To comply with the Standard, an Occupational Safety and Health Act (OSH Act) covered employer subject to the Standard must establish and implement a medical surveillance program for workers assigned to enter regulated areas, inform workers of their medical examination results, and provide workers with access to their medical records. The employer must also retain worker medical records for specified time periods and make the records available upon request to the OSHA and National Institute for Occupational Safety and Health. OSH Act sections 2(b)(9), 6, and 8(c) authorize this information collection. See 29 U.S.C. 651(b)(9), 655, and 657(c). This information collection is subject to the PRA.
