Notice of Request for Extension of a Currently Approved Information Collection
This notice announces the Agricultural Marketing Service's (AMS) intention to request approval, from the Office of Management and Budget, for an extension of the currently approved information collection request Web-Based Supply Chain Management Commodity Offer Form, Paperwork Collection Notice. This information collection is necessary to support the procurement of agricultural commodities for domestic nutrition assistance programs. AMS issues invitations to purchase fresh and processed commodities for domestic nutrition assistance programs on a year round basis. The extension of the information collection request is required to continue using our Web- Based Supply Chain Management (WBSCM) system, which allows respondents to submit information electronically. The information collection burden for respondents should not increase.

Olives Grown in California; Decreased Assessment Rate
This rule decreases the assessment rate established for the California Olive Committee (Committee) for the 2014 and subsequent fiscal years from $21.16 to $15.21 per ton of assessable olives handled. The Committee locally administers the marketing order, which regulates the handling of olives grown in California. Assessments upon olive handlers are used by the Committee to fund reasonable and necessary expenses of the program. The fiscal year began January 1 and ends December 31. The assessment rate will remain in effect indefinitely unless modified, suspended, or terminated.

National Organic Standards Board (NOSB): Notice of Intent To Renew Charter and Call for Nominations
The National Organic Standards Board (NOSB) was established to assist in developing standards for substances to be used in organic production and to advise the Secretary on the implementation of the Organic Foods Production Act of 1990 (OFPA). Through this Notice, USDA is announcing its intent to renew the Charter of the NOSB; the current charter expires on May 10, 2014. The USDA is also requesting nominations to fill four (4) upcoming vacancies on the NOSB. The positions to be filled are: environmentalist (1 position), producer (1 position), handler (1 position), and retailer (1 position). The Secretary of Agriculture will appoint one person to each of these 4 positions to serve a 5-year term of office that will commence on January 24, 2015, and run until January 24, 2020.
Notice of Meeting of the National Organic Standards Board
In accordance with the Federal Advisory Committee Act, as amended, (5 U.S.C. App.), the Agricultural Marketing Service (AMS) is announcing an upcoming meeting of the National Organic Standards Board (NOSB). Written public comments are invited in advance of the meeting, and the meeting will include scheduled time for oral comments from the public.
Milk in the Appalachian and Southeast Marketing Areas; Final Partial Decision on Proposed Amendments to Marketing Agreements and to Orders
This final decision proposes to permanently adopt revised transportation credit balancing fund provisions for the Appalachian and Southeast milk marketing orders. Specifically, this document Establishes a variable mileage rate factor using a fuel cost adjustor to determine the transportation credit payments of both orders; increases the transportation credit assessment rate for the Appalachian order to $0.15 per hundredweight; and establishes a zero diversion limit standard on loads of milk requesting transportation credits. Separate decisions will address the proposed adoption of an intra- market transportation credit provision for the Appalachian and Southeast orders and for increasing the transportation credit rate assessment for the Southeast order. This final decision is subject to producer approval. Producer approval for this action will be determined concurrently with amendments adopted in a separate final decision that amends the Class I pricing and other provisions of the Appalachian, Southeast, and Florida milk marketing orders.
Milk in the Appalachian, Florida and Southeast Marketing Areas; Final Decision on Proposed Amendments to Marketing Agreements and to Orders
This final decision proposes to permanently adopt amendments that adjust the Class I pricing surface of the Appalachian, Florida, and Southeast Federal milk marketing orders. In addition, this decision seeks to adopt proposals that amend certain features of the diversion limit, touch-base, and transportation credit provisions for the Appalachian and Southeast milk marketing orders. This decision also proposes to adopt amendments that increase the maximum administrative assessment for the Appalachian, Florida and Southeast marketing orders. The orders as amended are subject to approval by producers in the affected markets. Producer approval for this action will be determined concurrently with amendments adopted in a separate final decision that amends the transportation balancing fund and other provisions of the Appalachian and Southeast milk marketing orders.
Dried Prunes Produced in California; Increased Assessment Rate
This rule increases the assessment rate established for the Prune Marketing Committee (Committee) for the 2013-14 and subsequent crop years from $0.22 to $0.28 per ton of salable dried prunes handled. The Committee locally administers the marketing order, which regulates the handling of dried prunes grown in California. Assessments upon dried prune handlers are used by the Committee to fund reasonable and necessary expenses of the program. The crop year begins August 1 and ends July 31. The assessment rate will remain in effect indefinitely unless modified, suspended, or terminated.
Soybean Promotion, Research, and Consumer Information Program: Amendment of Procedures and Notification of Request for Referendum
This interim final rule would amend the procedures to Request a Referendum by removing the specific number of soybean producers eligible to request a referendum under the Soybean Promotion, Research, and Consumer Information program, commonly known as the Soybean Checkoff Program. The number of soybean producers will be replaced with language that allows the Secretary of Agriculture (Secretary) to update this number based on information provided by USDA. Additionally, this action would remove specific USDA and Farm Service Agency (FSA) Web site and office addresses and replace them with more flexible language. These changes will enable AMS to announce future Requests for Referendum without engaging in additional notice-and-comment rulemaking. This rule also serves as AMS' official notice that soybean producers may request a referendum to determine if producers want a referendum on the Soybean Promotion and Research Order (Order), as authorized under the Soybean Promotion, Research, and Consumer Information Act (Act). If at least 10 percent (not in excess of one- fifth of which may be producers in any one State) of eligible producers, as determined by USDA, participate in the Request for Referendum, a referendum will be held within 1 year from that determination. If results of the Request for Referendum indicate that a referendum is not supported, a referendum would not be conducted. The results of the Request for Referendum will be published in the Federal Register.
Kiwifruit Grown in California and Imported Kiwifruit; Relaxation of Minimum Grade Requirement
The Department of Agriculture (USDA) is adopting, as a final rule, without change, an interim rule that relaxed the minimum grade requirement under the marketing order for kiwifruit grown in California (order), and for kiwifruit imported into the United States that are shipped to the fresh market, by increasing the tolerance of kiwifruit which is ``badly misshapen'' from 7 percent to 16 percent. This change is intended to facilitate the packing of fruit to meet the minimum grade requirement of ``KAC No. 1,'' and reduce costs associated with re-sorting and repacking this grade of fruit.
Oranges and Grapefruit Grown in Lower Rio Grande Valley in Texas and Imported Oranges; Change in Size Requirements for Oranges
This rule relaxes the minimum size currently prescribed for oranges under the marketing order for oranges and grapefruit grown in Lower Rio Grande Valley in Texas (order). The order is administered locally by the Texas Valley Citrus Committee (Committee). The corresponding change in the orange import regulation is required under section 8e of the Agricultural Marketing Agreement Act of 1937. This rule relaxes the minimum size requirement for oranges from 2-6/16 inches to 2-3/16 inches in diameter. This rule will provide additional oranges to meet market demand, helping to maximize fresh shipments.
Oranges and Grapefruit Grown in Lower Rio Grande Valley in Texas; Change in Size and Grade Requirements for Grapefruit
This rule relaxes the minimum size and grade requirements currently prescribed for grapefruit under the marketing order for oranges and grapefruit grown in Lower Rio Grande Valley in Texas (order). The order is administered locally by the Texas Valley Citrus Committee (Committee). This rule relaxes the minimum size requirement for grapefruit from 3\5/16\ inches to 3 inches in diameter and reduces the minimum grade requirement for small-sized grapefruit. This rule will provide additional grapefruit to meet market demand, helping to maximize fresh shipments.

Notice of Request for Extension and Revision of a Currently Approved Information Collection for Voluntary Grading.
In accordance with the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), this notice announces the Agricultural Marketing Service's (AMS) intention to request approval, from the Office of Management and Budget, for an extension of and revision to the currently approved information collection in support of the Regulations for Voluntary Grading of Shell Eggs7 CFR Part 56. With this submission we will merge the burden and forms of the 0581-0127 Regulations for Voluntary Grading of Poultry Products and Rabbit Products; 7 CFR Part 70, approved on December 26, 2013; and 0581-0128 Regulations Governing the Voluntary Grading of Shell Eggs, 7 CFR Part 56, approved on June 4, 2011. With this merge we will change the title to Regulations for Voluntary Grading of Shell Eggs, Poultry Products, and Rabbit Products7 CFR Part 56 and 70.

Irish Potatoes Grown in Modoc and Siskiyou Counties, California, and in All Counties in Oregon, Except Malheur County; Termination of Marketing Order No. 947
This final rule terminates Marketing Order No. 947 (order), which regulates the handling of Irish potatoes grown in Modoc and Siskiyou Counties, California, and in all counties in Oregon, except Malheur County, and the rules and regulations issued thereunder. The Department of Agriculture (USDA) has determined that the marketing order is no longer an effective marketing tool for the Oregon- California potato industry, and that termination serves the current needs of the industry while also eliminating the costs associated with the operation of the marketing order.
Irish Potatoes Grown in Colorado; Decreased Assessment Rate for Area No. 2
The Department of Agriculture (USDA) is adopting, as a final rule, without change, an interim rule that decreased the assessment rate established for the Colorado Potato Administrative Committee, Area No. 2 (Committee) for the 2013-2014 and subsequent fiscal periods from $0.0051 to $0.0033 per hundredweight of potatoes handled. The Committee locally administers the marketing order for Irish potatoes grown in Colorado. The interim rule was necessary to allow the Committee to reduce its financial reserve while still providing adequate funding to meet program expenses.
Tomatoes Grown in Florida; Increased Assessment Rate
This rule increases the assessment rate established for the Florida Tomato Committee (Committee) for the 2013-14 and subsequent fiscal periods from $0.024 to $0.0375 per 25-pound carton of tomatoes handled. The Committee locally administers the Federal marketing order, which regulates the handling of tomatoes grown in Florida. Assessments upon Florida tomato handlers are used by the Committee to fund reasonable and necessary expenses of the program. The fiscal period begins August 1 and ends July 31. The assessment rate will remain in effect indefinitely unless modified, suspended, or terminated.
Irish Potatoes Grown in Washington and Imported Potatoes; Modification of the Handling Regulations, Reporting Requirements, and Import Regulations for Red Types of Potatoes
This rule exempts red types of potatoes from minimum quality, maturity, pack, marking, and inspection requirements of the Washington potato marketing order for the remainder of the 2013-2014 fiscal period and subsequent fiscal periods. The marketing order regulates the handling of Irish potatoes grown in Washington and is administered locally by the State of Washington Potato Committee (Committee). During the exemption period, reports will be required from handlers of red types of potatoes to obtain information necessary to administer the marketing order. As required under section 8e of the Agricultural Marketing Agreement Act of 1937, this action also exempts imported red- skinned, round type potatoes from minimum grade, size, quality, and maturity requirements. This rule is expected to reduce overall industry expenses and increase net returns to producers and handlers while giving the industry the opportunity to explore alternative marketing strategies.
Kiwifruit Grown in California; Decreased Assessment Rate
The Department of Agriculture (USDA) is adopting, as a final rule, without change, an interim rule that decreased the assessment rate established for the Kiwifruit Administrative Committee (Committee) for the 2013-14 and subsequent fiscal periods from $0.035 to $0.025 per 9-kilo volume-fill container or equivalent of kiwifruit. The Committee locally administers the marketing order, which regulates the handling of kiwifruit grown in California. The interim rule was necessary to allow the Committee to reduce its financial reserve while still providing adequate funding to meet program expenses.

The committee locally administers the marketing order for dates grown or packed in Riverside County, California. The interim rule was necessary to allow the committee to reduce its operating expenses while still providing adequate funding to meet program expenses.
Farmers' Market Promotion Program: Notice of Request for Extension and Revision of a Currently Approved Information Collection-Farmers Market Promotion Program
In accordance with the Paperwork Reduction Act of 1995 (44 U.S.C. chapter 35), this notice announces the Agricultural Marketing Service's (AMS) intention to request approval from the Office of Management and Budget (OMB) for the currently approved information collection for OMB 0581-0235, an extension and revision of forms ``TM- 29, FMPP Project Proposal Narrative Form'' and ``TM-30, FMPP Supplemental Budget Summary Form.'' An electronic version of these mandatory forms will be posted within the Grants.gov forms library for application submission.
Paper and Paper-Based Packaging Promotion, Research and Information Order
This rule establishes a Paper and Paper-Based Packaging Promotion, Research and Information Order (Order). The purpose of the program is to maintain and expand markets for paper and paper-based packaging. The program will be financed by an assessment on paper and paper-based packaging manufacturers (domestic producers) and importers and administered by a board of industry members appointed by the Secretary of Agriculture (Secretary). The assessment rate will initially be $0.35 per short ton. The U.S. Department of Agriculture (Department or USDA) conducted a referendum among eligible manfacturers and importers from October 28 through November 8, 2013. Eighty-five percent of those voting in the referendum representing 95 percent of the volume of paper and paper-based packaging represented in the referendum favored implementation of the program.
National Organic Program: Notice of Final Guidance on Certification Requirements for Handling Unpackaged Organic Products
The National Organic Program (NOP) is announcing the availability of a final guidance document intended for use by accredited certifying agents, certified operations and non-certified handlers of certified organic products. The guidance document is entitled: Certification Requirements for Handling Unpackaged Organic Products (NOP 5031). This guidance document is intended to inform the public of NOP's current thinking on this topic.

Tart Cherries Grown in the States of Michigan, New York, Pennsylvania, Oregon, Utah, Washington, and Wisconsin; Revising Handler Reporting and Grower Diversion Requirements
The Department of Agriculture (USDA) is adopting, as a final rule, without change, an interim rule that changed handler reporting and grower diversion requirements prescribed under the marketing order for tart cherries grown in the States of Michigan, New York, Pennsylvania, Oregon, Utah, Washington, and Wisconsin (order). The Cherry Industry Administrative Board (Board) locally administers the order. The interim rule changed the deadline for submitting the handler reserve plan from November 1 to October 1 and extended the deadline for redeeming or transferring grower diversion certificates from November 1 to June 30 of a given crop year. These changes provide the industry with a more complete and timely picture of the available supply of tart cherries earlier in the season and give handlers more time and flexibility in meeting their obligations under volume regulation.
Notice of Request for a New Collection of Three Additional Marketing Channels for Local Food
In accordance with the Paperwork Reduction Act of 1995, this notice announces the Agricultural Marketing Service's (AMS) intention to request approval of a new collection, titled: Local Food Directories and Survey, from the Office of Management and Budget (OMB). Recommendations of Advisory Committee on Universal Cotton Standards
The Agricultural Marketing Service (AMS) held meetings of the Universal Cotton Standards Advisory Committee in Raleigh, North Carolina on June 19, 20 and 21, 2013. This notice announces the Advisory Committee's recommendation to adopt USDA's HVI (High Volume Instrument) Cotton Trash Standards as Universal Standards and to change the frequency of Universal Cotton Standards Conferences from once every three years to once every four years. Hardwood Lumber and Hardwood Plywood Promotion, Research and Information Order; Reopening and Extension of Comment Period on Proposed Establishment of a Program
Notice is hereby given that the comment period on the proposed rule establishing an industry-funded promotion, research and information program for hardwood lumber and hardwood plywood is reopened and extended. The comment period is also extended for the new hardwood lumber and hardwood plywood information collection requirements by the Office of Management and Budget (OMB) for the operation of the proposed program. The proposed Hardwood Lumber and Hardwood Plywood Promotion, Research and Information Order, was submitted to the U.S. Department of Agriculture (USDA) by the Blue Ribbon Committee, a committee of 14 hardwood lumber and hardwood plywood industry leaders representing small and large manufacturers and geographically distributed throughout the United States.
