Review and Approval of Projects
This document contains amendments to the project review regulations of the Susquehanna River Basin Commission (Commission) requiring review and approval of any natural gas well development project targeting the Marcellus or Utica shale formations and involving the withdrawal, diversion, or consumptive use of waters of the Susquehanna River Basin, adding a provision providing for a specific approval by rule process for consumptive water use associated with such projects, and modifying the definitions of ``construction'' and ``project.'' In addition, editorial changes are made to the existing approval by rule provision related to the consumptive use of water withdrawn from public water supply systems to make that provision consistent with the new approval by rule provision for natural gas well development projects.
Notice of Public Hearing and Commission Meeting
The Susquehanna River Basin Commission will hold a public hearing as part of its regular business meeting beginning at 8:30 a.m. on December 4, 2008, in Bel Air, Maryland. At the public hearing, the Commission will consider: (1) Approval of certain water resources projects; (2) a request for extension of an emergency certificate issued on October 30, 2008; and (3) adjustments to the SRBC Project Fee Schedule. Details concerning the matters to be addressed at the public hearing and business meeting are contained in the Supplementary Information section of this notice.
Review and Approval of Projects
This document contains proposed rules that would amend the project review regulations of the Susquehanna River Basin Commission (Commission) by requiring review and approval of any natural gas well development project targeting the Marcellus, Utica or other shale formations and involving the withdrawal or consumptive use of waters of the Susquehanna River Basin, adding a provision providing for a specific approval by rule process for consumptive water use associated with such projects and modifying the definition of project. Notice of Actions Taken at September 11, 2008, Meeting
At its regular business meeting on September 11, 2008, in Lewisburg, Pennsylvania, the Commission held a public hearing as part of its regular business meeting. At the public hearing, the Commission: (1) Approved certain water resources projects; (2) approved enforcement actions for six projects; and (3) granted a request for extension of an emergency certificate issued on July 24, 2008. Details concerning these and other matters addressed at the public hearing and business meeting are contained in the Supplementary Information section of this notice.

At the public hearing, the Commission will consider: (1) Approval of certain water resources projects; (2) enforcement actions for six projects; and (3) a request for extension of an emergency certificate issued on July 24, 2008. Notice of Actions Taken at June 12, 2008 Meeting
At its regular business meeting on June 12, 2008 in Elmira, New York, the Commission: (1) Heard a special infrastructure presentation by Ms. Sandra Allen of the N.Y. Department of Environmental Conservation, (2) received a report on the present hydrologic conditions of the basin showing a drying trend in parts of the basin, (3) approved a phased-in proposal to increase the Commission's consumptive use mitigation fee, (4) rescinded certain unneeded Commission policies, (5) adopted the FY-10 Budget, (6) approved two contracts, and (7) elected a new Chairman (Robert M. Summers of Maryland) and Vice-Chairman (Brig. Gen. Todd Semonite) to serve in the next fiscal year. In addition, the Commission heard a Legal Counsel's report, heard an update on recent activities in the regulatory program, and convened a public hearing to: (1) Approve certain water resources projects, including one enforcement action; (2) consider a request for a hearing on an administrative appeal regarding Docket No. 20080305, Mountainview Thoroughbred Racing Association, Inc.; (3) consider a request to reopen Docket No. 20020809, Mountainview Thoroughbred Racing Association, Inc.; and (4) consider a request by Mountainview Thoroughbred Racing Association, Inc. for reconsideration of a denial of a request for stay. Eight water resources projects were also tabled. See the Supplementary Information section below for more details on these actions.

The Susquehanna River Basin Commission (SRBC) has released its draft revised Comprehensive Plan for a 90-day public review and comment period. To facilitate public comment, three public hearings will be held on the draft Plan. Details concerning the subject matter of the public hearings are contained in the Supplementary Information section of this notice.

The Susquehanna River Basin Commission (SRBC) will hold a public hearing on April 23, 2008 in the Susquehanna Room, Pennsylvania Fish & Boat Commission, 1601 Elmerton Ave., Harrisburg, Pennsylvania 17110, beginning at 10 a.m. The purpose of the hearing is to receive comments on a proposed increase in the SRBC Consumptive Use Mitigation Fee and is being held in conjunction with a 60-day public comment period established for the proposal. At the public hearing, the Commission will consider: (1) A request for an administrative hearing, (2) approval of certain water resources projects, including one enforcement action and several diversions into and out of the basin for pipeline testing, and (3) a separate rescission of an existing docket approval. Review and Approval of Projects
This document contains amendments to project review regulations. These amendments include language clarifying the definition of ``agricultural water use,'' and providing a qualified exception to the consumptive use approval requirements for agricultural water use projects. Also, an error in the ``Authority'' citation for Part 808 is corrected.
