change to list and trade shares of the

Futures Long Fund and ForceShares

under Commentary .02 to NYSE Arca
Equities Rule 8.200. The proposed rule
change was published for comment in
the Federal Register on November 4,
2016.3 The Commission received no
comments on the proposed rule change.
Section 19(b)(2) of the Act 4 provides
that, within 45 days of the publication
of notice of the filing of a proposed rule
change, or within such longer period up
to 90 days as the Commission may
designate if it finds such longer period
to be appropriate and publishes its
reasons for so finding or as to which the
self-regulatory organization consents,
the Commission shall either approve the
proposed rule change, disapprove the
proposed rule change, or institute
proceedings to determine whether the
proposed rule change should be
disapproved. The 45th day after
publication of the notice for this
proposed rule change is December 19,
2016. The Commission is extending this
45-day time period.

Background
In 2013, the NYSE adopted
disciplinary rules that are, with certain
exceptions, substantially the same as the
Financial Industry Regulatory
Authority, Inc. (‘‘FINRA’’) Rule 8000
Series and Rule 9000 Series, and which
set forth rules for conducting
investigations and enforcement actions.4
The NYSE disciplinary rules were
implemented on July 1, 2013.5 In 2016,
NYSE MKT also adopted the Rule 8000
Series and Rule 9000 Series, which
rules are, with certain exceptions,
substantially the same as those of NYSE
and FINRA.6 The NYSE MKT
