Dried Prunes Produced in California; Increased Assessment Rate
This rule implements a recommendation from the Prune Marketing Committee to increase the assessment rate established for the 2020-21 and subsequent crop years. The assessment rate will remain in effect indefinitely unless modified, suspended, or terminated.
Elimination of Immediate Notification Requirements for Nonemergency Events
The U.S. Nuclear Regulatory Commission (NRC) will consider in its rulemaking process issues raised in a petition for rulemaking (PRM), dated August 2, 2018, submitted by Mr. Bill Pitesa on behalf of the Nuclear Energy Institute. The petition was docketed by the NRC on November 20, 2018, and assigned Docket No. PRM-50-116. The petitioner requested that the NRC amend its regulations to eliminate immediate notification requirements for nonemergency events for operating nuclear power reactors. The NRC will evaluate the current requirements and guidance for immediate notification of nonemergency events for operating nuclear power reactors, assess whether the requirements present an unnecessary reporting burden, and if they do, determine whether reporting can be reduced or eliminated that does not have a commensurate safety benefit.
Olives Grown in California; Increased Assessment Rate
This final rule implements a recommendation from the California Olive Committee to increase the assessment rate for the 2021 fiscal year. The assessment rate will remain in effect indefinitely unless modified, suspended, or terminated.
Avocados Grown in South Florida and Imported Avocados; Change in Maturity Requirements
This proposed rule would change the maturity requirements currently prescribed under the Florida avocado marketing order. The order regulates the handling of avocados grown in South Florida and is administered locally by the Avocado Administrative Committee (Committee). The proposed change would establish beginning and end dates for the annual maturity shipping schedule. A corresponding change would be made to the avocado import regulation as required under section 8e of the Agricultural Marketing Agreement Act of 1937.

Amendment No. 2 would revise the certificate of compliance to add a dry shielded canister for storage, add new heat load zone configurations, and make other changes to the storage system. Amendment No. 2 also would change the certificate of compliance, technical specifications, and updated final safety analysis report for consistency and clarity.

Safety Zone; M/V ZHEN HUA 24, Crane Delivery Operation, Chesapeake Bay and Coastal Virginia
The Coast Guard is proposing to establish a temporary moving safety zone around M/V ZHEN HUA 24 during its transit through certain waters of the Chesapeake Bay and Coastal Virginia. This action is necessary to provide for the safety of life on these navigable waters during the movement of the M/V ZHEN HUA 24 while it is transporting four new Super-Post Panamax container cranes to the Port of Baltimore, anticipated to arrive between September 4, 2021, and September 29, 2021. The Captain of the Port Virginia has determined that limited maneuverability and unique cargo of this vessel are potential hazardous to any person or vessel within the proposed safety zone. This proposed rulemaking would prohibit persons and vessels from being in the safety zone unless authorized by the Captain of the Port Virginia or a designated representative. We invite your comments on this proposed rulemaking.
Energy Conservation Program: Energy Conservation Standards for Microwave Ovens
The Energy Policy and Conservation Act, as amended, prescribes energy conservation standards for various consumer products and certain commercial and industrial equipment, including microwave ovens. EPCA also requires the U.S. Department of Energy (``DOE'') to periodically determine whether more-stringent, amended standards would be technologically feasible and economically justified, and would result in significant energy savings. In this notification of proposed determination (``NOPD''), DOE has initially determined that energy conservation standards for microwave ovens do not need to be amended and requests comment on this proposed determination and the associated analyses and results.
Advanced Boiling Water Reactor (ABWR) Design Certification Renewal
The U.S. Nuclear Regulatory Commission (NRC) is confirming the effective date of September 29, 2021, for the direct final rule that was published in the Federal Register on July 1, 2021. This direct final rule amended NRC's regulations to certify the U.S. Advanced Boiling Water Reactor standard design so that applicants intending to construct and operate an U.S. Advanced Boiling Water Reactor standard design may do so by referencing the design certification rule.
Schedules of Controlled Substances: Placement of 4,4′-DMAR in Schedule I
With the issuance of this final rule, the Drug Enforcement Administration places 4,4'-dimethylaminorex (common name: 4,4'-DMAR) including its salts, isomers, and salts of isomers, in schedule I of the Controlled Substances Act. This action is being taken to enable the United States to meet its obligations under the 1971 Convention on Psychotropic Substances. This action imposes the regulatory controls and administrative, civil, and criminal sanctions applicable to schedule I controlled substances on persons who handle (manufacture, distribute, import, export, engage in research, conduct instructional activities or chemical analysis, or possess), or propose to handle 4,4'-DMAR.
Truth in Lending (Regulation Z); Impact of the 2021 Juneteenth Holiday on Certain Closed-End Mortgage Requirements
The Bureau of Consumer Financial Protection (Bureau) is issuing this interpretive rule to provide guidance on certain Regulation Z timing requirements related to rescission of closed-end mortgages and the TILA-RESPA Integrated Disclosures (TRID). These timing requirements are based on a definition of ``business day'' that excludes days that are designated as legal public holidays under Federal law. The interpretive rule explains these timing requirements in light of recent legislation that designated ``Juneteenth National Independence Day, June 19'' (Juneteenth) as a Federal legal public holiday. It clarifies that, if the relevant closed-end rescission or TRID time period began on or before June 17, 2021, then June 19, 2021, was considered a business day, but nothing prohibits creditors from providing longer time periods. Therefore, it would also be compliant for creditors to have considered June 19, 2021, a Federal holiday for purposes of these provisions.
Safety Zone; Ohio River, Owenboro, KY
The Coast Guard is establishing a temporary safety zone from mile marker 756 to 757 of the Ohio River. The safety zone is needed to protect life and the marine environment from potential hazards created by the Owensboro Fireworks and Bridge Lights show display. This temporary final rule would prohibit persons and vessels from entering the safety zone unless authorized by the Captain of the Port Sector Ohio Valley or a designated representative.
Wireless Telecommunications Bureau Seek Comment on Implementation of the Commission's Incremental Reduction Plan for Phase I Accelerated Relocation Payments
In this document, the Wireless Telecommunications Bureau (WTB or Bureau) seeks comment on its proposed implementation of the Commission's incremental reduction plan for Phase I Accelerated Relocation Payments (ARP) relating to the ongoing transition of the 3.7 GHz band. On August 4, 2021, as directed by the Commission in the Expanding Flexible Use of the 3.7 to 4.2 GHz Band Report and Order, GN Docket No. 18-122, Report and Order and Order of Proposed Modification, FCC 20-22 (Mar. 3, 2020) (3.7 GHz Report and Order), WTB issued a Public Notice to prescribe the filing procedures for eligible space station operators to submit Certifications of Accelerated Relocation (Certifications) and stakeholders to submit related challenges as part of the Phase I migration of incumbent services in this band. Related to this process, WTB hereby seeks comment on its proposed approach for calculating an incremental reduction for an eligible space station operator's ARP due to its failure to meet the Phase I Accelerated Relocation Deadline. Filers responding to this Public Notice should submit comments in GN Docket No. 21-320.
Federal Preemption and Joint Federal-State Regulation and Oversight of the Department of Education's Federal Student Loan Programs and Federal Student Loan Servicers
The U.S. Department of Education (Department) issues this interpretation to revise and clarify its position on the legality of State laws and regulations that govern various aspects of the servicing of Federal student loans, such as preventing unfair or deceptive practices, correcting misapplied payments, or addressing refusals to communicate with borrowers. The Department concludes that these State laws are preempted only in limited and discrete respects, as further discussed in this interpretation. In addition, this interpretation will help facilitate close coordination between the Department and its State partners to further enhance both servicer accountability and borrower protections. This interpretation revokes and supersedes the interpretation published on March 12, 2018, ``Federal Preemption and State Regulation of the Department of Education's Federal Student Loan Programs and Federal Student Loan Servicers'' (2018 interpretation).
Fees for Services Performed in Connection With Licensing and Related Services-2021 Update
The Board updates for 2021 the fees that the public must pay to file certain cases and pleadings with the Board. Pursuant to this update, 87 of the Board's 135 fees will decrease, 3 fees will increase, and 45 fees will remain at their current levels.
Airworthiness Directives; Bombardier, Inc., Airplanes
The FAA proposes to adopt a new airworthiness directive (AD) for certain Bombardier, Inc., Model BD-100-1A10 airplanes. This proposed AD was prompted by a discovery that a lockwire may not have been installed on the side stay actuator pin nut of the main landing gear (MLG). This proposed AD would require inspecting the left-hand and right-hand MLG side stay actuator assembly pin nut for the presence of a lockwire, and installing a lockwire if necessary. The FAA is proposing this AD to address the unsafe condition on these products.
Airworthiness Directives; De Havilland Aircraft of Canada Limited (Type Certificate Previously Held by Bombardier, Inc.) Airplanes
The FAA proposes to adopt a new airworthiness directive (AD) for certain De Havilland Aircraft of Canada Limited Model DHC-8-401 and -402 airplanes. This proposed AD was prompted by reports of loss of hydraulic fluid and annunciation of the check fire detect light. This proposed AD would require doing a detailed visual inspection for chafing and proper clearance of the left-hand (LH) and right-hand (RH) main landing gear (MLG) primary zone advanced pneumatic detector (APD) sensing lines, the hydraulic tube assemblies, and the surrounding structure, and doing all applicable corrective actions. The FAA is proposing this AD to address the unsafe condition on these products.
Airworthiness Directives; Airbus SAS Airplanes
The FAA proposes to adopt a new airworthiness directive (AD) for certain Airbus SAS Model A350-941 and -1041 airplanes. This proposed AD was prompted by a report indicating that during maintenance, a fuse pin retaining the main landing gear support structure (MLGSS) was found incorrectly engaged in the trunnion block and improperly secured with the associated retaining pin, due to incorrect installation during assembly. This proposed AD would require inspecting the fuse pins and associated retaining pins of the MLGSS for such discrepancies, and corrective action if necessary, as specified in a European Union Aviation Safety Agency (EASA) AD, which is proposed for incorporation by reference. The FAA is proposing this AD to address the unsafe condition on these products.
Airworthiness Directives; Rolls-Royce Deutschland Ltd & Co KG (Type Certificate Previously Held by Rolls-Royce plc) Turbofan Engines
The FAA proposes to adopt a new airworthiness directive (AD) for all Rolls-Royce Deutschland Ltd. & Co KG (RRD) Trent 7000-72 and Trent 7000-72C model turbofan engines. This proposed AD was prompted by the manufacturer revising the engine Time Limits Manual (TLM) life limits of certain critical rotating parts and updating certain maintenance tasks. The proposed AD would require the operator to revise the airworthiness limitation section (ALS) of their approved maintenance program (AMP) by incorporating the revised tasks of the applicable TLM for each affected model turbofan engine, as specified in a European Union Aviation Safety Agency (EASA) AD, which is proposed for incorporation by reference (IBR). The FAA is proposing this AD to address the unsafe condition on these products.
Airworthiness Directives; General Electric Company Turbofan Engines
The FAA proposes to adopt a new airworthiness directive (AD) for certain General Electric Company (GE) GE90 model turbofan engines. This proposed AD was prompted by two separate in-flight shutdowns (IFSDs) resulting from failure of the transfer gearbox (TGB) radial bevel gear (TGB radial gearshaft). This proposed AD would require visual inspection of the TGB radial gearshaft and, depending on the results of the inspection, replacement of the TGB radial gearshaft. The FAA is proposing this AD to address the unsafe condition on these products.

Drawbridge Operation Regulation; Chicago River, Chicago, IL; Correction
The Coast Guard is correcting a final rule that appeared in the Federal Register on July 30, 2021. The final rule announced changes to the Amtrak Railroad Bridge, mile 3.77, across the South Branch of the Chicago River, at Chicago, Illinois. The rule has an effective date of August 30, 2021. This correction fixes an incorrect amendatory instruction within that final rule that deleted existing regulatory text that should not have been deleted.
Air Plan Approval; AK; Juneau's Mendenhall Valley Second 10-Year PM10
The Environmental Protection Agency (EPA) is proposing to approve the Juneau, Mendenhall Valley, Alaska (AK) limited maintenance plan (LMP) submitted on November 10, 2020, by the Alaska Department of Environmental Conservation (ADEC or ``the State''). This plan addresses the second 10-year maintenance period beyond redesignation for particulate matter with an aerodynamic diameter less than or equal to a nominal 10 micrometers (PM10). A LMP is used to meet Clean Air Act (CAA) requirements for formerly designated nonattainment areas that meet certain qualification criteria. The EPA is proposing to determine that Alaska's LMP meets CAA requirements. The plan relies upon control measures contained in the first 10-year maintenance plan and the determination that the Mendenhall Valley area currently monitors PM10 levels well below the PM10 National Ambient Air Quality Standards (NAAQS or ``the standard'').
Airworthiness Directives; PZL Swidnik S.A. Helicopters
The FAA is adopting a new airworthiness directive (AD) for certain PZL Swidnik S.A. Model PZL W-3A helicopters. This AD requires visually inspecting the bonding on a certain part-numbered fairing installed on a certain part-numbered vibration absorber, improving the bonding if necessary, using improved installation procedures to secure the fairing to the vibration absorber, and removing certain parts from service. This AD also prohibits installing the affected part unless it is inspected and installed per the AD requirements. This AD was prompted by a report of a broken bolt securing the fairing to the vibration absorber that resulted from an incorrect torque value for the nut used to secure the fairing to the vibration absorber. The FAA is issuing this AD to address the unsafe condition on these products.
Fisheries Off West Coast States; Modification of the West Coast Commercial Salmon Fisheries; Inseason Actions #22, #23, and #24
NMFS announces three inseason actions in the 2021 ocean salmon fisheries. These inseason actions modified the commercial and recreational salmon fisheries in the area from the U.S./Canada border to the Oregon/California border.
Special Local Regulation; Ohio River, Owensboro, KY
The Coast Guard is establishing a temporary special local regulation on the Ohio River mile 754.0-760.0 in Owensboro, KY on August 12-15, 2021. This special local regulation is needed to protect personnel, vessels, and the marine environment from potential hazards created during the Owensboro Air Show. Entry into this zone is prohibited unless specifically authorized by the Captain of the Port Sector Ohio Valley (COTP).
Florasulam; Pesticide Tolerances
This regulation establishes a tolerance with regional registrations for residues of florasulam in or on grass, forage, fodder and hay, group 17. The Interregional Project Number 4 (IR-4) requested these tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA).
Air Plan Approval; OR; Updates to Adoption by Reference of Federal Provisions
The Environmental Protection Agency (EPA) is approving a revision to the Oregon State Implementation Plan (SIP) submitted on January 29, 2021. The revision updates the date by which Federal provisions are adopted by reference into the Oregon SIP, making air quality requirements more current.
Approval and Promulgation of Implementation Plans; New York; Ozone Season NOX
The Environmental Protection Agency (EPA) is approving a revision to the New York State Implementation Plan (SIP) as a SIP- strengthening measure that is expected to further control emissions of oxides of nitrogen (NOx) to contribute to attainment and maintenance of ozone standards. This SIP strengthening measure goes beyond what has already been approved as satisfying the RACT requirements for the 2008 ozone NAAQS. The EPA is approving a SIP revision of a New York regulation that lowers allowable NOx emissions from simple cycle and regenerative combustion turbines during the ozone season. The intended effect of this action is to approve control strategies that will reduce emissions and help New York State attain and maintain the national ambient air quality standards for ozone.
Air Plan Approval; Ohio; Infrastructure SIP Requirements for the 2015 Ozone NAAQS
The Environmental Protection Agency (EPA) is approving elements of a State Implementation Plan (SIP) submission from Ohio regarding the infrastructure requirements of section 110 of the Clean Air Act (CAA) for the 2015 Ozone National Ambient Air Quality Standards (NAAQS). The infrastructure requirements are designed to ensure that the structural components of each state's air quality management program are adequate to meet the state's responsibilities under the CAA. EPA proposed to approve this action on March 9, 2021, and received no adverse comments.
Electronic Submission of Facility Operations and Emergency Manuals
This final rule enables regulated facilities to electronically submit Operations Manuals and Emergency Manuals and electronically communicate with the Coast Guard. This rule also allows facility operators to submit one electronic or printed copy of the manuals and one electronic or printed copy of the amendments to the manuals. Finally, this rule requires the regulated facilities to maintain either an electronic or a printed copy of each required manual in the marine transfer area of the facility during transfer operations.
Modification of Class E Airspace; Gulkana, AK
This action modifies the Class E airspace, designated as a surface area at Gulkana Airport, Gulkana, AK. This action also modifies the Class E airspace extending upward from 700 feet above the surface. The NPRM for this action proposed a modification to the Class E airspace extending upward from 1,200 feet above the surface, however, the proposed change has been removed from the Final Rule. Additionally, this action removes the Gulkana VORTAC and the Glenallen NDB from the Class E2 text header and airspace description. Further, this action removes the Gulkana VOR/DME from the Class E5 text header and airspace description. Lastly, this action implements administrative updates to the Class E2 and E5 text headers and the Class E2 airspace description. The airspace is designed to support instrument flight rules (IFR) operations at the airport.
Energy Conservation Program: Product Classes for Residential Dishwashers, Residential Clothes Washers, and Consumer Clothes Dryers
On October 30, 2020 and December 16, 2020, the Department of Energy (``DOE'') published two final rules that established product classes for residential dishwashers with a cycle time for the normal cycle of 60 minutes or less, top-loading residential clothes washers and consumer clothes dryers with a cycle time of less than 30 minutes, and front-loading residential clothes washers with a cycle time of less than 45 minutes (``short-cycle product classes''). The rules resulted in amended energy conservation standards for these short cycle product classes, without determining whether the relevant statutory criteria for amending standards were met. Thus, DOE proposes to revoke the two earlier rules that improperly promulgated standards and reinstate the prior product classes and applicable standards for these covered products. DOE requests written comment on its proposal and announces a public meeting to receive comment on this notice of proposed rulemaking (``NOPR'').
Interstate Transport Prongs 1 and 2 for the 2010 Sulfur Dioxide (SO2
The Environmental Protection Agency (EPA) is taking final action to approve State Implementation Plan (SIP) submissions from Kansas and Nebraska addressing the Clean Air Act (CAA or Act) interstate transport SIP requirements for the 2010 Sulfur Dioxide (SO2) National Ambient Air Quality Standards (NAAQS). These submissions address the requirement that each SIP contain adequate provisions prohibiting air emissions that will have certain adverse air quality effects in other states. The EPA is approving portions of these infrastructure SIPs for the aforementioned states as containing adequate provisions to ensure that air emissions in the states will not significantly contribute to nonattainment or interfere with maintenance of the 2010 SO2 NAAQS in any other state.

This action is being taken to enable the United States to meet its obligations under the 1971 Convention on Psychotropic Substances. Negotiated Rulemaking Committee; Negotiator Nominations and Schedule of Committee Meetings
We announce our intention to establish one negotiated rulemaking committee to prepare proposed regulations for the Federal Student Aid programs authorized under title IV of the Higher Education Act of 1965, as amended (HEA). The committee will include representatives of organizations or groups with interests that are significantly affected by the subject matter of the proposed regulations. We request nominations for individual negotiators who represent key stakeholder constituencies for the issues to be negotiated to serve on the committee. We also announce the creation of a subcommittee, and request nominations for individuals with pertinent expertise to participate on the subcommittee. The Department has set a schedule for committee meetings.
Standards for Business Practices of Interstate Natural Gas Pipelines
The Federal Energy Regulatory Commission is amending its regulations to incorporate by reference, with certain enumerated exceptions, the latest version (Version 3.2) of business practice standards adopted by the Wholesale Gas Quadrant of the North American Energy Standards Board (NAESB) applicable to natural gas pipelines in place of the currently incorporated version (Version 3.1) of those business practice standards. The revisions made by NAESB in this version of the standards are designed to enhance the natural gas industries' system and software security measures and to clarify the processing of certain business transactions.
Protection of Digital Computer and Communication Systems and Networks
The U.S. Nuclear Regulatory Commission (NRC) is denying a petition for rulemaking (PRM), dated June 12, 2014, submitted by Anthony Pietrangelo on behalf of the Nuclear Energy Institute. The petitioner requested that the NRC amend its power reactor cyber security regulations to make them consistent with the original intent of the rule and clarify that the scope of those regulations only require the protection of those digital assets that can directly cause core damage and spent fuel sabotage, or whose failure would cause a reactor scram. The petition was docketed by the NRC on September 22, 2014, and assigned Docket No. PRM-73-18. The NRC staff has determined that the information presented in PRM-73-18 does not support rulemaking. The NRC has also determined that existing and ongoing revisions to guidance can effectively address the issues raised by the petitioner in this PRM. Therefore, for the reasons discussed in the SUPPLEMENTARY INFORMATION of this document, the NRC is denying PRM-73- 18.

Air Plan Approval; Missouri; Restriction of Particulate Matter Emissions From Fuel Burning Equipment Used for Indirect Heating
The Environmental Protection Agency (EPA) is proposing approval of a State Implementation Plan (SIP) revision submitted by Missouri on January 19, 2021. Missouri requests that the EPA approve into Missouri's SIP revisions to its rule related to the restriction of particulate matter emissions from fuel burning equipment used for indirect heating. These revisions add incorporation by reference information, remove unnecessary words, and make other editorial changes for clarity. The EPA believes that the revisions are administrative in nature, do not impact the stringency of the SIP and do not adversely impact air quality. The EPA's proposed approval of this rule revision is being done in accordance with the requirements of the Clean Air Act (CAA).
Air Plan Approval; Missouri; Restriction of Emissions From Batch-Type Charcoal Kilns
The Environmental Protection Agency (EPA) is proposing approval of a State Implementation Plan (SIP) revision submitted by Missouri on January 19, 2021. Missouri requests that the EPA approve into Missouri's SIP revisions to its rule related to control of emissions from Batch-Type Charcoal Kilns. These revisions correct an erroneous reference, update, correct and clarify references to test methods, remove unnecessary words, and make other grammatical and typographical corrections. These revisions are administrative in nature and do not impact the stringency of the SIP or have an adverse impact to air quality. The EPA's proposed approval of this rule revision is being done in accordance with the requirements of the Clean Air Act (CAA).
Modification of Class D and Class E Airspace, and Removal of Class E Airspace; Kodiak, AK
This action modifies the Class D airspace at Kodiak Airport, Kodiak, AK. This action also removes the Class E airspace designated as an extension to a Class D or Class E surface area, east of the airport. Further, this action increases the size of the Class E airspace extending upward from 700 feet above the surface. Finally, this action updates the geographic coordinates in the third line of the Class D text header and updates the term ``Airport/Facility Directory'' to ``Chart Supplement'' in the last sentence of the Class D airspace description.
Air Plan Approval; California; San Diego Air Pollution Control District
The Environmental Protection Agency (EPA) is proposing to approve revisions to the San Diego Air Pollution Control District (SDAPCD) portion of the California State Implementation Plan (SIP). These revisions concern emissions of volatile organic compounds (VOCs) from cold solvent cleaning and stripping operations and from vapor degreasing operations. We are proposing to approve changes to SIP- approved local rules to regulate these emission sources under the Clean Air Act (CAA or the Act). We are taking comments on this proposal and plan to follow with a final action.
