This ICR
seeks to extend PRA authority for the
Sealing of Abandoned Areas Standard
information collection. The Standard
includes reporting and recordkeeping
requirements to help ensure the
construction and maintenance of seals
are done correctly; certified persons
conducting sampling in sealed areas are
adequately trained, and problems can be
found and corrected. Federal Mine
Safety and Health Act of 1977 sections
101(a) and 103(h) authorize this
information collection. See 30 U.S.C.
811(a) and 813(h).
This information collection is subject
to the PRA. A Federal agency generally
cannot conduct or sponsor a collection
of information, and the public is
generally not required to respond to an
information collection, unless it is
approved by the OMB under the PRA
and displays a currently valid OMB
Control Number. In addition,
notwithstanding any other provisions of
law, no person shall generally be subject
to penalty for failing to comply with a
collection of information that does not
display a valid Control Number. See 5
CFR 1320.5(a) and 1320.6. The DOL
obtains OMB approval for this
information collection under Control
Number 1219–0116.

This ICR
seeks to extend PRA authority for the
Request for Assistance from Department
of Labor, Employee Benefits Security
Administration information collection.
The EBSA assists employee benefit plan
participants in understanding their
rights, responsibilities, and benefits
under employee benefit law and
intervenes informally on behalf of
beneficiaries with plan sponsors in
order to assist participants in obtaining
the health and retirement benefits that
may have been inappropriately denied.
Such informal intervention can avert the
necessity for a formal investigation or a
civil action. The EBSA maintains a tollfree telephone number through which
inquirers can reach Benefits Advisors in
ten Regional Offices. The EBSA has also
made a request for assistance form
available on its Web site for those
wishing to obtain assistance in this
manner. Employee Retirement Income
Security Act of 1974 (ERISA) sections
504 and 513 authorize this information
collection. See 29 U.S.C. 1134, 1143.
