Meeting of the Judicial Conference Advisory Committee on Rules of Criminal Procedure
The Advisory Committee on Rules of Criminal Procedure will hold a two-day meeting. The meeting will be open to public observation but not participation.
Hearings of the Judicial Conference Advisory Committees on Rules of Appellate, Bankruptcy, Civil, and Criminal Procedure
The Advisory Committees on Rules of Appellate, Bankruptcy, Civil, and Criminal Procedure have proposed new rules and amendments to the following rules: Appellate Rule: 25; Bankruptcy Rules: 1014, 3001, 3007, 4001, 6006, 7007.1, and new Rules 6003, 9005.1, and 9037; Civil Rule: New Rule 5.2, and Illustrative Forms; and Criminal Rules: 11, 32, 35, 45, and new Rule 49.1. Public hearings are scheduled to be held on the amendments to: Appellate Rules in Phoenix, Arizona, on January 9, 2006; Bankruptcy Rules in Phoenix, Arizona, on January 9, 2006; Civil Rules in Chicago, Illinois, on November 18, 2005; and in Washington, DC, on December 2, 2005; and Criminal Rules in Phoenix, Arizona, on January 9, 2006. Those wishing to testify should contact the Secretary at the address below in writing at least 30 days before the hearing. All written comments and suggestions with respect to the proposed amendments and new rules must be placed in the hands of the Secretary as soon as convenient and not later than February 15, 2006. The Farm Credit Administration (FCA or Agency) amends its rules governing preferred stock issued by Farm Credit System (FCS or System) banks, associations, and service corporations. This final rule requires greater board involvement and oversight in the retirement of preferred stock, enhances FCA's current standards of conduct regulations to specifically address insider preferred stock transactions, modifies and streamlines the FCA review and clearance process, and requires disclosure of senior officer and director preferred stock transactions. Lastly, we add a new provision to require FCA prior approval of investments by FCS banks, associations, and service corporations in preferred stock of other System institutions, including the Federal Agricultural Mortgage Corporation (Farmer Mac).
Fingerprint Submission Requirements
Pursuant to 28 CFR part 901, the National Crime Prevention and Privacy Compact Council (Compact Council), established by the National Crime Prevention and Privacy Compact Act of 1998 (Compact), has approved a Federal Emergency Management Agency (FEMA) proposal to access the Interstate Identification Index (III) System on a delayed fingerprint submission basis when conducting pre-employment criminal history record checks on FEMA emergency workers during times of natural disasters and catastrophic emergencies. (See FEMA's request, attached) FEMA is authorized access to criminal history record information to conduct background checks on applicants for federal employment pursuant to title 28 United States Code section 534 and Executive Order 10450. The FEMA's request was submitted by letter dated October 19, 2004, and approved by the Compact Council on November 4, 2004, pursuant to 28 CFR 901.2 and 901.3. Access to the III System to conduct name-based criminal history record checks, followed by fingerprint submissions, provides a responsive and timely avenue to support FEMA's need for expeditious pre-employment screening during exigent circumstances. An example of such need arose during 2004 when several hurricanes struck the southeastern portion of the United States causing the FEMA to hire large numbers of emergency workers in a short period of time. FEMA intends to enlist the services of the Federal Protective Service or another criminal justice agency with authorized direct access to the III System to conduct the preliminary III name checks on behalf of FEMA. Such name-based checks will be followed by submission of the applicant's fingerprints to the FBI within 5 working days.

This notice announces Federal Travel Regulation (FTR) GSA Bulletin FTR 05-06. This Bulletin informs agencies that certain provisions of the FTR governing the authorization of actual subsistence expenses for official travel (both TDY and relocation) are temporarily waived as a result of Hurricane Katrina, because it is expected that finding lodging facilities and/or adequate meals may be difficult, and distances involved may be great resulting in increased costs for per diem expenses. Notice of Receipt of and Availability for Public Comment on an Application for Wireless Telecommunications Facilities Site; The Presidio of San Francisco, California
This notice announces the Presidio Trust's receipt of and availability for public comment on an application from New Cingular Wireless PCS, LLC for installation of a wireless telecommunications facilities site (``Project'') in The Presidio of San Francisco. The proposed location of the Project is the south side of the MacArthur Tunnel. The Project involves (i) installing a 32-foot pole with two sets of antennae panels and power and telecommunications panels, (ii) placing the associated telecommunications equipment within three cabinets on a concrete pad, and (iii) mounting two antennae on the south face of the MacArthur Tunnel wall. Power and telecommunications service will be brought to the site via underground trench. Comments: Comments on the proposed project must be sent to Steve Carp, Presidio Trust, 34 Graham Street, P.O. Box 29052, San Francisco, CA 94129-0052, and be received by October 12, 2005. A copy of Cingular's application is available upon request to the Presidio Trust.

The Commission hereby gives notice of the scheduling of a full review pursuant to section 751(c)(5) of the Tariff Act of 1930 (19 U.S.C. 1675(c)(5)) (the Act) to determine whether termination of the suspended investigation on ammonium nitrate from Russia would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time. USEC Inc.'s Proposed American Centrifuge Plant; Notice of Availability of Draft Environmental Impact Statement
Notice is hereby given that the U.S. Nuclear Regulatory Commission (NRC) is issuing a Draft Environmental Impact Statement (DEIS) for the USEC Inc. (USEC) license application, dated August 23, 2004, for the possession and use of source, byproduct and special nuclear materials at its proposed American Centrifuge Plant (ACP) located near Piketon, Ohio. The DEIS is being issued as part of the NRC's decision-making process on whether to issue a license to USEC, pursuant to Title 10 of the U.S. Code of Federal Regulations Parts 30, 40, and 70. The scope of activities conducted under the license would include the construction, operation, and decommissioning of the ACP. Specifically, USEC proposes to use gas centrifuge technology to enrich the uranium-235 isotope found in natural uranium up to 10-weight percent. The enriched uranium would be used to manufacture nuclear fuel for commercial nuclear power reactors. The NRC staff will hold a public meeting to present an overview of the DEIS and to accept oral and written public comments. The meeting date, time and location are listed below: Meeting Date: Thursday, September 29, 2005. Meeting Location: Vern Riffe Career Technology Center, 175 Beaver Creek Road, Piketon, OH 45661. Informal Open House: 6-7 p.m. DEIS Comment Meeting: 7-9:45 p.m. Prior to the public meeting, the NRC staff will be available to informally discuss the proposed USEC project and answer questions in an ``open house'' format. This ``open house''' format provides for one-on- one discussions with the NRC staff involved with the preparation of the DEIS. The DEIS meeting officially begins at 7 p.m. and will include: (1) A presentation summarizing the contents of the DEIS and (2) an opportunity for interested government agencies, organizations, and individuals to provide comments on the DEIS. This portion of the meeting will be transcribed by a court reporter. Persons wishing to provide oral comments will be asked to register at the meeting entrance. Individual oral comments may have to be limited by the time available, depending upon the number of persons who register. If special equipment or accommodations are needed to attend or present information at the public meeting, the need should be brought to the attention of Mr. Matthew Blevins no later than September 22, 2005, to provide NRC staff with adequate notice to determine whether the request can be accommodated. Please note that comments do not have to be provided at the public meeting and may be submitted at any time throughout the comment period, through October 24, 2005, as described in the DATES and ADDRESSES sections of this notice.

The NRC has recently submitted to OMB for review the following proposal for the collection of information under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35). The NRC hereby informs potential respondents that an agency may not conduct or sponsor, and that a person is not required to respond to, a collection of information unless it displays a current valid OMB control number. 1. Type of submission, new, revision, or extension: Extension. 2. The title of the information collection: NRC Form 313, ``Application for Material License''; and NRC Form 313A, ``Training and Experience and Preceptor Statement.'' 3. The form number if applicable: NRC Form 313 and NRC Form 313A. 4. How often the collection is required: There is a one-time submittal of information to receive a license. Once a specific license has been issued, there is a 10-year resubmittal of the information for renewal of the license. 5. Who will be required or asked to report: All applicants requesting a license for byproduct or source material. 6. An estimate of the number of responses: 3074 new, amendment, and renewal applications to NRC; 12,840 new, amendment, and renewal applications to Agreement States, for a total of 15,914 responses. 7. The estimated number of annual respondents: 15,914 (3,074 NRC licensees + 12,840 Agreement State licensees). 8. An estimate of the number of hours needed annually to complete the requirement or request: 70,022 (13,526 hours for NRC licensees and 56,496 hours for Agreement State licensees). 9. An indication of whether Section 3507(d), Pub. L. 104-13 applies: Not applicable. 10. Abstract: Applicants must submit NRC Forms 313 and 313A to obtain a specific license to possess, use, or distribute byproduct or source material.
