Export-Import Bank 2005 – Federal Register Recent Federal Regulation Documents

Ex-Im Bank is issuing a proposed regulation that would establish policy and prescribe procedures with respect to the testimony of Ex-Im Bank personnel, both current and former, and the production of agency records, in legal proceedings. The proposed regulation is designed to balance concerns such as preserving the time of Ex-Im Bank personnel for the conduct of official business against concerns such as whether the disclosure of information requested is necessary to prevent fraud or injustice.

The Export-Import Bank of the United States (Ex-Im Bank) and the U.S. Small Business Administration (SBA) provide working capital guarantees to lenders. In assessing the creditoworthiness of an applicant, Ex-Im Bank and SBA review EIB form 84-1. This form provides information which allows the us to obtain legislatively required reasonable assurance of repayment, as well as to fulfill other statutory requirements. Ex-Im Bank will be the primary administrator of the form.

The Advisory Committee was established by Pub. L. 98-181, November 30, 1983, to advise the Export-Import Bank on its programs and to provide comments for inclusion in the reports of the Export-Import Bank of the United States to Congress. The Sub-Saharan Africa Advisory Committee was established by Public Law 105-121, November 26, 1997, to advise the Board of Directors on the development and implementation of policies and programs designed to support the expansion of the Bank's financial commitments in Sub- Saharan Africa under the loan, guarantee and insurance programs of the Bank. Further, the committee shall make recommendations on how the Bank can facilitate greater support by U.S. commercial banks for trade with Sub-Saharan Africa. Agenda: Given the entire new membership on the advisory committee, the meeting will begin with an ethics briefing applicable to non- government appointees who serve on such a committee followed by a review of the 2004 Ex-Im Bank report to the U.S. Congress on the Bank's activities in sub-Saharan Africa specifically including a report on the September 2004 ``Increasing Capital Flows to Africa'' conference in Johannesburg co-sponsored with the Corporate Council on Africa; a review of the current year's business development efforts in the region; a status report on the Millennium Challenge Corporation as it relates to the selected African countries; and planning for the Africa panel session at the April 14-15 annual Ex-Im Bank meeting.
