(PRA). Public comments on the ICR are
invited.

SUPPLEMENTARY INFORMATION: The
Immigration and Nationality Act (INA),
as amended, assigns responsibilities to
the Secretary of Labor (Secretary)
relating to the entry and employment of
certain categories of immigrant and
nonimmigrant foreign workers under
the PERM, H–2B, H–1B, H–1B1, and
E–3 programs. The INA requires the
Secretary to certify that the employment
of foreign workers under certain visa
classifications will not adversely affect
the wages and working conditions of
similarly employed workers in the
United States. To render this
certification, the Secretary determines
the prevailing wage for the occupational
classification and area of intended
employment and ensures the employer
offers a wage to the foreign worker that
equals at least the prevailing wage. The
Department uses Forms ETA–9141 and
ETA–9165 to collect information
necessary to determine the prevailing
wage for the applicable occupation and
area of intended employment. For
additional substantive information

published in the Federal Register on
June 14, 2022 (87 FR 35999).
This information collection is subject
to the PRA. A Federal agency generally
cannot conduct or sponsor a collection
of information, and the public is
generally not required to respond to an
information collection, unless the OMB
approves it and displays a currently
valid OMB Control Number. In addition,
notwithstanding any other provisions of
law, no person shall generally be subject
to penalty for failing to comply with a
collection of information that does not
display a valid OMB Control Number.

DOL seeks PRA authorization for this
information collection for three (3)
years. OMB authorization for an ICR
cannot be for more than three (3) years
without renewal. The DOL notes that
