NMFS, Southeast Region, in collaboration with the South Atlantic Fishery Management Council (Council), intends to prepare a DEIS to describe and analyze a range of alternatives for management actions to be included in the Generic Accountability Measure (AM) and Dolphin Allocation Amendment. The Generic AM and Dolphin Allocation Amendment would amend the Fishery Management Plans (FMPs) for: the Dolphin and Wahoo Fishery of the Atlantic; the Snapper-Grouper Fishery of the South Atlantic Region; and the Golden Crab Fishery of the South Atlantic Region. The Generic AM and Dolphin Allocation Amendment will consider alternative AMs for snapper-grouper species and golden crab, as well as alternatives to modify existing commercial and recreational sector allocations for dolphin. The purpose of this NOI is to solicit public comments on the scope of issues to be addressed in the DEIS.

NMFS implements an accountability measure (AM) through this temporary final rule for commercial harvest of king mackerel in the southern Florida west coast subzone of the eastern zone of the Gulf of Mexico (Gulf) exclusive economic zone (EEZ) using run-around gillnet gear. NMFS has determined that the commercial annual catch limit (ACL) (equal to the commercial quota) for king mackerel using run-around gillnet gear in the southern Florida west coast subzone of the Gulf EEZ will have been reached by January 29, 2014. Therefore, NMFS closes the southern Florida west coast subzone to commercial king mackerel fishing using run-around gillnet gear in the Gulf EEZ. This closure is necessary to protect the Gulf king mackerel resource.

Framework Adjustment 8 (Framework 8) proposes several changes to facilitate operation of the butterfish discard cap in the longfin squid fishery and the directed butterfish fishery. Framework 8 would allocate the butterfish discard cap among trimesters in the same percentages used for the trimester allocations for longfin squid: 43 percent to Trimester I (January to April); 17 percent to Trimester II (May to August), and 40 percent to Trimester III (September to December). Each trimester would close when it is estimated that 95 percent of the butterfish discard cap has been taken. In addition, Framework 8 would allow NMFS to transfer, in either direction, up to 50 percent of unused quota between the butterfish landing allocation and the discard cap on the longfin squid fishery. This would occur near the end of the year in order to optimally utilize the butterfish that is available for fishing each year.

We find that the petition and information readily available in our files present substantial scientific or commercial information indicating that the petitioned action may be warranted. We will conduct a status review of the species to determine if the petitioned action is warranted. To ensure that the status review is comprehensive, we are soliciting scientific and commercial information pertaining to this species from any interested party.

On December 27, 2013 the National Marine Fisheries Service (NMFS) on behalf of NMFS and the National Ocean Service (referred to collectively here as the National Oceanic and Atmospheric Administration (NOAA)), announced the availability of draft guidance for assessing the effects of anthropogenic sound on marine mammal species under NOAA's jurisdiction. NOAA solicited public comment on the draft guidance and provided a 30-day public comment period ending January 27, 2014. NOAA has received requests for an extension of the public comment period. In response to those requests, NOAA is reopening the public comment period for an additional 45 days.

Listing Endangered or Threatened Species: Proposed Amendment to the Endangered Species Act Listing of the Southern Resident Killer Whale Distinct Population Segment

In response to a petition submitted by the People for the Ethical Treatment of Animals Foundation to include the killer whale ``Lolita'' as a protected member of the endangered Southern Resident killer whale Distinct Population Segment (DPS), we, the National Marine Fisheries Service (NMFS), have completed a status review and propose to amend the regulatory language of the Endangered Species Act (ESA) listing of the DPS by removing the exclusion for captive members of the population. The current regulatory language excluded Lolita, the sole member of the Southern Resident killer whale DPS held in captivity, from the endangered listing. With removal of the exclusion, Lolita, a female killer whale captured from the Southern Resident population in 1970 who resides at the Miami Seaquarium in Miami, Florida, would be included in the Southern Resident killer whale DPS. The Southern Resident killer whale DPS was listed as endangered under the ESA in 2005. We accepted the petition to include Lolita in the Southern Resident killer whale DPS on April 29, 2013, initiating a public comment period and a status review. Based on our review of the petition, public comments, and the best available scientific information, we find that amending the regulatory language to remove the exclusion for captive whales from the Southern Resident Killer whale DPS is warranted. We are soliciting scientific and commercial information pertaining to the proposed rule.

The Pacific Fishery Management Council (Council) has requested that the National Marine Fisheries Service (NMFS) take into consideration alternative harvest control rules for Sacramento River winter Chinook salmon (winter-run), a species listed as endangered under the Endangered Species Act (ESA) and impacted by ocean salmon fisheries that the Council and NMFS manage. The Council is concerned that the existing control rule may be unnecessarily restrictive in years of low winter-run abundance, particularly when the 3-year average escapement drops below 500 fish. The current control rule specifies zero fishery impacts at this level of abundance rather than the de minimis impacts that are allowed under fishery control rules that limit impacts on other ESA listed species. The Council has expressed interest in exploring alternatives that would provide some limited harvest opportunity on other Chinook salmon stocks when winter-run abundance is low, without significantly increasing the risk to winter-run. To help facilitate consideration of such alternatives, NMFS is requesting public comment on alternative harvest control rules analyzed in a Management Strategy Evaluation (MSE) for winter-run. These alternative harvest control rules include the current control rule implemented by NMFS on May 1, 2012, as part of the ESA consultation standard on the ocean salmon fishery and additional control rules that reduce the impact rate at low abundance.

NMFS issues regulations to implement Amendment 89 to the Fishery Management Plan for Groundfish of the Gulf of Alaska (GOA groundfish FMP) and revise regulations governing the configuration of modified nonpelagic trawl gear. First, this rule establishes a protection area in Marmot Bay, northeast of Kodiak Island, and closes that area to fishing with trawl gear except for directed fishing for pollock with pelagic trawl gear. The closure will reduce bycatch of Tanner crab (Chionoecetes bairdi) in Gulf of Alaska (GOA) groundfish fisheries. Second, this rule requires that nonpelagic trawl gear used in the directed flatfish fisheries in the Central Regulatory Area of the GOA be modified to raise portions of the gear off the sea floor. The modifications to nonpelagic trawl gear used in these fisheries will reduce the unobserved injury and mortality of Tanner crab, and will reduce the potential adverse impacts of nonpelagic trawl gear on bottom habitat. Finally, this rule makes a minor technical revision to the modified nonpelagic trawl gear construction regulations to facilitate gear construction for those vessels required to use modified nonpelagic trawl gear in the GOA and Bering Sea groundfish fisheries. This rule is intended to promote the goals and objectives of the Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act), the GOA groundfish FMP, and other applicable law.
