TRICARE; Reimbursement of Long Term Care Hospitals and Inpatient Rehabilitation Facilities

The Department of Defense, Defense Health Agency, is proposing to revise its reimbursement of Long Term Care Hospitals (LTCHs) and Inpatient Rehabilitation Facilities (IRFs). Proposed revisions are in accordance with the statutory provision at title 10, United States Code (U.S.C.), section 1079(i)(2) that requires TRICARE payment methods for institutional care be determined, to the extent practicable, in accordance with the same reimbursement rules as apply to payments to providers of services of the same type under Medicare. Our regulation includes a definition for ``Hospital, long-term (tuberculosis, chronic care, or rehabilitation).'' This rule proposes to delete this definition and create separate definitions for ``Long Term Care Hospital'' and ``Inpatient Rehabilitation Facility'' in accordance with Centers for Medicare & Medicaid Services (CMS) classification criteria. Under TRICARE, LTCHs and IRFs (both freestanding rehabilitation hospitals and rehabilitation hospital units) are currently paid the lower of a negotiated rate (if they are a network provider) or billed charges (if they are a non-network provider). Although Medicare's reimbursement methods for LTCHs and IRFs are different, it is prudent to propose adopting both the Medicare LTCH and IRF Prospective Payment System (PPS) methods simultaneously to align with our statutory requirement to utilize the same reimbursement system as Medicare. This proposed rule sets forth the proposed regulation modifications necessary for TRICARE to adopt Medicare's LTCH and IRF Prospective Payment Systems and rates applicable for inpatient services provided by LTCHs and IRFs to TRICARE beneficiaries.

Military Lending Act Limitations on Terms of Consumer Credit Extended to Service Members and Dependents

The Department of Defense (Department) is interpreting its regulation implementing the Military Lending Act (the MLA). The MLA as implemented by the Department, limits the military annual percentage rate (MAPR) that a creditor may charge to a maximum of 36 percent, requires certain disclosures, and provides other substantive consumer protections on ``consumer credit'' extended to Service members and their families. On July 22, 2015, the Department amended its regulation primarily for the purpose of extending the protections of the MLA to a broader range of closed-end and open-end credit products (the July 2015 Final Rule). This interpretive rule provides guidance on certain questions the Department has received regarding compliance with the July 2015 Final Rule.

The United States Air Force (Air Force) is issuing this notice to notify the public of its intent to prepare a Legislative Environmental Impact Statement (LEIS) for the Nevada Test and Training Range (NTTR) military land withdrawal at Nellis Air Force Base, Nevada. The LEIS is being prepared in accordance with National Environmental Policy Act (NEPA) of 1969; 40 Code of Federal Regulations (CFR), Parts 1500-1508, the Council on Environmental Quality (CEQ) regulations for implementing NEPA; and the Air Force Environmental Impact Analysis Process (EIAP) [32 CFR part 989]. Section 9355, the U.S. Air Force Academy (USAFA) Board of Visitors (BoV) will hold a meeting at the Center for Character and Leadership Development Building, U.S. Air Force Academy, Colorado Springs, CO on Sept 7 & 8, 2016. On Wednesday, Sept 7, the meeting will begin at 1300 and conclude at 1600. On Thursday, Sept 8, the meeting will begin at 8:00 a.m. and conclude at 1515. The purpose of this meeting is to review morale and discipline, social climate, curriculum, instruction, infrastructure, fiscal affairs, academic methods, and other matters relating to the Academy. Specific topics for this meeting include a Superintendent's Update; USAFA Non-Profits Update; Religious Respect Update; USAFA Academics Update; USAFA's Climate Assessment Survey Results. Public attendance at this USAFA BoV meeting shall be accommodated on a first-come, first- served basis up to the reasonable and safe capacity of the meeting room. The St. Paul District, Army Corps of Engineers, in partnership with the Souris River Joint Water Resources Board (SRJB), is conducting a flood risk management feasibility study for the Souris River Basin within the continental United States. The feasibility study will include an Environmental Impact Statement and consider opportunities to reduce flood risk within Bonnineau, McHenry, Ward, and Renville counties, North Dakota. The study will evaluate several alternative measures, including, but not limited to: Levees and floodwalls, diversion channels, non-structural flood proofing, relocation of flood- prone structures, and flood storage.

The Department of the Navy (DoN) is amending its certifications and exemptions under the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), to reflect that the Deputy Assistant Judge Advocate General (DAJAG) (Admiralty and Maritime Law) has determined that USS GABRIELLE GIFFORDS (LCS 10) is a vessel of the Navy which, due to its special construction and purpose, cannot fully comply with certain provisions of the 72 COLREGS without interfering with its special function as a naval ship. The intended effect of this rule is to warn mariners in waters where 72 COLREGS apply.

The United States Army Corps of Engineers (Corps) intends to prepare a Supplemental Environmental Impact Statement (SEIS) to address the proposed Springfield Supplemental Water Supply Project (previously referred to as the Proposed Water Supply Reservoir Hunter Lake) in Sangamon County, IL. The Corps, working in conjunction with the City of Springfield, Office of Public Utilities, also known as the City Water, Light & Power (City), prepared an Environmental Impact Statement (EIS) in accordance with the National Environmental Policy Act (NEPA) of 1969 [42 U.S.C. 4321 et. seq.] that evaluated a range of alternatives to provide supplemental water supply to meet a projected deficit in water availability. A final EIS was prepared and published in November of 2000. The Final EIS (EIS No. 000402) was published in the Federal Register on November 24, 2000; however, no Record of Decision was issued. The City has conducted an updated water demand analysis that demonstrates a sustained need for additional water supply to meet current and future demands. In accordance with Council on Environmental Quality (CEQ) regulations specified in 40 CFR 1502.9, the Corps in conjunction with the City are initiating the preparation of an EIS supplement.

This final rule removes regulations concerning Public Affairs liaison with industry. These Code of Federal Regulations (CFR) provisions are outdated and no longer accurate or applicable as written. The guidance, as revised, sets forth internal standards for how DoD employees should reach out and engage with industry. With respect to the visual information portion, it is essentially a collection and discussion of currently applicable intellectual property law that does not create any new public duties or obligations. Therefore, these regulations are removed from the CFR.
