Under the provisions of section 371(a) of the Energy Policy Act of 2005, the lessee, Charles A. Einarsen, timely filed a petition for reinstatement of competitive oil and gas lease WYW153586 in Natrona County, Wyoming. The lessee paid the required rental accruing from the date of termination, September 1, 2002, and submitted a signed agreement, specifying future rental and royalty rates for this lease would be at $10.00 per acre or fraction of an acre and 16\2/3\ percent respectively. In accordance with 43 CFR 3103.4-1 and 43 CFR 3108.2-3(f) the lessee petitioned to reduce the rental and royalty rates for the subject lease to the rates specified in sections 1 and 2 of the original lease agreement and submitted justification and rationalization for the request. After thoroughly reviewing the lessee's petition and taking into consideration the information submitted, we have granted the request to reduce the rental rates to those in Section 1 of the original lease agreement but have denied the request for a reduced royalty rate. The purpose of granting a reduced royalty rate is to extend the productive life of an existing well. Normally it cannot be determined whether a lease can be successfully operated at the higher royalty rate required for reinstated leases until the lease has been fully developed. Because the productivity of the leasehold has not been fully determined, the request for a reduced royalty rate is premature. No leases were issued that affect these lands. The lessee had paid the required $500 administrative fee for lease reinstatement and $166 cost for publishing this Notice. The lessee has met all the requirements for reinstatement of the lease per Sec. 31(e) of the Mineral Leasing Act of 1920 (30 U.S.C. 188(e)). We are proposing to reinstate the lease, effective the date of termination subject to: The original terms and conditions of the lease; The rental rates specified in section 1 of the original lease agreement; and The increased royalty of 16\2/3\ percent or 4 percentages above the existing competitive royalty rate.

This document corrects the regulatory text of a proposed rule published in the Federal Register of November 22, 2005, regarding permits for recreation on public lands. First, it corrects two prohibited acts provisions to make it clear that persons who fail to pay a permit fee will incur a maximum penalty of $100, as provided in the Federal Lands Recreation Enhancement Act (the Act), but that those who fail to obtain a permit will be subject to the higher penalties of the Federal Lands Policy and Management Act and other laws, as provided by the Act. Second, it corrects a penalty provision to be consistent with the correction in the prohibited acts provisions. Also, the document extends the comment period in light of the substantive nature of the corrections.

In accordance with the Federal Land Policy and Management Act (FLPMA) and the National Environmental Policy Act (NEPA), the Bureau of Land Management (BLM) announces the availability of the Proposed Resource Management Plan Amendment/Final Environmental Impact Statement (PRMPA/FEIS) for McGregor Range in Otero County, New Mexico. The planning area encompasses approximately 608,000 surface acres of public land withdrawn by the Department of Army and jointly managed by the Las Cruces District Office and Fort Bliss Texas. It is located in south central Otero County in southern New Mexico. The BLM has and will continue to work closely with all interested parties to identify management decisions that are best suited to the needs of the public. Final decisions will supersede those in the previous RMPA for McGregor Range that was completed in 1990, and will provide direction for management of the resources and public uses of the withdrawn public land.

On Monday, December 12, 2005, the Bureau of Land Management published a Notice of Availability of the Draft Environmental Impact Statement for the Atlantic Rim Natural Gas Development Project in the Federal Register [Vol. 70, No. 237, p. 73482]. The SUPPLEMENTARY INFORMATION on alternatives analyzed in detail contained naming errors. The correct information is as follows: The Atlantic Rim DEIS analyzed four alternatives in detail: 1. The Proposed Action Alternative; 2. Alternative A, the No Action Alternative, which means the project as proposed would be rejected by the BLM; 3. Alternative BPhased development; and, 4. Alternative CSpecial protection of sensitive of sensitive resources. ``The agency's preferred alternative is a combination of Alternative B and C.'' These corrected alternative names also correct references to the alternatives for the remainder of the notice.

In accordance with the National Environmental Policy Act (NEPA), the Federal Land Policy and Management Act (FLPMA), and Bureau of Land Management (BLM) procedures, the BLM announces the availability of the ROD to implement a Wind Energy Development Program and amend BLM land use plans. The decision is hereby made to implement a comprehensive Wind Energy Development Program to administer the development of wind energy resources on BLM-administered public lands in 11 western states, excluding Alaska. In addition, this decision amends 52 BLM land use plans in 9 states to adopt the new program. The Assistant Director, Minerals, Realty and Resource Protection and the Assistant Director, Renewable Resources and Planning jointly signed the ROD on December 15, 2005.
