Interim Procedures for Considering Requests Under the Commercial Availability Provision of the United States-Colombia Trade Promotion Agreement

This notice sets forth the interim procedures the Committee for the Implementation of Textile Agreements (``CITA'') will follow in implementing certain provisions of the United States-Colombia Trade Promotion Agreement (``US-Colombia TPA''). Section 203(o)(4) of the United States-Colombia Trade Promotion Agreement Implementation Act (``Implementation Act'') authorizes the President to establish procedures to modify the list of fabrics, yarns, or fibers not available in commercial quantities in a timely manner in either the United States or Colombia as set out in Annex 3-B of the US- Colombia TPA. The President has delegated to CITA the authority to determine whether fabrics, yarns, or fibers are not available in commercial quantities in a timely manner in either the United States or Colombia and has directed CITA to establish procedures that govern the submission of a request and provide the opportunity for interested entities to submit comments and supporting evidence for any such determination pursuant to the Implementation Act. CITA hereby gives notice to interested entities of the procedures CITA will follow in considering such requests and solicits public written comments on these interim procedures. CITA will be using the procedures detailed in this notice as of November 6, 2012.

This notice sets forth the interim procedures the Committee for the Implementation of Textile Agreements (``CITA'') will follow in implementing certain provisions of the United StatesColombia Trade Promotion Agreement (``U.S.-Colombia TPA''). Title III, Subtitle B, Section 321 through Section 328 of the United States-Colombia Trade Promotion Agreement Implementation Act (``Implementation Act'') [Pub. L. 112-42] authorizes the President to consider requests from the public for textile and apparel safeguard actions. The President has delegated to CITA the authority to determine whether imports of a Colombian textile or apparel article are causing serious damage, or actual threat thereof, to a domestic industry producing an article that is like, or directly competitive with, the imported article. CITA hereby gives notice to interested entities of the procedure CITA will follow in considering such requests and solicits public written comments on these interim procedures.

This notice sets forth the interim procedures the Committee for the Implementation of Textile Agreements (``CITA'') will follow in implementing certain provisions of the United States-Korea Free Trade Agreement Implementation Act (the ``Act''). Section 202(o)(3)(F) of the Act provides that the President shall establish procedures to govern the submission of requests to modify the list of fibers, yarns, or fabrics not available in commercial quantities in a timely manner in the United States as set out in Annex 4-B-1 of the United States-Korea Free Trade Agreement (the ``Agreement''). The President has delegated to CITA the authority to determine whether fibers, yarns, or fabrics are not available in commercial quantities in a timely manner in the United States and has directed CITA to establish procedures that govern the submission of a request and provide the opportunity for interested entities to submit comments and supporting evidence in any such determination pursuant to the Act and the Agreement. CITA hereby gives notice to interested entities of the procedure CITA will follow in considering such requests and solicits public written comments on these interim procedures. In accordance with the Paperwork Reduction Act, this notice further provides an estimate of the burden to the public to collect and submit information as required by Section 202(o)(3)(F) of the Act and CITA's interim procedures. CITA hereby gives notice of the estimated burden to the public.

The Committee for the Implementation of Textile Agreements (``CITA'') has determined that certain faux suede bonded to faux fur pile fabric, as specified below, is not available in commercial quantities in a timely manner in the CAFTA-DR countries. The product will be added to the list in Annex 3.25 of the CAFTA-DR Agreement in unrestricted quantities.
