Organization and Functions of the Chemical Safety and Hazard Investigation Board
This proposed rule augments 40 CFR part 1600, which governs the administration of the Chemical Safety and Hazard Investigation Board (CSB). The proposed rule adds a requirement for the chairperson to add notation votes that have been calendared for public discussion to the agenda of a public meeting within 90 days of the calendared notation vote. The proposed rule also adds a requirement for the chairperson to conduct a minimum of four public meetings per year in Washington, DC. Following publication of this proposed rule, the CSB welcomes and will consider public comment, and then proceed to a final rule.

National Academy of Sciences Study
The Fiscal Year 2010 appropriations legislation for the Chemical Safety and Hazard Investigation Board (CSB) provides funding for a study by the National Academy of Sciences (NAS) to examine the use and storage of methyl isocyanate, including the feasibility of implementing alternative chemicals or processes and an examination of the cost of alternatives at the Bayer CropScience facility in Institute, West Virginia. With this notice, the CSB is outlining the scope of the study to be undertaken by the NAS and requesting public comments regarding the study.

The Clean Air Act requires that the Chemical Safety and Hazard Investigation Board (CSB) establish a regulation which would require that accidental chemical releases be reported to the CSB or to the National Response Center. With this advance notice of proposed rulemaking, the CSB seeks to obtain comments on how best to proceed with implementing this requirement. The CSB will use this information in the development of a proposed and then a final rule.
