Public Meeting Concerning Petition Requesting Ban of All-Terrain Vehicles Sold for Use of Children Under 16 Years Old
The Consumer Product Safety Commission (``CPSC'' or ``Commission'') will conduct a public meeting on March 22, 2005 to receive comments concerning Petition CP 02-4/HP-02-1, which requested that the Commission issue a rule banning adult-size four wheel all terrain vehicles (``ATVS'') sold for the use of children under 16 years old. The CPSC staff's briefing package recommends that the Commission deny the petition. The Commission invites oral presentations from members of the public with information or comments related to the petition or the staff's briefing package. The Commission will consider these presentations as it decides what action to take on the petition.

This document requests comments on a Petition for Rule Making filed by Sea-Comm, Inc., (``Petitioner''), licensee of FM Stations WBNU, Shallotte, North Carolina; WWTB, Topsail Beach, North Carolina, and WBNE, Wrightsville Beach, North Carolina. Channel 264A can be allotted to Groveland in compliance with the Commission's minimum distance city reference coordinates. The coordinates for Channel 264A at Groveland are 37-50-45 North Latitude and 120-12-00 West Longitude. The Audio Division requests comments on a petition filed by Mike Chavez proposing the allotment of Channel 293C2 at Powers, Oregon, as the community's first local aural transmission service. The Audio Division, at the request of Linda A. Davidson, allots Channel 229A at Grayville, Illinois, as the community's first local service. See 69 FR 60344, published October 8, 2004. Channel 229A can be allotted to Grayville in compliance with the Commission's minimum distance separation requirements, provided there is a site restriction of 13.0 kilometers (8.1 miles) northwest of the community. The reference coordinates for Channel 229A at Grayville are 38-21-56 North Latitude and 88-03-38 West Longitude. The Audio Division, at the request of Daniel R. Feely, allots Channel 240C2 at Alamogordo, New Mexico, as the community's fifth local service. See 69 FR 60344, published October 8, 2004. Channel 240C2 can be allotted to Alamogordo in compliance with the Commission's minimum distance separation requirements, provided there is a site restriction of 10.4 kilometers (6.5 miles) southeast of the community. The reference coordinates for Channel 240C2 at Alamogordo are 32-49-04 North Latitude and 105-54-19 West Longitude. Because the reference coordinates at Alamogordo are located within 320 kilometers (200 miles) of the Mexican border, concurrence of the Mexican Government has been obtained. Filing windows for Channel 229A at Grayville, Illinois and Channel 240C2 at Alamogordo, New Mexico will not be opened at this time. Instead, the issue of opening a filing window for these channels will be addressed by the Commission in a subsequent order.

Agency Information Collection Activities: Announcement of Board Approval under Delegated Authority and Submission to OMB
Notice is hereby given of the final approval of proposed information collections by the Board of Governors of the Federal Reserve System (Board) under OMB delegated authority, as per 5 CFR 1320.16 (OMB Regulations on Controlling Paperwork Burdens on the Public). Protection of Safeguards Information
The Nuclear Regulatory Commission (NRC) is proposing to amend its regulations for the protection of Safeguards Information (SGI) to protect SGI from inadvertent release and unauthorized disclosure which might compromise the security of nuclear facilities and materials. The proposed amendments are consistent with recent Commission practices reflected in orders and threat advisories, issued since September 11, 2001. The proposed amendments would affect certain licensees, information, and materials not currently specified in the regulations, but which are within the scope of Commission authority under the Atomic Energy Act of 1954, as amended (AEA).

In accordance with the requirement of Section 3506 (c)(2)(A) of the Paperwork Reduction Act of 1995 which provides opportunity for public comment on new or revised data collections, the Railroad Retirement Board (RRB) will publish periodic summaries of proposed data collections. Comments are invited on: (a) Whether the proposed information collection is necessary for the proper performance of the functions of the agency, including whether the information has practical utility; (b) the accuracy of the RRB's estimate of the burden of the collection of the information; (c) ways to enhance the quality, utility, and clarity of the information to be collected; and (d) ways to minimize the burden related to the collection of information on respondents, including the use of automated collection techniques or other forms of information technology. Title and purpose of information collection: Statement of Authority to Act for Employee; OMB 3220-0034. Under Section 5(a) of the Railroad Unemployment Insurance Act (RUIA), claims for benefits are to be made in accordance with such regulations as the Railroad Retirement Board (RRB) shall prescribe. The provisions for claiming sickness benefits as provided by Section 2 of the RUIA are prescribed in 20 CFR 335.2. Included in these provisions is the RRB's acceptance of forms executed by someone else on behalf of an employee if the RRB is satisfied that the employee is sick or injured to the extent of being unable to sign forms. The RRB utilizes Form SI-10, Statement of Authority to Act for Employee, to provide the means for an individual to apply for authority to act on behalf of an incapacitated employee and also to obtain the information necessary to determine that the delegation should be made. Part I of the form is completed by the applicant for the authority and Part II is completed by the employee's doctor. One response is requested of each respondent. Supplemental Standards of Ethical Conduct for Employees of the Social Security Administration
The Social Security Administration (SSA), with the concurrence of the Office of Government Ethics (OGE), proposes to issue regulations that would supplement, for officers and employees of SSA, the OGE Standards of Ethical Conduct for Employees of the Executive Branch. The proposed regulations would set forth prohibitions and prior approval requirements for certain outside employment and other outside activities for all SSA employees, and would set forth additional prior approval requirements for SSA Administrative Law Judges.
National Environmental Policy Act; Outrigger Telescopes Project
Pursuant to the National Environmental Policy Act of 1969, as amended (NEPA) (42 U.S.C. 4321 et seq.), the Council on Environmental Quality Regulations for Implementing the Procedural Provisions of NEPA (40 CFR Parts 1500-1508), and NASA policy and procedures (14 CFR Part 1216 Subpart 1216.3), NASA has prepared and issued a FEIS for the proposed Outrigger Telescopes Project. NASA's Proposed Action and preferred alternative is to fund the Outrigger Telescopes Project at the W.M. Keck Observatory within the Mauna Kea Science Reserve on the summit of Mauna Kea, Island of Hawai'i. The FEIS addresses alternative sites and the environmental and cultural resource impacts that could potentially occur with on-site construction, installation, and operation of four, and possibly up to six, Outrigger Telescopes. The proposed Outrigger Telescopes would be strategically placed around the existing Keck I and Keck II Telescopes, within the current footprint of W.M. Keck Observatory. A reasonable alternative site has been identified on La Palma, Canary Islands, Spain. Sites for a reduced science option have been identified at Mt. Wilson and Mt. Palomar in California.
Visa Reform Act
In response to the requirement in the H-1B Visa Reform Act of 2004, Public Law 108-447, Division J, Title IV, Subtitle B, Section 429(d), NSF is publishing the list of eligible programs of study that will be included in the scholarship program established by the Act. Eligible programs of study are the biological science (except medicine and other clinical fields), physical sciences, mathematical sciences, computer and information sciences, the geosciences, and engineering, as well as technology areas associated with the preceding fields.

Price Index Increases for Expenditure and Contribution Limitations

Notice of Availability of the Record of Decision on the Utah Lake Drainage Basin Water Delivery System, Central Utah Project
On January 27, 2005, Jody L. Williams, Chairman of the Utah Reclamation Mitigation and Conservation Commission (Mitigation Commission) signed the Record of Decision (ROD) which documents selection of the Proposed Action as presented in the 2004 Utah Lake Drainage Basin Water Delivery System Final Environmental Impact Statement (INT FES 04-41) (2004 ULS FEIS) filed with the U.S. Environmental Protection Agency on September 30, 2004. The Mitigation Commission, Central Utah Water Conservancy District and Department of the Interior served as joint lead agencies in preparing the 2004 ULS FEIS. The Proposed Action, called the Spanish Fork Canyon-Provo Reservoir Canal Alternative, one other action alternative called the Bonneville Unit Water Alternative, and a No Action alternative are described and evaluated in the 2004 ULS FEIS, upon which the ROD is based. The Spanish Fork Canyon-Provo Reservoir Canal Pipeline Alternative will deliver an average annual transbasin diversion of 101,900 acre- feet from the Colorado River Basin to the Bonneville Basin, which consists of a delivery of: 30,000 acre-feet of Municipal and Industrial (M&I) water for secondary use to southern Utah County and 30,000 acre- feet of M&I water to Salt Lake County water treatment plants; 1,590 acre-feet of M&I water already contracted to southern Utah County cities; and 40,310 acre-feet of M&I water to Utah Lake for exchange to Jordanelle Reservoir. A portion of the 40,310 acre-feet delivered to Utah Lake would be delivered via lower Hobble Creek to provide spawning habitat for the endangered June sucker, and via lower Provo River where it would help maintain minimum instream flows for June sucker spawning and other fishery and aquatic benefits. The 30,000 acre-feet (less the water returned to Interior under the Section 207 Program) of M&I water utilized in southern Utah County would be used in the cities' secondary water systems. Use of this water as a potable supply in the future would require additional NEPA compliance. Under the Proposed Action, Interior would acquire all of the District's secondary water rights in Utah Lake. These rights would amount to a maximum of 57,073 acre-feet. The acquired water rights would be used to exchange project water to Jordanelle Reservoir. All remaining environmental commitments associated with the Bonneville Unit would be completed and previously committed in-stream flows within the Bonneville Unit area and statutorily mandated in-stream flows would be provided. The Acting Assistant Secretary for Water and Science, Department of the Interior issued a separate ROD for the ULS on December 22, 2004, also selecting the Proposed Action for implementation. The Assistant Secretary's separate decision is necessitated by the responsibility and authority of the Department of the Interior for other aspects of the project beyond the scope of the Mitigation Commission to mitigate for reclamation projects.
Notice of Availability of the Final Environmental Assessment and Finding of No Significant Impact to Construct a Group-Site Campground in Diamond Fork Canyon, UT
The Utah Reclamation Mitigation and Conservation Commission has issued a Final Environmental Assessment and Finding of No Significant Impact to construct a group-site campground in Diamond Fork Canyon in Utah County, Utah. The new campground will have a capacity of approximately 475 people at one time and will replace group camp sites removed from the Diamond and Palmyra Campgrounds, which were reconstructed in the year 2000. The project will also provide additional group-site camping as a feature of the Diamond Fork System of the Central Utah Project. A 1998 environmental assessment and associated decision documents prepared by the Mitigation Commission indicated that the group-site facilities removed from the Diamond and Palmyra Campgrounds would be replaced in a more favorable location and that the size and location would be analyzed in a separate analysis. This environmental analysis is a fulfillment of that 1998 commitment.

Small Business Size Standards: Waiver of the Nonmanufacturer Rule
The U.S. Small Business Administration (SBA) is granting a waiver of the Nonmanufacturer Rule for Adhesives and Sealants Manufacturing. The basis for waivers is that no small business manufacturers are supplying these classes of products to the Federal government. The effect of a waiver would be to allow otherwise qualified regular dealers to supply the products of any domestic manufacturer on a Federal contract set aside for small businesses, service-disabled veteran-owned small businesses; SBA's Very Small Business Program or awarded through the SBA's 8(a) Business Development Program.

This document responds to two petitions for reconsideration that were filed in response to the Commission's decision to establish regulations for unlicensed ultra-wideband (``UWB'') operation. It also responds to the rule making proposals contained in the Memorandum Opinion and Order and Further Notice of Proposed Rule Making in this docket. The order establishes new rules for wideband unlicensed devices operating in the 5925-7250 MHz, 16.2-17.7 GHz, and 22.12-29 GHz bands.
Implement the Global Mobile Personal Communications by Satellite (GMPCS) Memorandum of Understanding and Arrangements
The Commission adopted new rules and policies pertaining to portable Global Mobile Personal Communications by Satellite (GMPCS) transceivers, i.e., satellite telephones and other portable transceivers operated by end users for communication via direct radio links with satellites. These devices are used for both voice and data communication and may be used for internet access or other modes of broadband communication. Certain rules contained new information collection requirements and were published in the Federal Register on February 6, 2004. This document announces the effective date of these published rules.
Next Meeting of the North American Numbering Council
On February 4, 2005, the Commission released a public notice announcing the March 15, 2005 meeting and agenda of the North American Numbering Council (NANC). The intended effect of this action is to make the public aware of the NANC's next meeting and its agenda.
