The Commodity Credit Corporation (CCC) proposes regulations to implement the new Biomass Crop Assistance Program (BCAP) authorized by the Food, Conservation, and Energy Act of 2008 (the 2008 Farm Bill). BCAP is intended to assist agricultural and forest land owners and operators with the establishment and production of eligible crops including woody biomass in selected project areas for conversion to bioenergy, and the collection, harvest, storage, and transportation of eligible material for use in a biomass conversion facility. This rule specifies the requirements for eligible participants, biomass conversion facilities, and biomass crops and materials. It also provides notice of final termination of the existing Notice of Funds Availability.

The Forest Service will prepare a Supplemental Draft Environmental Impact Statement (SDEIS) to assess the impacts of the Station Fire and other project changes affecting National Forest System (NFS) lands. After the public review period for the SDEIS, the Forest Service will issue its Final EIS. Following release of the Final EIS, the Forest Service will issue a Record of Decision (ROD) to document the decision to either approve or deny the requested Special Use authorization for the Project in response to the application received from Southern California Edison for construction of a series of transmission system improvements to deliver electricity from new wind energy projects in eastern Kern County. The proposed project would be located in Kern, Los Angeles, and San Bernardino counties. The purpose of the project is to provide the electrical facilities necessary to reliably interconnect and integrate in excess of 700 megawatts (MW) and up to approximately 4,500 MW of new wind generation in the Tehachapi Wind Resource Area, currently being planned or expected in the future, thereby assisting SCE and other California utilities to comply with California's Renewables Portfolio Standard (RPS) goals in an expedited
Proposed Processed Raspberry Promotion, Research, and Information Order

This rule proposes the establishment of an industry-funded promotion, research, and information program for processed raspberries. The proposed program, Processed Raspberry Promotion, Research, and Information Order (Proposed Order), was submitted to the Department of Agriculture (Department) by the Washington Red Raspberry Commission (WRRC). Under the Proposed Order, producers of raspberries for processing and importers of processed raspberries would pay an assessment of up to one cent per pound, with the initial assessment rate being one cent per pound, which would be paid to the proposed National Processed Raspberry Council (Council). Producers and importers of less than 20,000 pounds annually of raspberries for processing and processed raspberries, respectively, would be exempt from the assessment. The proposed program would be implemented under the Commodity Promotion, Research, and Information Act of 1996 (1996 Act). The Department is conducting an initial referendum to ascertain whether the persons to be covered by and assessed under the Proposed Order favor the implementation of the program prior to it going into effect. In addition, USDA is announcing that the referendum will be conducted among eligible producers of raspberries for processing and importers of processed raspberries to determine whether they favor the implementation of the Proposed Order. The Proposed Order would be implemented if it is approved by a majority of producers and importers voting in the referendum. A separate final rule on referendum procedures is being published in this issue of the Federal Register.

This rule establishes procedures which the Department of Agriculture (USDA or the Department) will use in conducting a referendum to determine whether the issuance of the proposed Processed Raspberry Promotion, Research, and Information Order (Proposed Order) is favored by producers of raspberries for processing and importers of processed raspberries. The Proposed Order will be implemented if it is approved by a simple majority of the eligible producers and importers voting in the referendum. These procedures will also be used for any subsequent referendum under the Proposed Order, if it is approved in the initial referendum. The Proposed Order is being published separately in this issue of the Federal Register. This proposed program is implemented under the Commodity Promotion, Research, and Information Act of 1996 (1996 Act).
Commodity Supplemental Food Program (CSFP): Amendment Removing Priority Given to Women, Infants, and Children Before the Elderly in Program Participation

This final rule amends the regulations for the Commodity Supplemental Food Program (CSFP) by removing the priority given to women, infants, and children before the elderly in program participation, in accordance with the amendment made by the Food, Conservation, and Energy Act of 2008 (the 2008 Farm Bill). As a result of this amendment, local agencies are no longer required to prioritize benefit issuance based on population group. All CSFP applicants may be treated equally when caseload slots become available, provided all eligibility requirements are met.

Grapes Grown in a Designated Area of Southeastern California and Imported Table Grapes; Change in Regulatory Periods

The Department of Agriculture (USDA) is adopting, as a final rule, without change, an interim final rule revising the regulatory period when minimum grade, size, quality, and maturity requirements apply to southeastern California grapes under Marketing Order No. 925 (order), and to imported grapes under the table grape import regulation, from April 20 through August 15 of each year to April 10 through July 10 of each year. The order regulates the handling of grapes grown in a designated area of southeastern California and is administered locally by the California Desert Grape Administrative Committee (Committee). The change to the regulatory period beginning date is needed to help ensure that imported table grapes marketed in competition with domestic grapes are subject to the grade, size, quality, and maturity requirements of the order. Section 8e of the Agricultural Marketing Agreement Act of 1937 (Act) provides authority for such change. The change to the regulatory period ending date is needed to realign the regulatory period with current shipping trends for grapes in the order's production area. This rule also continues in effect the action that clarified the maturity (soluble solids) requirements for southeastern California and imported Flame Seedless variety grapes.
Umatilla National Forest, Walla Walla Ranger District, Walla Walla, WA; Cobbler II Timber Sale and Fuels Reduction Project

The USDA Forest Service will prepare an environmental impact statement (EIS) to disclose environmental effects on proposed resource management actions in Cobbler II project planning area. This project would improve the health, vigor, and resilience to fire, insects, and disease in upland forest stands that are outside their historical pre- fire conditions for species composition, structural diversity, stocking densities, and fuel loads. The project planning area is approximately 34,000 acres in size. Proposed project activities consist of commercial timber harvest, including treatment of activity and natural fuels within harvest units, temporary road construction (that will be decommissioned after project use), new road construction, danger tree removal along haul routes, non-commercial thinning, hardwood restoration, meadow restoration, and landscape prescribed burning.

The Natural Resources Conservation Service (NRCS) has prepared an Environmental Assessment (EA) and Finding of No Significant Impact (FONSI) consistent with the National Environmental Policy Act (NEPA) of 1969, as amended, to construct the Delta-Clearwater Remediation Project, authorized under the Watershed Protection, Watershed Surveys, and Flood Prevention Act of 1954 (Pub. L. 83-566, 83d Cong., 68 Stat. 666), as amended. Upon review and analysis of potential environmental impacts, the State Conservationist (Alaska) found that the project would not result in a significant impact on the quality of the human environment. Therefore, a FONSI was issued and no environmental impact statement is required.

The Soda Springs Ranger District of the Caribou-Targhee National Forest is proposing to take reservations for group camping and group day use picnicking at the Trail Canyon Group Site on the Soda Springs Ranger District. They are proposing to charge a $40 fee per day for group camping and group day use picnicking (up to a maximum of 100 people). Fees are assessed based on the level of amenities and services provided, cost of operations and maintenance, market assessment and public comment. The fee is proposed and will be determined upon further analysis and public comment. To date, an analysis of the facility shows that the proposed fees are reasonable and typical of similar sites in the area. Use at other similar facilities on the Caribou-Targhee National Forest has shown that publics appreciate and enjoy the availability of developed recreation campground and picnicking facilities. This facility will remain free of charge during the winter season as a warming shelter. Funds from the use of these developed facilities will be used for the continued operation and maintenance of the Trail Canyon Group Site.

Bridger-Teton National Forest, Big Piney Ranger District, WY; Piney Creeks Vegetation Treatment

The Big Piney Ranger District is proposing to implement vegetation management in the Piney Creek drainages throughout the next five-seven years. The need for vegetation management in this area has previously been identified and studied in the Bridger-Teton Forest Plan implemented in 1990, in public meetings held on the revision of the Forest Plan in 2008 and comprehensive evaluation reports for aspen, lodge pole pine, Douglas fir, spruce fir and white bark pine. The analysis area is approximately 20,000 acres within this watershed and includes the creeks of South, Middle and North on the Big Piney Ranger District of the Bridger-Teton National Forest. The area also includes Middle and North Piney Lakes, Wyoming Peak the Middle Piney Summer homes, Sacajawea and Middle Piney Lake campgrounds. Management opportunities, practices, standards and guidelines, and mitigation have been developed to help achieve desired resource conditions. These are the basis for this proposal and for further site specific analysis of effects. It is approximately 25 miles west of Big Piney, Wyoming in the Green River drainage, on the east slope of the Wyoming range. All lands within the analysis area are National Forest System lands within Sublette County, Wyoming. The legal description includes portions of T28N through T31N and R112W through R114W.

The United States Department of Agriculture (USDA) grants a project waiver of the Buy American Requirements of ARRA Section 1605 under the authority of Section 1605(b)(2) [manufactured goods are not produced in the United States in sufficient and reasonably available quantities and of a satisfactory quality] to the Plymouth Village Water & Sewer District, New Hampshire (``District'') for the purchase of a foreign manufactured rotary sludge dewatering press. This is a project specific waiver and only applies to the use of the specified product for the ARRA project being proposed. Any other ARRA recipient that wishes to use the same product must apply for a separate waiver based on project specific circumstances. The District's proposed wastewater treatment facility improvements will include a replacement of the existing belt filter press for sludge generated at the plant. Based upon information submitted by the District and its consultants, it was determined that a rotary press sludge dewatering unit, manufactured by Fournier Industries of Quebec, Canada, will meet the District's design and performance specifications. The Secretary is making this determination based on the review and recommendations of the Rural Development Buy American Coordinator. The District through its design engineer has provided sufficient documentation to support its request. The Undersecretary for Rural Development concurred on this decision to waive Section 1605 of ARRA. This action permits the purchase of a 6 channel rotary press sludge dewatering unit, manufactured by Fournier Industries, by the District, as specified in its October 7, 2009 waiver request, as part of the improvements to the wastewater treatment facility.

This rule will allow States, at their option, to treat legally obligated child support payments to a non-household member as an income exclusion rather than a deduction; allow a State option to exclude certain types of income and resources that are not counted under the State's Temporary Assistance for Needy Families (TANF) cash assistance or Medicaid programs; replace the current, fixed standard deduction with a deduction that varies according to household size and is adjusted annually for cost-of-living increases; allow States to simplify the Standard Utility Allowance (SUA) if the State elects to use the SUA rather than actual utility costs for all households; allow States to use a standard deduction from income of $143 per month for homeless households with some shelter expenses; allow States to disregard reported changes in deductions during certification periods (except for changes associated with new residence or earned income) until the next recertification; increase the resource limit for households with a disabled member from $2,000 to $3,000 consistent with the limit for households with an elderly member; allow States to extend simplified reporting of changes to all households; require State agencies that have a Web site to post applications on these sites in the same languages that the State uses for its written applications; allow States to extend from the current 3 months up to 5 months the period of time households may receive transitional food stamp benefits when they cease to receive TANF cash assistance; and restore food stamp eligibility to qualified aliens who are otherwise eligible and who are receiving disability benefits regardless of date of entry, are under 18 years of age regardless of date of entry, or have lived in the United States for 5 years as qualified aliens beginning on the date of entry.
Continuous Construction-Permanent Loan Guarantees Under the Section 538 Guaranteed Rural Rental Housing Program

The Rural Housing Service (an agency within the Rural Development mission area) is proposing an additional form of guarantee under the Guaranteed Rural Rental Housing Program regulation. This action is taken to enhance efficiency, flexibility, and effectiveness in managing the program. The Agency currently offers a guarantee on a permanent loan only and a guarantee on construction advances and the permanent financing phase of a project. In addition to the proposed form of guarantee, the Agency will continue to offer the two types of guarantees currently provided.
Notice of Proposed Changes to the National Handbook of Conservation Practices for the Natural Resources Conservation Service

Notice is hereby given of the intention of NRCS to issue a series of revised conservation practice standards in the National Handbook of Conservation Practices. These standards include: Air Filtration and Scrubbing (Code 371), Animal Trails and Walkways (Code 575), Combustion System Improvement (Code 372), Conservation Crop Rotation (Code 328), Diversion (Code 362), Dust Control on Unpaved Roads and Surfaces (Code 373), Forage Harvest Management (Code 511), Herbaceous Weed Control (Code 315), Range Planting (Code 550), and Riparian Herbaceous Cover (Code 390). NRCS State Conservationists who choose to adopt these practices for use within their States will incorporate them into Section IV of their respective electronic Field Office Technical Guides. These practices may be used in conservation systems that treat highly erodible land (HEL) or on land determined to be a wetland. Section 343 of the Federal Agriculture Improvement and Reform Act of 1996 requires NRCS to make available for public review and comment all proposed revisions to conservation practice standards used to carry out HEL and wetland provisions of the law.
Food Distribution Program on Indian Reservations: Resource Limits and Exclusions, and Extended Certification Periods

The Food and Nutrition Service (FNS) is amending the regulations for the Food Distribution Program on Indian Reservations (FDPIR). The changes will improve program service, ensure consistency between FDPIR and the Supplemental Nutrition Assistance Program (SNAP) (formerly the Food Stamp Program), and respond to concerns expressed by the National Association of Food Distribution Programs on Indian Reservations (NAFDPIR) that the current FDPIR resource limits are insufficient for the target populations and serve as a barrier to participation. The rule will increase the maximum level of allowable resources to the same level permitted under SNAP (including the establishment of a resource limit of $3,000 for FDPIR households with a disabled member in accordance with Section 4107 of the Farm Security and Rural Investment Act of 2002 (Pub. L. 107-171), and annual adjustments for inflation in accordance with Section 4104 of the Food, Conservation, and Energy Act of 2008 (Pub. L. 110-246), allow a resource exclusion for the first $1,500 of the equity value of one pre- paid funeral arrangement per household member, and allow households in which all members are elderly and/or disabled to be certified for up to 24 months.

The Caribou-Targhee National Forest is proposing to charge a $35 fee for the overnight (summer use only) rental of Diamond Creek Guard Station. The guard station is used in the winter time as a warming hut but is currently unused during the summer season. Fees are assessed based on the level of amenities and services provided, cost of operations and maintenance, market assessment and public comment. The fee is proposed and will be determined upon further analysis and public comment. To date, an analysis of the cabin shows that the proposed fees are reasonable and typical of similar sites in the area. Rentals of other cabins on the Caribou-Targhee National Forest have shown that publics appreciate and enjoy the availability of historic and other type rental cabins. Funds from fees will be used for the continued operation and maintenance of the Diamond Creek Guard Station.

The Grain Inspection, Packers and Stockyards Administration (GIPSA) is taking several actions to post and depost stockyards under the Packers and Stockyards Act (P&S Act). Specifically, we are proposing that eight stockyards now operating subject to the P&S Act be posted. We are posting 20 stockyards that were identified previously as operating subject to the P&S Act. Finally, we are deposting 34 stockyards that can no longer be used as stockyards.
