Each state agency needs to obtain certain military service information on claimants filing for UCX benefits to enable them to determine his/her eligibility for benefits. This information collection is a revision, because the ETA 841 report is no longer in use and was removed from the collection request. UCX law (5 U.S.C. 8521–8523) and Social Security Act section 303(a)(6) authorize this information collection. See 5 U.S.C. 8523; 42 U.S.C. 503(a)(6) This information collection is subject to the PRA. A Federal agency generally cannot conduct or sponsor a collection of information, and the public is generally not required to respond to an information collection unless the OMB under the PRA approves it and displays a currently valid OMB Control Number. Middle Class Tax Relief and Job Creation Act of 2012, Subtitle D, Short-Time Compensation Program, also known as the Layoff Prevention Act of 2012, concerns States that currently participate in, or wish to initiate a layoff aversion program known as STC or work-sharing. The law requires applications, administrative processes, monitoring, and reporting of data between State Workforce Agencies (SWAs) and the ETA. The ETA has principal oversight responsibility for the Unemployment Insurance (UI) program that SWAs operate. The ETA has developed a data collection for the proper oversight of State STC programs to ensure compliance with the UI system funding and administration under the Layoff Prevention Act. Layoff Prevention Act of 2012 authorizes this information collection. See Public Law 112–96. This information collection is subject to the PRA.
