On May 7, 2020, the White House issued an Executive Order (E.O.) on Promoting American Seafood Competitiveness and Economic Growth, which requires the Secretary of Commerce to identify geographic areas containing locations suitable for commercial aquaculture, and complete a National Environmental Policy Act (NEPA) Programmatic Environmental Impact Statement (PEIS) for each area to assess the impact of siting aquaculture facilities there. NOAA requests that interested parties provide relevant information on the identification of areas within Federal waters of the Gulf of Mexico and off Southern California, south of Point Conception, for the first two Aquaculture Opportunity Areas (AOA) and on what areas NOAA should consider nationally for future AOAs. Please respond to the questions listed in the SUPPLEMENTARY INFORMATION section, as appropriate. The public input provided in response to this request for information (RFI) will inform NOAA as it works with Federal agencies, appropriate Regional Fishery Management Councils, and in coordination with appropriate State and tribal governments to identify AOAs.

This final rule revises the transit provisions for shrimp trawl vessels with penaeid shrimp, i.e., brown, pink, and white shrimp, on board in Federal waters of the South Atlantic that have been closed to shrimp trawling to protect white shrimp as a result of cold weather events. The purpose of this final rule is to update the regulations to more closely align with current fishing practices, reduce the socio-economic impacts for fishermen who transit these closed areas, and improve safety at sea while maintaining protection for overwintering white shrimp.

NMFS received a request from the Port of Kalama (POK) for the Renewal of their currently active incidental harassment authorization (IHA) to take marine mammals incidental to construction activities associated with an expansion project at the POK on the Lower Columbia River, Washington. These activities are identical to those covered in the current authorization. The project has been delayed and none of the work covered in the initial IHA has been conducted. Pursuant to the Marine Mammal Protection Act, prior to issuing the currently active IHA, NMFS requested comments on both the proposed IHA and the potential for renewing the initial authorization if certain requirements were satisfied. The Renewal requirements have been satisfied, and NMFS is now providing an additional 15-day comment period to allow for any additional comments on the proposed Renewal not previously provided during the initial 30-day comment period.

This rule proposes salmon bycatch minimization measures to minimize incidental take of Endangered Species Act-listed salmon by vessels in the Pacific Coast groundfish fishery. The proposed rule would establish additional management tools to minimize incidental Chinook and coho salmon bycatch to keep fishery sectors within guidelines, establish rules to allow industry to access the Chinook salmon bycatch reserve, and create Chinook salmon bycatch closure thresholds for the trawl fishery. This proposed rule fulfills the terms and conditions of a 2017 National Marine Fisheries Service Biological Opinion. This proposed rule is intended to promote the goals and objectives of the Magnuson-Stevens Fishery Conservation and Management Act, the Pacific Coast Groundfish Fishery Management Plan, and other applicable laws, including the Endangered Species Act.
