Chronic Wasting Disease Herd Certification Program and Interstate Movement of Farmed or Captive Deer, Elk, and Moose
We are proposing further amendments that would establish a herd certification program to eliminate chronic wasting disease from farmed or captive cervids in the United States. Under the 2006 Chronic Wasting Disease (CWD) rule, participating deer, elk, and moose herds would have to follow CWD Herd Certification Program requirements for animal identification, testing, herd management, and movement of animals into and from herds. This document proposes additional changes to the program regarding recognition of State bans on the entry of farmed or captive cervids for reasons unrelated to CWD, the number of years an animal must be monitored for CWD before it may move interstate, interstate movement of cervids that originated from herds in proximity to a CWD outbreak, herd inventory procedures, and several other matters. These actions are intended to help eliminate CWD from the farmed or captive cervid herds in the United States.
Notice of Sanders County Resource Advisory Committee Meeting
Pursuant to the authorities in the Federal Advisory Committee Act (Pub. L. 92-463) and under the Secure Rural Schools and Community Self-Determination Act of 2000 (Pub. L. 106-393) the Lob and Kootenai National Forests' Sanders County Resource Advisory Committee will meet on April 16 at 7 p.m. in Thompson Falls, Montana for a business meeting. The meeting is open to the public.
Notice of Proposed New Fee Site; Federal Lands Recreation Enhancement Act, (Title VIII, Pub. L. 108-447)
The Tahoe National Forest is proposing to charge a new fee at one developed recreation site. Fees are assessed based on the level of amenities and services provided, cost of operation and maintenance, market assessment, and public comment. The fee listed is only proposed and final determination will be made upon further analysis and public comment. Funds from the fee would be used for the operation and maintenance of this recreation site.
Sale and Disposal of National Forest System Timber; Special Forest Products and Forest Botanical Products
The Department is delaying the effective date of this rule for an additional 60 days. The Department previously delayed the effective date and sought comment for 30 days ending on March 2, 2009 (74 FR 5107). More time is needed for the Forest Service to properly respond to the comments and to consider any potential changes to the rule. The rule regulates the sustainable free use, commercial harvest, and sale of special forest products and forest botanical products from National Forest System lands.
Import/Export User Fees
We are amending the regulations concerning user fees for import- and export-related services that we provide for animals, animal products, birds, germ plasm, organisms, and vectors. We are increasing those fees for fiscal years 2009 through 2013 in order to ensure that the fees accurately reflect the anticipated costs of providing these services each year. By publishing the annual user fee changes in advance, users can incorporate the fees into their budget planning.
Change in Disease Status of the Republic of Korea With Regard to Foot-and-Mouth Disease and Rinderpest
We are proposing to amend the regulations to add the Republic of Korea to the list of regions that are considered free of rinderpest and foot-and-mouth disease (FMD). We are taking this action because we have conducted an evaluation and determined that the Republic of Korea is free of rinderpest and FMD. We are also proposing to add the Republic of Korea to the list of regions that are subject to certain import restrictions on meat and meat products because of their proximity to or trading relationships with rinderpest- or FMD-affected countries. These actions would update the disease status of the Republic of Korea with regard to rinderpest and FMD while continuing to protect the United States from an introduction of those diseases by providing additional requirements for meat and other animal products imported into the United States from the Republic of Korea.

Solicitation of Nominations, Advisory Committee on Biotechnology and 21st Century Agriculture
Pursuant to 5 U.S.C. App., the Agricultural Research Service is requesting nominations for qualified persons to serve as members of the Secretary's Advisory Committee on Biotechnology and 21st Century Agriculture (AC21). The charge for the AC21 is two-fold: To examine the long-term impacts of biotechnology on the U.S. food and agriculture system and USDA; and to provide guidance to USDA on pressing individual issues, identified by the Office of the Secretary, related to the application of biotechnology in agriculture.
Funding Opportunity Title: Commodity Partnerships for Small Agricultural Risk Management Education Sessions (Commodity Partnerships Small Sessions Program)
The Federal Crop Insurance Corporation (FCIC), operating through the Risk Management Agency (RMA), announces the availability of approximately $900,000 (subject to availability of funds) for Commodity Partnerships for Small Agricultural Risk Management Education Sessions (the Commodity Partnerships Small Sessions Program). The purpose of this cooperative partnership agreement program is to deliver training and information in the management of production, marketing, and financial risk to U.S. agricultural producers. The program gives priority to educating producers of crops currently not insured under Federal crop insurance, specialty crops, and underserved commodities, including livestock and forage. A maximum of 90 cooperative partnership agreements will be funded, with no more than nine in each of the ten designated RMA Regions. The maximum award for any cooperative partnership agreement will be $10,000. Awardees must demonstrate non- financial benefits from a cooperative partnership agreement and must agree to the substantial involvement of RMA in the project. Funding availability for this program may be announced at approximately the same time as funding availability for similar but separate programs CFDA No. 10.455 (Community Outreach and Assistance Partnerships), and CFDA No. 10.458 (Crop Insurance Education in Targeted States). Prospective applicants should carefully examine and compare the notices for each program.
Funding Opportunity Title: Crop Insurance Education in Targeted States (Targeted States Program)
The Federal Crop Insurance Corporation (FCIC), operating through the Risk Management Agency (RMA), announces the availability of approximately $4.5 million (subject to availability of funds) to fund cooperative agreements under the Crop Insurance Education in Targeted States program (the Targeted States Program). The purpose of this cooperative agreement program is to deliver crop insurance education and information to U.S. agricultural producers in certain States that have been designated as historically underserved with respect to crop insurance. The states, collectively referred to as Targeted States, are Connecticut, Delaware, Hawaii, Maine, Maryland, Massachusetts, Nevada, New Hampshire, New Jersey, New York, Pennsylvania, Rhode Island, Utah, Vermont, West Virginia, and Wyoming. A maximum of 16 cooperative agreements will be funded, one in each of the 16 Targeted States. Awardees must agree to the substantial involvement of RMA in the project. Specialty Crop Block Grant Program-Farm Bill
This rule finalizes regulations to administer the Specialty Crop Block Grant ProgramFarm Bill (SCBGP-FB) to enhance the competitiveness of specialty crops. This action finalizes eligibility and application requirements and grant administration procedures for the SCBGP-FB consistent with the Food, Conservation, and Energy Act of 2008 (Farm Bill) amendments to the Specialty Crops Competitiveness Act of 2004. This program is separate from the Specialty Crop Block Grant Program (SCBGP).
Child Nutrition Programs-Income Eligibility Guidelines
This Notice announces the Department's annual adjustments to the Income Eligibility Guidelines to be used in determining eligibility for free and reduced price meals and free milk for the period from July 1, 2009 through June 30, 2010. These guidelines are used by schools, institutions, and facilities participating in the National School Lunch Program (and Commodity School Program), School Breakfast Program, Special Milk Program for Children, Child and Adult Care Food Program and Summer Food Service Program. The annual adjustments are required by section 9 of the Richard B. Russell National School Lunch Act. The guidelines are intended to direct benefits to those children most in need and are revised annually to account for changes in the Consumer Price Index.
Dixie National Forest; Tropic To Hatch 138kV Transmission Line Project, Correction to Include Notice of Intent To Amend the Bureau of Land Management, Grand Staircase-Escalante National Monument Management Plan
Pursuant to section 102(2) of the National Environmental Policy Act of 1969, 40 Code of Federal Regulations (CFR) subparts 1500- 1508, and 43 CFR subpart 1610.5-5 (Planning Regulations), notice is hereby given that the Bureau of Land Management (BLM), Grand Staircase- Escalante National Monument intends to prepare an amendment to the Grand Staircase-Escalante National Monument Management Plan (MMP) with an associated environmental impact statement (EIS) in cooperation with the U.S. Forest Service as lead agency. The Dixie National Forest published a Notice of Intent in the Federal Register to initiate this proposal on February 21, 2008, but did not include the BLM's Grand Staircase-Escalante National Monument (GSENM) Notice of Intent into its heading. The publication of this Federal Register notice is to make the public aware that this action also applies to a possible land use plan amendment to the MMP. Discussion of the GSENM amendment was in the body of the original Federal Register notice, but was not evident in the title. The public is now provided a second opportunity to review and provide comments on this possible amendment to the BLM's MMP based on the planning criteria identified in the SUPPLEMENTARY INFORMATION below.
User Fees for 2009 Crop Cotton Classification Services to Growers
The Agricultural Marketing Service (AMS) is proposing to raise user fees for cotton producers for 2009 crop cotton classification services under the Cotton Statistics and Estimates Act. These user fees also are authorized under the Cotton Standards Act of 1923. The 2008 user fee for this classification service was $2.00 per bale. This proposal would raise the fee for the 2009 crop to $2.20 per bale. The proposed fee and the existing reserve are sufficient to cover the costs of providing classification services, including costs for administration and supervision.
Agricultural Water Enhancement Program
The Commodity Credit Corporation (CCC) published in the Federal Register of January 14, 2009, a Notice of Request for Proposals to announce the availability of funds and to solicit proposals from potential partners who seek to enter into partnership agreements with the Chief, Natural Resources Conservation Service (NRCS). The deadline for submitting proposals was March 2, 2009. The purpose of this notice is to reopen the deadline for submitting proposals and to provide NRCS State Conservationists up to 2 weeks following the proposal submission deadline to submit their letter of review. The CCC is hereby reopening the deadline for submitting proposals until April 1, 2009.
Siskiyou County Resource Advisory Committee
The Siskiyou County Resource Advisory Committee (RAC) will host a workshop for the public in local communities to provide information and expertise to those who may want to submit project proposals to the RAC. Following the time allowed on the agenda for the workshop, the RAC will meet to conduct routine business consistent with the Secure Rural Schools and Community Self-Determination Act.
Lake Tahoe Basin Federal Advisory Committee
The Lake Tahoe Basin Federal Advisory Committee will hold a meeting on March 31, 2009 at the U.S. Forest Service Office, 35 College Drive, South Lake Tahoe, CA 96150. This Committee, established by the Secretary of Agriculture on December 15, 1998 (64 FR 2876), is chartered to provide advice to the Secretary on implementing the terms of the Federal Interagency Partnership on the Lake Tahoe Region and other matters raised by the Secretary.
Common Crop Insurance Regulations, Tobacco Crop Insurance Provisions
The Federal Crop Insurance Corporation (FCIC) finalizes the Common Crop Insurance Regulations Tobacco Crop Provisions. The amended provisions removed the Quota Tobacco Crop Insurance Provisions, and revised the Guaranteed Tobacco Crop Insurance Provisions, and changed the title of the Guaranteed Tobacco Crop Insurance Provisions to Tobacco Crop Insurance Provisions. The intended effect of this action is to provide policy changes and clarify existing policy provisions to better meet the needs of insured producers. The changes will apply for the 2010 and succeeding crop years.

Notice of Meeting; Federal Lands Recreation Enhancement Act (Title VIII, Pub. L. 108-447)
The Colorado Recreation Resource Advisory Committee will tentatively meet in Denver, CO. The purpose of the meeting is to continue to provide the new committee members with the information they need to be effective committee members and review several fee proposals. These fee proposals will tentatively include fee increases for Christmas Tree cutting permits for the Grand Mesa/Uncompahgre/ Gunnison National Forests and the Mud Springs Campground located in the Grand Junction Field Office Area of the BLM. A new fee for the North Fruita Desert Campground also located in the Grand Junction Field Office Area of the BLM will also be reviewed.

L. 110-343) the Lassen County Resource Advisory Committee will meet April 9, 2009 and May 6 and 7, 2009 in Susanville, California for business meetings. The meetings are open to the public.
McGovern Dole International Food for Education and Child Nutrition Program and Food for Progress Program
This final rule amends the regulations to administer the Food for Progress (FFPr) Program and the McGovern-Dole International Food for Education and Child Nutrition Program (McGovern-Dole Program) by making revisions to provide greater clarity with respect to all aspects of the program, with specific emphasis on the eligibility requirements that a participant must meet and the actions that must be undertaken by a participant in order to receive assistance under these programs, including the reports that are filed by program participants with the Foreign Agricultural Service (FAS). This final rule also amends the Agriculture Acquisition Regulation (AGAR), to specify the criteria that is used in determining whether a commodity that is procured under these programs and under domestic feeding programs administered by U.S. Department of Agriculture (USDA) is considered to be a product of the United States. The purpose of these amendments is to improve the efficiency of the programs and make it clearer to participants what they must do to meet eligibility requirements.

Okanogan-Wenatchee National Forest, Washington; Motorized Travel Management
The Forest Supervisor of the Okanogan-Wenatchee National Forest (OWNF) gives notice of the intent to prepare an Environmental Impact Statement (EIS) on a Proposed Action to implement 36 CFR Parts 212, 251, 261, and 295; Travel Management: Designated Routes and Areas for Motor Vehicle Use; Final Rule (Travel Management Rule) to designate a system of roads, trails, and areas that are open to motor vehicle use. Creating a new motor vehicle travel plan is necessary to improve management and enforcement of off-highway vehicle (OHV) travel policy on the Forest. Existing travel rules that were established in the current Forest Plans did not anticipate the rapid increase in off- highway vehicle use or the types of user conflicts and resource impacts that have occurred in recent years. This notice announces the beginning of scoping, describes the specific elements to be included in a new travel plan, describes the decisions to be made, and estimates the dates for filing the draft and final EIS. In accordance with the National Environmental Policy Act (NEPA, 42 U.S.C. 4321 et seq.) and the National Forest Management Act (NFMA, 16 U.S.C. 1600-1614 et seq.), the Forest Service announces the decision to amend selected Land Management Plans. Specifically, the ROD amends 38 Land Management Plans for National Forests in 10 of the 11 Western States. The United States Department of the Interior and the Bureau of Land Management (BLM) are expected to concurrently announce a similar decision amending their respective Resource Management Plans.

Tuberculosis in Cattle and Bison; State and Zone Designations; New Mexico
We are amending the bovine tuberculosis regulations to establish two separate zones with different tuberculosis risk classifications for the State of New Mexico. The entire State of New Mexico has been classified as modified accredited advanced; however, all its affected herds are located in a small area along the State's eastern border. We have determined that New Mexico meets our requirements for zone classification. Therefore, we are removing New Mexico from the list of modified accredited advanced States, adding an area consisting of Curry and Roosevelt Counties, NM, to the list of modified accredited advanced zones, and adding the remainder of the State to the list of accredited-free zones. This action relieves restrictions on the interstate movement of cattle and bison from these areas of New Mexico outside of the modified accredited advanced zone in two counties.
Tart Cherries Grown in the States of Michigan, et al.; Change to Fiscal Period
The Department of Agriculture (USDA) is adopting, as a final rule, without change, an interim final rule changing the fiscal period prescribed under the tart cherry marketing order (order). The order regulates the handling of tart cherries grown in Michigan, New York, Pennsylvania, Oregon, Utah, Washington and Wisconsin and is administered locally by the Cherry Industry Administrative Board (Board). This rule continues in effect an action that changed the fiscal period from July 1 through June 30 to October 1 through September 30. This will improve the administration and the fiscal operation of the Board.
Kiwifruit Grown in California; Decreased Assessment Rate
The Department of Agriculture (USDA) is adopting, as a final rule, without change, an interim final rule which decreased the assessment rate established for the Kiwifruit Administrative Committee (Committee) for the 2008-09 and subsequent fiscal periods from $0.045 to $0.035 per 9-kilo volume-fill container or equivalent of kiwifruit. The Committee locally administers the marketing order which regulates the handling of kiwifruit grown in California. Assessments upon kiwifruit handlers are used by the Committee to fund reasonable and necessary expenses of the program. The fiscal period begins on August 1 and ends July 31. The assessment rate will remain in effect indefinitely unless modified, suspended, or terminated.
Lost River Subwatershed of the Potomac River Watershed, Hardy County, WV
Pursuant to Section 102(2)(C) of the National Environmental Policy Act of 1969; the Council on Environmental Quality Guidelines (40 CFR Part 1500); and the Natural Resources Conservation Service Guidelines (7 CFR Part 650); the Natural Resources Conservation Service (NRCS), U.S. Department of Agriculture, is giving notice that a second draft supplemental work plan and second draft environmental impact statement (SDEIS) are being prepared for the Lost River Subwatershed of the Potomac River Watershed, Hardy County, West Virginia. The SDEIS will evaluate potential impacts to the natural, physical and human environment as a result of the flood damage reduction and water supply storage measures proposed for the Lost River Subwatershed, Hardy County, West Virginia.
Solicitation of Input From Stakeholders Regarding the Smith-Lever 3(d) Extension Integrated Pest Management Competitive Grants Program
Section 7403 of the Food, Conservation, and Energy Act of 2008 (Pub. L. 110-246) (FCEA) amended section 3(d) of the Smith-Lever Act (7 U.S.C. 343(d)) to provide the opportunity for 1862 and 1890 Land-Grant Institutions, including Tuskegee University and West Virginia State University to compete for section 3(d) funds. Section 7417 of FCEA also provided the University of the District of Columbia the opportunity to compete for section 3(d) funds. The Extension Integrated Pest Management Coordination and Support Program (EIPM-CS) is among the Extension programs funded under this authority. By this notice, CSREES is designated to act on behalf of the Secretary of Agriculture in soliciting public comment from interested persons regarding the future design and implementation of this program.

Mandatory Country of Origin Labeling of Muscle Cuts of Beef (Including Veal), Lamb, Chicken, Goat, and Pork; Ground Beef, Ground Lamb, Ground Chicken, Ground Goat, and Ground Pork
The Food Safety and Inspection Service (FSIS) is affirming, without change, its interim final rule requiring a country of origin statement on the label of any meat or poultry product that is a covered commodity, as defined by the Agricultural Marketing Service (AMS), and that is to be sold by a retailer, also as defined by AMS, in accordance with the regulations set out in AMS' final rule, ``Mandatory Country of Origin Labeling of Beef, Pork, Lamb, Chicken, Goat Meat, Perishable Agricultural Commodities, Peanuts, Pecans, Ginseng, and Macadamia Nuts.'' FSIS is also affirming, without change, the provisions of the interim final rule that amended its regulations to provide that it will consider the addition of compliant country of origin statements to the labels of covered meat or poultry products to be generically approved. FSIS is thus conforming its regulations to the AMS final rule. FSIS is not amending its regulations or labeling policies for meat or poultry products that are non-covered commodities.

Regulations Under the Perishable Agricultural Commodities Act, 1930; Section 610 Review
This notice summarizes the results of an Agricultural Marketing Service (AMS) review of the Regulations (Other than Rules of Practice) under the Perishable Agricultural Commodities Act, 1930, as amended, under the criteria contained in section 610 of the Regulatory Flexibility Act (RFA). Based upon its review, AMS has determined that the Regulations (Other than Rules of Practice) under the Perishable Agricultural Commodities Act, 1930, as amended, should be continued without change.
Fremont Winema National Forests; Oregon; Proposed Forest Plan Amendments for the Ruby Pipeline L.L.C. Project
The USDA Forest Service (Forest Service), Fremont Winema National Forests, is proposing to prepare an amendment to the Fremont National Forest Land and Resource Management Plan (Forest Plan) for the proposed Ruby Pipeline Project (Project). The Federal Energy Regulatory Commission (FERC) is the lead agency for this proposed natural gas pipeline (Docket No. CP09-54-000). The staff of FERC is preparing an Environmental Impact Statement (EIS) that will discuss the environmental impacts that could result from the construction and operation of a new underground natural gas pipeline proposed by Ruby Pipeline, LLC (Ruby). The Project's proposed facilities consist of 675.2 miles of 42-inch-diameter natural gas pipeline, four new compressor stations, and related facilities. The USDA Forest Service, Fremont Winema National Forests is participating as a cooperating agency because the Project traverses the Fremont Winema National Forests in Oregon. As a cooperating agency, the U.S. Forest Service, Fremont Winema National Forests intends to adopt the FERC EIS per Title 40 CFR 1506.3, to meet its National Environmental Policy Act (NEPA) responsibilities. FERC, as lead federal agency in the preparation of the EIS, is preparing the EIS to satisfy the requirements of NEPA. NEPA requires FERC to take into account the environmental impacts that could result from an action when it considers whether or not an interstate natural gas pipeline should be issued a Certificate of Public Convenience and Necessity for construction of the pipeline. FERC will use the EIS to consider the environmental impacts that could result if it issues project authorizations. FERC will use the EIS in its decision-making processes to determine whether or not to authorize the Project. FERC initiated its pre-filing process on January 31, 2008 and issued a Notice of Intent (NOI) to prepare an EIS for this Project on September 26, 2008. The USDA Forest Service will use the EIS to evaluate the proposed amendments to the Fremont Forest Plan and for any forest plan amendment decisions made subsequently should FERC authorize this Project. The Forest Service has determined that an amendment to the Fremont Forest Plan would be needed because the Project would not meet the plan Standards and Guidelines for soil disturbance, visual quality, mechanical disturbance in seeps and springs, and old growth management. Analysis of the effects of the amendment will be included in the FERC EIS. This notice announces the intention to prepare an amendment to the Fremont Forest Plan.
Opportunity for Designation in the Pocatello, ID; Lewiston, ID; Evansville, IN; and Utah Areas and Request for Comments on the Official Agencies Serving These Areas
The designations of the official agencies listed below will end on September 30, 2009. We are asking persons or governmental agencies interested in providing official services in the areas served by these agencies to submit an application for designation. We are also asking for comments on the quality of services provided by these currently designated agencies: Idaho Grain Inspection Service, Inc. (Idaho); Lewiston Grain Inspection Service, Inc. (Lewiston); Ohio Valley Grain Inspection, Inc. (Ohio Valley); and Utah Department of Agriculture and Food (Utah).
Designation for the Jamestown, ND; Lincoln, NE; Memphis, TN; and Sioux City, IA Areas
GIPSA is announcing designation of the following organizations to provide official services under the United States Grain Standards Act, as amended (USGSA): Grain Inspection, Inc. (Jamestown); Lincoln Inspection Service, Inc. (Lincoln); Midsouth Grain Inspection Service (Midsouth); and Sioux City Inspection and Weighing Service Company (Sioux City).
Notice of Central Idaho Resource Advisory Committee Meeting
Pursuant to the authorities in the Federal Advisory Committee Act (Pub. L. 92-463) and under the Secure Rural Schools and Community Self Determination Act of 2000 (Pub. L. 106-393), the Salmon-Challis National Forest's Central Idaho Resource Advisory Committee will conduct a business meeting which is open to the public.
Hood/Willamette Resource Advisory Committee (RAC)
The Hood/Willamette Resource Advisory Committee (RAC) will meet on Friday, April 24, 2009. The meeting is scheduled to begin at 9:30 a.m. and will conclude at approximately 12 p.m. The meeting will be held at Salem Office of the Bureau of Land Management Office; 1717 Fabry Road SE; Salem, Oregon; (503) 375-5646. The tentative agenda includes: (1) Orientation; (2) Election of chairperson; (3) Decision on overhead rate for 2009 and 2010 projects; (4) Presentation of 2009 and 2010 Projects; and (5) Public Forum. The Public Forum is tentatively scheduled to begin at 10:30 a.m. Time allotted for individual presentations will be limited to 4-5 minutes. Written comments are encouraged, particularly if the material cannot be presented within the time limits for the Public Forum. Written comments may be submitted prior to the April 24th meeting by sending them to Donna Short at the address given below.
