In this proposed rulemaking, the Department proposes to exempt portions of this system of records from certain provisions of the Privacy Act because of national security requirements, and to prevent the undermining of evaluation materials used to determine potential for promotion.

In accordance with the Privacy Act of 1974, the DoD is establishing a new system of records covering all DoD components titled, "Military Human Resource Records," DoD-0020. This system of records describes DoD's collection, use, and maintenance of records about members of the armed services, including active duty, reserve, and guard personnel. Records support Department requirements and individual Service members' careers, through the collection and management of personnel and employment data. This information includes individual's pay and compensation, education, assignment history, grade/rank and promotion determinations, separation and retirement actions, performance information, awards, and career milestones. Additionally, DoD is issuing a Notice of Proposed Rulemaking, which proposes to exempt this system of records from certain provisions of the Privacy Act, elsewhere in today's issue of the Federal Register.

Medical Malpractice Claims by Members of the Uniformed Services

The DoD is finalizing amendments to apply offsets for payments made by the U.S. Government for medical malpractice claims to potential economic damages only and not to total potential damages. Under this rule total potential damages will no longer be reduced by offsetting most of the compensation otherwise provided or expected to be provided by DoD or the Department of Veterans Affairs (VA) for the same harm that is the subject of the medical malpractice claim. Instead, only economic damages will be reduced by offsetting most of the compensation otherwise provided or expected to be provided by DoD or the VA for the same harm that is the subject of the medical malpractice claim. This rule also clarifies future lost earnings may be awarded until the time DoD determines that the claimant is, or is expected to be, medically rehabilitated and able to resume employment; in cases of permanent incapacitation, until expiration of the claimant's work-life expectancy; or, in cases of death, until the expiration of the claimant's work-life expectancy, after deducting for the claimant's personal consumption.
Notice of Intent To Prepare an Environmental Impact Statement for the 492nd Special Operations Wing Beddown at Davis-Monthan Air Force Base, Arizona

The Department of the Air Force (DAF) is issuing this Notice of Intent (NOI), in accordance with the National Environmental Policy Act (NEPA), to prepare an environmental impact statement (EIS) to evaluate the potential environmental impacts associated with transformation of the 492nd Special Operations Wing (492 SOW) into an Air Force Special Operations Command (AFSOC) Power Projection Wing (PPW) at Davis-Monthan Air Force Base (AFB), Arizona. This PPW would include the 492 SOW, the 6th and 319th Special Operations Squadrons, an MC-130J squadron, activation of an Intelligence Squadron (IS) under the Air Combat Command (ACC) 361st Intelligence, Surveillance, and Reconnaissance Group (361 ISRG), and Special Tactics and Special Operations Theater Air Operations Squadrons. The beddown of the 492 SOW is planned as a replacement mission for the A-10 aircraft at Davis- Monthan as they retire. There will likely be a short-term temporary overlap of the 492 SOW mission with the A-10s until their retirement is complete.

In accordance with the Privacy Act of 1974, the DoD is establishing a new system of records titled, "All-domain Anomaly Resolution and Anomalous Phenomena (AARO) Program Records," AARO-0001. This system of records describes the AARO's collection, use, and maintenance of correspondence and reports submitted from current or former U.S. government employees, service members, or contractors with direct knowledge of U.S. Government programs or activities related to Unidentified Anomalous Phenomenon (UAP) dating back to 1945. This system also includes correspondence and reports submitted from members of the general public and government-affiliated personnel on reported events related to UAP. The submitted information will be used to carry out AARO's mission, including to inform AARO's congressionally directed Historical Record Report. Additionally, DoD is issuing a direct final rulemaking, which will exempt this system of records from certain provisions of the Privacy Act, elsewhere in this issue of the Federal Register.
