change to amend Rule 6.67(c) to change
the timing for recording the name of the
Clearing Member 3 in the Electronic
Order Capture system (‘‘EOC’’). On
March 29, 2016,4 the Exchange filed
Amendment No. 1 to the proposed rule
change. The Commission published the
proposed rule change, as modified by
Amendment No. 1, for comment in the
Federal Register on April 11, 2016.5
The Commission received no comments
on the proposed rule change. On May
25, 2016 the Commission extended the
time period within which to approve
the proposed rule change, disapprove
the proposed rule change, or institute
proceedings to determine whether to
approve or disapprove the proposed
rule change to July 10, 2016.6 On July
7, 2016, the Commission instituted
proceedings under section 19(b)(2)(B) of
the Act 7 to determine whether to
approve or disapprove the proposed
rule change, as modified by Amendment
No. 1.8 The Commission received no
comments on the proposed rule change.
On August 29, 2016, the Exchange
withdrew the proposed rule change
(SR–NYSEArca-2016–15).

certified that, in her opinion, one or

and 17 CFR 200.402(a)(3), (a)(5), (a)(7),
(a)(9)(ii) and (a)(10), permit
consideration of the scheduled matter at
the closed meeting.
Chair White, as duty officer, voted to
consider the items listed for the closed
meeting in closed session.
The subject matter of the closed
meeting will be:
Institution and settlement of
injunctive actions;
Institution and settlement of
administrative proceedings;
Resolution of litigation claims; and
Other matters relating to enforcement
proceedings.
At times, changes in Commission
priorities require alterations in the
scheduling of meeting items.

On July 1, 2016, NYSE MKT LLC
(‘‘NYSE MKT’’ or the ‘‘Exchange’’) filed
with the Securities and Exchange
Commission (‘‘Commission’’), pursuant
to Section 19(b)(1) of the Securities
Exchange Act of 1934 (‘‘Act’’) 1 and Rule
19b–4 thereunder,2 a proposed rule

change to amend certain rules related to
Flexible Exchange (‘‘FLEX’’) Options.
The proposed rule change was
published for comment in the Federal
Register on July 21, 2016.3 On August
30, 2016, the Exchange filed
Amendment No. 1 to the proposed rule
change.4 No comments have been
received on the proposed rule change.
Section 19(b)(2) of the Act 5 provides
that within 45 days of the publication of
notice of the filing of a proposed rule
change, or within such longer period up
to 90 days as the Commission may
designate if it finds such longer period
to be appropriate and publishes its
reasons for so finding or as to which the
self-regulatory organization consents,
the Commission shall either approve the
proposed rule change, disapprove the
proposed rule change, or institute
proceedings to determine whether the
proposed rule change should be
disapproved. The 45th day after
publication of the notice for this
proposed rule change is September 4,
2016. The Commission is extending this
45-day time period for Commission
action on the proposed rule change.
The Commission finds it appropriate
to designate a longer period within
which to take action on the proposed
rule change so that it has sufficient time
to consider the proposed rule change, as
modified by Amendment No. 1.
Accordingly, the Commission, pursuant
to Section 19(b)(2) of the Act,6 and for
the reason noted above, designates
October 19, 2016 as the date by which
the Commission shall either approve or
disapprove, or institute proceedings to
determine whether to disapprove, the
proposed rule change (File No. SR–
NYSEMKT–2016–48).
