protective measures can and will be
taken in the event of a radiological
emergency at the ZNPS facility based on
its permanently shut down condition.
This exemption is effective upon
issuance.

change was published for comment in
the Federal Register on October 21,
2014.3 On December 2, 2014, the
Commission extended the time period
in which to either approve the proposal,
disapprove the proposal, or to institute
proceedings to determine whether to
approve or disapprove the proposal, to
January 19, 2015.4 On January 16, 2015,
the Commission instituted proceedings
to determine whether to approve or
disapprove the proposal.5 The

Section 19(b)(2) of the Act 7 provides
that, after initiating disapproval
proceedings, the Commission shall issue
an order approving or disapproving the
proposed rule change not later than 180
days after the date of publication of
notice of filing of the proposed rule
change.8 The Commission may extend
the period for issuing an order
approving or disapproving the proposed
rule change, however, by not more than
60 days if the Commission determines
that a longer period is appropriate and
publishes the reasons for such
determination.9 The proposed rule
change was published for notice and
comment in the Federal Register on
October 21, 2014. April 19, 2015, is 180
days from that date, and June 18, 2015,
is 240 days from that date.
The Commission finds it appropriate
to designate a longer period within
which to issue an order approving or
disapproving the proposed rule change
so that it has sufficient time to consider
the proposal, and the issues raised in
NYSE MKT’s comment letters.
Accordingly, the Commission,
pursuant to Section 19(b)(2) of the
Act,10 designates June 18, 2015 as the
date by which the Commission shall
either approve or disapprove the
proposed rule change (File No. SR–
NYSEMKT–2014–86).
