This ICR
seeks to extend PRA authority for the
Prohibited Transaction Class Exemption
for Cross-Trades of Securities by Index
and Model-Driven Funds information
collection. Prohibited Transaction Class
Exemption 2002–12 permits cross-trades
of securities between index and modeldriven funds managed by investment
managers and among such funds and
certain large accounts to which such
investment managers act as a trading
adviser in connection with a specific
portfolio-restructuring program. To
ensure managers have complied with
exemption requirements, the DOL has
included in the exemption certain
recordkeeping and disclosure
obligations designed to safeguard plan
assets by periodically providing
information to plan fiduciaries, which
generally must be independent about
the cross-trading program. Employee
Retirement Income Security Act section
408(a) authorizes this information
collection. See 29 U.S.C. 1108(a).
This information collection is subject
to the PRA. A Federal agency generally
cannot conduct or sponsor a collection
of information, and the public is
generally not required to respond to an
information collection, unless it is
approved by the OMB under the PRA
and displays a currently valid OMB
