Section 21
of the OSH Act (29 U.S.C. 670)
authorizes OSHA to conduct directly, or
through grants and contracts, education
and training courses. These courses
must ensure an adequate number of
qualified personnel to fulfill the
purposes of the OSH Act, provide them
with short-term training, inform them of
the importance and proper use of safety
and health equipment, and train
employers and workers to recognize,
avoid, and prevent unsafe and
unhealthful working conditions. Under
Section 21, OSHA awards training
grants to nonprofit organizations to
provide part of the required training.
The agency requires organizations that
receive these grants to submit quarterly
progress reports that provide
information on their grant-funded
training activities; these reports allow
OSHA to monitor the grantee’s
performance and to determine if an
organization is using grant funds as
specified in the grant application. For

published in the Federal Register on
April 28, 2020 (85 FR 23534).
This information collection is subject
to the PRA. A Federal agency generally
cannot conduct or sponsor a collection
of information, and the public is
generally not required to respond to an
information collection, unless the OMB
approves it and displays a currently
valid OMB Control Number. In addition,
notwithstanding any other provisions of
law, no person shall generally be subject
to penalty for failing to comply with a
collection of information that does not
display a valid OMB Control Number.
See 5 CFR 1320.5(a) and 1320.6.
DOL seeks PRA authorization for this
information collection for three (3)
years. OMB authorization for an ICR
cannot be for more than three (3) years
without renewal. The DOL notes that
information collection requirements
submitted to the OMB for existing ICRs
receive a month-to-month extension
while they undergo review.
