The U.S. Army Corps of Engineers, Los Angeles District (Corps) is examining the environmental consequences associated with the proposed construction, operation, and closure of a new tailings storage facility in eastern Pinal County, Arizona, in connection with Asarco LLC's application for a Department of the Army permit under Section 404 of the Clean Water Act. The proposed tailings storage facility and associated facilities would discharge fill materials into approximately 138 acres of waters of the U.S. and indirectly impact an additional 17 acres through dewatering. The primary federal environmental concerns are the proposed discharges of fill material into waters of the U.S. and the potential for significant adverse environmental effects resulting from such activities. Therefore, to address these concerns in accordance with the National Environmental Policy Act (NEPA), the Corps is requiring preparation of an Environmental Impact Statement (EIS) prior to consideration of any permit action. The action must comply with the Section 404(b)(1) Guidelines (40 CFR Part 230) and not be contrary to the public interest to be granted a Corps permit. The Corps may ultimately make a determination to permit or deny the above project, or permit or deny modified versions of the above project.

The U.S. Army Pacific (USARPAC) and U.S. Army Garrison, Hawai`i, (USAG-HI) announce the decision to construct and operate a new Infantry Platoon Battle Course (IPBC) and associated infrastructure at P[omacr]hakuloa Training Area (PTA), Hawai`i. This decision allows the Army to construct and operate an IPBC that will meet Army training requirements and will support the live-fire collective training needs of the Army, Army Reserve, and Hawai`i Army National Guard, as well as other Service components that are stationed or train in Hawai`i. To comply with the National Environmental Policy Act (NEPA), the Department of the Army prepared an Environmental Impact Statement (EIS) that evaluated the potential environmental and socioeconomic effects associated with alternatives to construct and operate the IPBC. In the Final EIS published in the Federal Register on April 26, 2013 (78 FR 24734), the Army identified the Western Range Alternative as the preferred alternative. The Army has selected the preferred alternative in the Record of Decision (ROD). The Western Range Area Alternative is located in an under-utilized portion of the PTA impact area where no ranges currently exist. The location has been exposed to indirect munitions fire and constructing the IPBC here will reclaim a portion of the impact area. Intent To Prepare a Draft Environmental Impact Statement for Dam Safety Study, Lake Lewisville Dam, Elm Fork Trinity River, Denton County, Texas

Authorized by the River and Harbor Act of March 2, 1945, Lake Lewisville embankment construction began in December 1948 with completion in August 1955. The project includes an earthen embankment that is approximately 32,000 feet in length and has a maximum height of 125 feet at elevation 560 feet (all elevations are NGVD) with gated outlet works and an uncontrolled concrete ogee weir spillway. The primary purposes of the project are flood risk management, water supply, recreation and non-Federal hydropower. Top of conservation pool was originally set at elevation 515. Following construction of Ray Roberts Dam upstream, the conservation pool of Lewisville was raised from elevation 515 to 522 on November 30, 1988. At elevation 522, the lake inundates approximately 29,600 surface acres. Top of flood pool is elevation 532 which inundates approximately 39,200 surface acres. Downstream of the dam, approximately 2,000 acres of Corps of Engineers (Corps) owned lands are currently leased by the Lewisville Lake Environmental Learning Area. A former fish hatchery is also operated by the government for national research on controlling nuisance aquatic plants. The risk associated with the Lake Lewisville project was first evaluated in 2005 after the Corps instituted a Screening Portfolio Risk Assessment (SPRA) program to assess the risk of all 694 dams in the Corps' portfolio. The SPRA report completed in July 2005, was reviewed by Corps senior dam safety officials who concluded that the risks associated with the possible poor performance of the dam were above the Corps' tolerable risk guidelines. As a result, additional studies of the project were initiated. These studies are currently ongoing, and will evaluate appropriate ways to minimize risk associated with the project. While the Corps completes in-depth studies of the project to determine appropriate permanent methods for correcting potential problems, interim risk reduction measures have been implemented. In anticipation of possible permanent corrective actions at the project, and in order to fully comply with National Environmental Policy Act (NEPA) requirements, the Corps is preparing a project report and a Draft Environmental Impact Statement (DEIS) to identify the environmental impacts associated with any alternatives to repair and reduce risks at the Lake Lewisville Dam. The general study area will be the Lake Lewisville proper and floodplain from Ray Roberts Dam downstream to Interstate Highway 20 in Dallas County.

In this proposed rule, the Department of Defense (DoD) discusses new policy, responsibilities, and procedures for the operation of voluntary education programs within DoD. The new policies discussed in the rule include the following. All educational institutions providing education programs through the DoD Tuition Assistance (TA) Program will provide meaningful information to students about the financial cost and attendance at an institution so military students can make informed decisions on where to attend school; not use unfair, deceptive, and abusive recruiting practices; and provide academic and student support services to Service members and their families. New criteria are created to strengthen existing procedures for access to military installations by educational institutions. An annual review and notification process is required if there are changes made to the uniform semester-hour (or equivalent) TA caps and annual TA ceilings. Military Departments will be required to provide their Service members with a joint services transcript (JST). The DoD Postsecondary Education Complaint System is implemented for Service members, spouses, and adult family members to register student complaints. The Military Departments are authorized to establish Service-specific TA eligibility criteria and management controls.

Millennium Bulk TerminalsLongview, LLC (MBTL) is proposing to construct and operate a shipping facility near Longview, Washington. MBTL currently intends to ship coal from the facility. Department of the Army (DA) authorization is required pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act. The Corps has entered into an agreement with the Cowlitz County Building and Planning Department (County) and the Washington State Department of Ecology (WDOE), (together, the co-lead agencies) to prepare a joint Environmental Impact Statement (EIS) in accordance with both the National Environmental Policy Act (NEPA) of 1969, as amended, and the Washington State Environmental Policy Act (SEPA). The Corps will serve as the lead federal agency for purposes of NEPA, and the County and WDOE will serve as lead agencies under SEPA.

The Air Force is issuing this notice to advise the public of its intent to prepare an Environmental Impact Statement (EIS). The Gulf Regional Airspace Strategic Initiative (GRASI) Landscape Initiative (GLI) is a U.S Air Force-led partnership with the State of Florida and other state and federal agencies to expand the capacity of the region to safely host military test and training operations. Under the GLI EIS, the Air Force's Proposed Action is to utilize Blackwater River State Forest (BRSF) and Tate's Hell State Forest (THSF) for establishing helicopter landing and drop zones, airstrips, and a number of different land and air training activities which currently occur within the interstitial (areas between designated test/ training sites) areas of the Eglin Air Force Base (AFB) Range. The Air Force is also proposing to establish up to 12 radar, telemetry, and training emitter sites throughout northwest Florida. The emitter sites would support development of an integrated air defense system, which would provide unique, viable, and robust air training. Scoping: In order to effectively define the full range of issues to be evaluated in the EIS, the Air Force will determine the scope (i.e. what will be covered and in what detail) by soliciting comments from interested state and federal agencies and interested members of the public through the Federal Register and various media in the local communities near the Proposed Action. The Air Force will also hold a series of scoping meetings to further solicit input regarding the scope of the proposed action and any reasonable alternatives.

TRICARE; Reimbursement of Sole Community Hospitals and Adjustment to Reimbursement of Critical Access Hospitals

This Final Rule implements for Sole Community Hospitals (SCHs) the statutory provision at title 10, United States Code (U.S.C.), section 1079(j)(2) that TRICARE payment methods for institutional care be determined, to the extent practicable, in accordance with the same reimbursement rules as those that apply to payments to providers of services of the same type under Medicare. This Final Rule implements a reimbursement methodology similar to that applicable to Medicare beneficiaries for inpatient services provided by SCHs. It will be phased in over a several-year period. This Final Rule also provides for special reimbursement for labor/delivery and nursery services in SCHs and creates a possible General Temporary Military Contingency Payment Adjustment (GTMCPA) for inpatient services in SCHs and for Critical Access Hospitals (CAHs).

The Department of Defense (DoD) proposes several amendments to the TRICARE regulation. Specifically, the proposed rule revises the definitions of durable equipment (DE) and durable medical equipment (DME) to better conform the language in the regulation to the statute and implementing the statutory requirements will not change current policies. This rule also adds a definition of assistive technology (AT) devices for purposes of benefit coverage under the TRICARE Extended Care Health Option (ECHO) Program and removes the restriction under the TRICARE Basic Program that limits ordering or prescribing of DME to only a physician, to allow certain other authorized individual professional providers acting within the scope of their licensure to order or prescribe DME. Finally, the proposed rule incorporates a policy clarification relating to luxury, deluxe, or immaterial features of equipment or devices. Namely, TRICARE cannot reimburse for the luxury, deluxe, or immaterial features of equipment or devices. However, the TRICARE Management Activity (TMA) can reimburse for the base or basic equipment or device that meet the beneficiary's needs. Beneficiaries may pay the provider for the luxury, deluxe, or immaterial features themselves, if they desire their equipment or device to have these ``extra features.''

This proposed rule would establish an exception to the usual rule that TRICARE Prime enrollment fees are uniform for the group of retirees and their dependents. Survivors and medically retired members are part of the retiree group under TRICARE rules. This exception would allow Survivors of Active Duty Deceased Sponsors and Medically Retired Uniformed Services Members and their Dependents enrolled in Prime to be exempt from future increases in TRICARE Prime enrollment fees. The Prime beneficiaries in these categories prior to 10/1/2013 would have their annual enrollment fee frozen at their current annual rate (FY 2011 rate $230 per single or $460 per family, FY 2012 rate $260 or $520, or the FY 2013 rate $269.38 or $538.56). The beneficiaries added to these categories on or after 10/1/2013 would have their fee frozen at the rate in effect at the time they are classified in either category and enroll in Prime or, if not enrolling, at the rate in effect at the time of enrollment. The fee remains frozen as long as at least one family member remains enrolled in Prime and there is not a break in enrollment. The fee charged for the dependent(s) of a Medically Retired Uniformed Services Member would not change if the dependent(s) was later re-classified a Survivor.
