Performance Measures: For purposes of Department reporting under 34 CFR 75.110, the Department will use the following performance measures to evaluate the success of the Basic Needs for Postsecondary Students Program: (1) The percentage of low-income students at the grantee institution served by any direct student service supported by the grant. (2) The annual persistence rate at the grantee institution for all students who are served by any direct student service supported by the grant. (3) By the end of the grant period, the rate of degree or certificate completion at the grantee institution for all students served by any direct student service supported by the grant. (4) The level of basic needs insecurity among all students served by any direct student service supported by the grant, measured before and after implementation of the grant. Note: For purpose of the performance measures, the term ‘‘low-income student’’ means a student— (a) Who is eligible to receive a Federal Pell Grant for the award year for which the determination is made; or (b) Who would otherwise be eligible to receive a Federal Pell Grant for the award year for which the determination is made, except that the student fails to meet the requirements of section 484(a)(5) of the HEA, 20 U.S.C. 1091(a)(5), because the student is in the United States for a temporary purpose. SUPPLEMENTARY INFORMATION: The United States Department of Energy (DOE) regulates electricity exports from the United States to foreign countries in accordance with section 202(e) of the Federal Power Act (FPA) (16 U.S.C. 824a(e)) and regulations thereunder (10 CFR 205.300 et seq.). Sections 301(b) and 402(f) of the DOE Organization Act (42 U.S.C. 7151(b) and 7172(f)) transferred this regulatory authority, previously exercised by the nowdefunct Federal Power Commission, to DOE. Section 202(e) of the FPA provides that an entity which seeks to export electricity must obtain an order from DOE authorizing that export (16 U.S.C. 824a(e)). On April 10, 2023, the authority to issue such orders was delegated to the DOE’s Grid Deployment Office (GDO) by Delegation Order No. S1–DEL–S3–2023 and Redelegation Order No. S3–DEL–GD1–2023. App. at 1. According to the Application, MFT Energy US Power LLC ‘‘is a limited liability company organized under the laws of the state of Delaware’’ with its principal place of business in Chicago, Illinois. Id. The Applicant states that it ‘‘does not own or control any electric power generation or transmission facilities and does not have a franchised electric power service area.’’ Id. Further, MFT Energy US Power LLC represents that it ‘‘operates as a power marketer’’ and holds market-based rate authority provided by the Federal Energy Regulatory Commission (FERC). Id. at 1–2. The Applicant states it ‘‘will purchase surplus electric energy from entities within the United States to be exported to Mexico.’’ Id. at 4. Because the electric energy proposed to be exported will be surplus, the Applicant asserts its exports ‘‘will not impair the sufficiency of electric supply within the United States.’’ Id. Further, the Applicant states that ‘‘all electricity exported by Applicant will be transmitted pursuant to arrangements with utilities that own and operate existing transmission facilities and will be consistent with all applicable export limits on those transmitting facilities and with other terms and conditions contained in the applicable Presidential Permits.’’ App. at 5. Therefore, the Applicant asserts its exports will not impede the regional coordination of the electric grid. Id. The existing international transmission facilities to be utilized by the Applicant have been previously authorized by Presidential permits issued pursuant to Executive Order 10485, as amended, and are appropriate for open access transmission by third parties.
