AGENCY:
Pursuant to Section 251 of the Trade
Act 1974, as amended (19 U.S.C. 2341
et seq.), the Economic Development
Administration (EDA) has received
petitions for certification of eligibility to
apply for Trade Adjustment Assistance
from the firms listed below.

Accordingly, EDA has initiated
investigations to determine whether
increased imports into the United States
of articles like or directly competitive
with those produced by each of these
firms contributed importantly to the
total or partial separation of the firm’s
workers, or threat thereof, and to a
decrease in sales or production of each
petitioning firm.

Court Decision Not in Harmony With
the Final Determination and Amended

Antidumping Duty Investigation

SUMMARY: On April 23, 2014, the United
States Court of International Trade
(‘‘CIT’’) the CIT granted Plaintiffs’1
consent motion for severance and
entered final judgment in Baroque
Timber Industries (Zhongshan)
Company, Limited, et. al. v. United
States and Zhejiang Layo Wood Industry
Co., Ltd. v. United States.2 The CIT
affirmed the Department of Commerce’s
(the ‘‘Department’’) final determination
of sales at less than fair value, as
modified by the final results of

redetermination with respect to Layo
Wood and the Samling Group pursuant
to court order, in Baroque Timber
Industries (Zhongshan) Company,
Limited, et. al. v. United States,3 and
affirmed that the antidumping margins
for Layo Wood and the Samling Group
are de minimis.
Consistent with the decision of the
United States Court of Appeals for the
Federal Circuit (‘‘CAFC’’) in Timken Co.
v. United States, 893 F.2d 337 (Fed. Cir.
1990) (‘‘Timken’’), as clarified by
Diamond Sawblades Mfrs. Coalition v.
United States, 626 F.3d 1374 (Fed. Cir.
2010) (‘‘Diamond Sawblades’’), the
Department is notifying the public that
the final judgment in this case is not in
harmony with the Department’s MLWF
Amended Final Determination 4 and is
amending the final results with respect
to Layo Wood and the Samling Group.
