Acquisition and Use of Criminal History Record Information by the Military Services
Document Number: 2019-16785
Type: Rule
Date: 2019-08-07
Agency: Department of Defense, Office of the Secretary
This final rule removes DoD's regulation addressing the acquisition and use of criminal history record information on potential applicants and recruits for the United States Armed Forces. That regulation articulated the Department's statutory authority to collect criminal background information from other government agencies including state and local governments, and it set forth internal standards for the use and protection of that information. Because that authority and those standards are set forth in current statute and internal policies, this part is not needed. Further, DoD utilizes a standardized form to request this criminal information, and any burden on the public attributable to the information collection is accounted for through the Paperwork Reduction Act process. Therefore, the regulation is unnecessary and can be removed from the CFR.
Office of the Secretary of Defense and Joint Staff Privacy Program
Document Number: 2019-16775
Type: Rule
Date: 2019-08-07
Agency: Department of Defense, Office of the Secretary
This final rule removes DoD's regulation concerning the Office of the Secretary of Defense and Joint Staff (OSD/JS) Privacy Program. On April 11, 2019, the Department of Defense published a revised DoD- level Privacy Program rule, which contains the necessary information for an agency-wide privacy program regulation under the Privacy Act and now serves as the single Privacy Program rule for the Department. That revised Privacy Program rule also includes all DoD component exemption rules. Therefore, this part is now unnecessary and may be removed from the CFR.

Announcement of Federal Funding Opportunity
Document Number: 2019-16619
Type: Notice
Date: 2019-08-05
Agency: Department of Defense, Office of the Secretary
As the Department of Defense (DoD) seeks to implement the National Defense Strategy by increasing our military capabilities and enhancing the lethality and readiness of our forces, it is in our Nation's best interests for states and communities around the nation to collaborate with our local installation's leadership to: Address instances where civilian activities may impair the utility of local installations; and ensure local civilian development does not negatively impact our missions, test facilities, and training ranges. In addition, local communities have the opportunity through development initiatives to enhance the military value and security of our bases and provide for the quality of life for our troops and their families. The purpose of the program is to enhance the operational utility of installations through a series of installation-community engagements that will identify and carry out civilian actions to improve the readiness and lethality of the force. These engagements allow the Department to utilize the particular civilian expertise that can be found across states and communities to augment our local missions' efforts to improve the combat capability of our forces while leveraging the comparative advantages these civilian partners can provide to support the Department's efforts. This notice announces an opportunity to request funding from the Office of Economic Adjustment (OEA), a DoD Field Activity, for community planning assistance to assist states and communities to work with their local military installations to promote and guide civilian development and activities which are compatible and support the long- term readiness and operability of military installations, ranges, special use air space, military operation areas, and military training routes. Many installations have recently updated their installation master plans and encroachment management plans. If a community has not completed a Compatible Use Plan or Joint Land Use Study in the last five years, they should consider the benefits of conducting one.
Legal Assistance
Document Number: 2019-16560
Type: Rule
Date: 2019-08-02
Agency: Department of Defense, Department of the Navy
This final rule removes Department of the Navy (DON) regulations concerning Legal Assistance. Removal is appropriate because the regulation does not affect how the public engages the DON regarding legal assistance and does not place obligations on the public. The Judge Advocate General (JAG) of the Navy and the Staff Judge Advocate (SJA) to the Commandant of the United States Marine Corps issue internal instructions that establish administration of the DON legal assistance programs within the parameters established by many controlling statutes. These internal instructions do not require publication in the Code of Federal Regulations.

The scoping process will help identify reasonable alternatives, potential environmental impacts, and key issues of concern to be evaluated in the EIS. Based on the information presented in the EIS, the Department of the Army will determine which of the identified heat and power generating alternatives would be implemented.
