Historical Record Report. Additionally, DoD is issuing a direct final rulemaking, which will exempt this system of records from certain provisions of the Privacy Act, elsewhere in this issue of the Federal Register.

Under the provisions of the Paperwork Reduction Act, the Regulatory Secretariat Division has submitted to the Office of Management and Budget (OMB) a request to review and approve an extension of a previously approved information collection requirement regarding combating trafficking in persons.

This rule proposes to remove existing general information about the professional responsibility requirements of attorneys practicing under the cognizance and supervision of the Judge Advocate General (JAG) and includes a new requirement for all non-U.S. Government attorneys to file a notice of appearance before appearing in any matter for which the JAG is charged with supervising the provision of legal services. It also proposes to remove existing content relating to the Rules of Professional Conduct and replaces it with complaint processing procedures.

The Assistant Secretary of the Army for Civil Works (ASA(CW)) is soliciting proposals for inclusion in the 2025 Annual Report to Congress on Future Water Resources Development (Annual Report). The Annual Report includes proposals submitted by non-federal interests for new feasibility studies, proposed modifications to authorized water resources development projects or feasibility studies, and proposed modifications to environmental infrastructure program authorities. The Annual Report is authorized under section 7001 of the Water Resources Reform and Development Act (WRRDA) of 2014, as amended.
