Information for Claimants
The duration of benefits payable in
the EB program, and the terms and
conditions on which they are payable,
are governed by the Federal-State
Extended Unemployment Compensation
Act of 1970, as amended, and the
operating instructions issued to the
states by the U.S. Department of Labor.
In the case of a state beginning an EB
period, the State Workforce Agency will
furnish a written notice of potential
entitlement to each individual who has
exhausted all rights to regular benefits
and is potentially eligible for EB (20
CFR 615.13(c)(1)).

entitled to EB, or who wish to inquire
about their rights under the program,

SUPPLEMENTARY INFORMATION:
I. Background
The Department of Labor, as part of
the continuing effort to reduce
paperwork and respondent (i.e.,
employer) burden, conducts a
preclearance consultation program to
provide the public with an opportunity
to comment on proposed and
continuing information collection
requirements in accordance with the
Paperwork Reduction Act (PRA) (44
U.S.C. 3506(c)(2)(A)). This program
ensures that information is in the
desired format, reporting burden (time
and costs) is minimal, collection
instruments are clearly understood, and
OSHA’s estimate of the information
collection burden is accurate. The
Occupational Safety and Health Act of
1970 (OSH Act) (29 U.S.C. 651 et seq.)
authorizes information collection by
employers as necessary or appropriate
for enforcement of the OSH Act or for
developing information regarding the
causes and prevention of occupational
injuries, illnesses, and accidents (29
U.S.C. 657). The OSH Act also requires
that OSHA obtain such information
with minimum burden upon employers,
especially those operating small
businesses, and to reduce to the
maximum extent feasible unnecessary
duplication of efforts in obtaining
information (29 U.S.C. 657).
The collection of information
contained in the Mechanical Power
Presses Standard are necessary to
reduce workers’ risk of death or serious
injury by ensuring that employers
maintain the mechanical power presses
used by the workers in safe operating
condition.
The following sections describe who
uses the information collected under
each requirement, as well as how they
use it.
Section 1910.217(e)(1)(i)
Paragraph (e)(1)(i) requires employers
to establish and follow a program of
periodic and regular inspections of
power presses to ensure that all their
parts, auxiliary equipment, and
safeguards are in safe operating
condition and adjustment. Employers
must maintain a certification record of
inspections that includes the date of
inspection, the signature of the person
who performed the inspection, and the

serial number, or other identifiers, of the
power press that was inspected.
Section 1910.217(e)(1)(ii)
Paragraph (e)(1)(ii) requires employers
to inspect and test each press no less
than weekly to determine the condition
of the clutch/brake mechanism,
antirepeat feature, and single-stroke
mechanism. Employers must perform
and complete necessary maintenance or
repair or both before the press is
operated. In addition, employers must
maintain a record of inspections, tests,
and maintenance work. The record must
include the date of the inspection, test,
or maintenance; the signature of the
person who performed the inspection,
test, or maintenance; and the serial
number, or other identifiers, of the press
that was inspected, tested, or
maintained.
II. Special Issues for Comment
OSHA has a particular interest in
comments on the following issues:
• Whether the proposed information
collection requirements are necessary
for the proper performance of the
agency’s functions, including whether
the information is useful;
• The accuracy of OSHA’s estimate of
the burden (time and costs) of the
information collection requirements,
including the validity of the
methodology and assumptions used;
• The quality, utility, and clarity of
the information collected; and
• Ways to minimize the burden on
employers who must comply; for
example, by using automated or other
technological information collection
and transmission techniques.

III. Proposed Actions
OSHA is requesting a burden hour
adjustment decrease of 17,160 hours
from 37,967 hours to 20,807 hours. This
change in calculation methods accounts
for the large decrease in the agency’s
estimate of mechanical power presses
currently in service, still an
overestimation.
