Under the provisions of the Paperwork Reduction Act of 1995 [Pub. L. 104-13; 44 U.S.C. Chapter 3506(c)(2)(A)], this notice announces that the information collection activity titled, ``Surveys and Other Audience Research for Radio and TV Marti'' has been forwarded to the Office of Management and Budget (OMB) for review and comment. The Broadcasting Board of Governors (BBG) is requesting reinstatement of this collection for a three-year period and approval of a revision to the burden hours. The information collection activity involved with this program is conducted pursuant to the mandate given to the BBG (formerly the United States Information Agency) in accordance with Public Law 98-111, the Radio Broadcasting to Cuba Act, dated, October 4, 1983, to provide for the broadcasting of accurate information to the people of Cuba and for other purposes. This act was amended by Public Law 101-246, dated, February 16, 1990, which established the authority for TV Marti.

The Broadcasting Board of Governors (BBG) is publishing as a final rule a regulation governing access to BBG information and records in connection with legal proceedings in which neither the United States nor the BBG is a party. The proposed rule was published for comment in 72 FR 10954 dated March 12, 2007. The BBG received no responses to the proposed rule. The final rule and corresponding regulation establishes guidelines for use in determining whether BBG employees are permitted to testify or to provide records relating to their official duties and procedures that requesters must follow when making demands on, or requests to, a BBG employee for official documents or to provide testimony.

The Broadcasting Board of Governors (BBG) seeks public comment on a proposed rule that would govern access to BBG information and records in connection with legal proceedings in which neither the United States nor the BBG is a party. The rule would establish guidelines for use in determining whether BBG employees will be permitted to testify or to provide records relating to their official duties. The rule would also establish procedures that requesters would have to follow when making demands on or requests to a BBG employee for official documents or to provide testimony. The proposed rule will promote uniformity in decisions, conserve the ability of BBG to conduct official business, preserve its employee resources, protect confidential information, provide guidance to requestors, minimize involvement in matters unrelated to its mission and programs, avoid wasteful allocation of agency resources, and avoid spending public time and money for private purposes.
