In accordance with Departmental
Policy, 28 CFR 50.7, notice is hereby
given that a proposed Consent Decree in
United States, et al. v. Trans Energy,
Inc., Civil Action No. 5:14–cv–00117–
FPS, was lodged with the United States
District Court for the Northern District
of West Virginia on September 2, 2014.
This proposed Consent Decree
concerns a complaint filed by the
United States and the State of West
Virginia against Trans Energy, Inc.
pursuant to Section 309(b) and (d) of the
Clean Water Act, 33 U.S.C. 1319(b) and
(d), the West Virginia Water Pollution
Control Act, W. Va. Code § 22–11–22,
and the West Virginia Dam Control and
Safety Act, W. Va. Code Chapter 22,
Article 14, to obtain injunctive relief
from and impose civil penalties against
the Defendant for violating the Clean
Water Act by discharging pollutants
without a permit into waters of the
United States. The proposed Consent
Decree resolves these allegations by
requiring the Defendant to restore the
impacted areas, perform mitigation,
implement a compliance program, and
pay a civil penalty.
The Department of Justice will accept
written comments relating to this
proposed Consent Decree for thirty (30)
days from the date of publication of this
Notice. Please address comments to:

The Employment and
Training Administration is issuing this
notice to announce the receipt of a
‘‘Certification of Non-Relocation and
Market and Capacity Information
Report’’ (Form 4279–2) for the
following:
Applicant/Location: Mid River
Terminal, LLC Osceola, Arkansas.
Principal Product/Purpose: The loan,
guarantee, or grant application will be
used for a new business venture to
purchase equipment, provide working
capital, fund USDA Guaranty Fees, bank
origination fees, professional fees and
closing costs for an embedded material
handling business at the Big River Steel
Plant in Osceola, Arkansas. The
business will independently handle all
off and on loading of steel at the plant.
The NAICS industry code for this
enterprise is: 488999. This U.S. industry
comprises establishments primarily
engaged in providing support activities
to transportation (except for air
transportation; rail transportation; water
transportation; road transportation;
freight transportation arrangement; and
packing and crating) Pipeline terminal
facilities, independently operated.
DATES: All interested parties may submit
comments in writing no later than

Development Act of 1972, as established
under 29 CFR part 75, authorizes the
United States Department of Agriculture
to make or guarantee loans or grants to
finance industrial and business
activities in rural areas. The Secretary of
Labor must review the application for
financial assistance for the purpose of
certifying to the Secretary of Agriculture
that the assistance is not calculated, or
likely, to result in: (a) A transfer of any
employment or business activity from
one area to another by the loan
applicant’s business operation; or, (b)
An increase in the production of goods,
materials, services, or facilities in an
area where there is not sufficient
demand to employ the efficient capacity
of existing competitive enterprises
unless the financial assistance will not
have an adverse impact on existing
competitive enterprises in the area. The
Employment and Training
Administration within the Department
of Labor is responsible for the review
and certification process. Comments
should address the two bases for
certification and, if possible, provide
data to assist in the analysis of these
issues.

SUPPLEMENTARY INFORMATION: Section 188 of the Consolidated Farm and
Rural Development Act of 1972, as established under 29 CFR part 75,
authorizes the United States Department of Agriculture to make or
guarantee loans or grants to finance industrial and business activities
in rural areas. The Secretary of Labor must review the application for
financial assistance for the purpose of certifying to the Secretary of
Agriculture that the assistance is not calculated, or likely, to result
