6.3 Exceptions to Data Availability
Requirements
Notwithstanding any other provision of the
CAT NMS Plan, this Appendix D, or
Exchange Act Rule 17a–1, the following
types of data may be retained in an archive
storage tier[, in which case they will be made
available upon request by Participant
regulatory staff or the SEC to the CAT Help
Desk]. Archived data is not directly available
and searchable electronically without manual
intervention and will not be subject to any
query tool performance requirements until it
is restored to an accessible storage tier. The
Plan Processor will restore archived data to
an accessible storage tier upon request to the
CAT Help Desk by an authorized regulatory
user from the Participants or a senior officer
from the SEC.
