Application for Reconsideration
By application dated March 24, 2014,
a worker requested administrative
reconsideration of the negative
determination regarding workers’
eligibility to apply for Trade Adjustment
Assistance (TAA) applicable to workers
and former workers of the subject firm.
The determination was issued on
February 27, 2014.
The determination was based on the
Department’s findings that there was no
increase in imports of textbooks or
catalogues, or like or directly
competitive articles (including e-books);
there was no shift in production by the
subject firm to a foreign country, and no
acquisition in production by the subject
firm from a foreign country; the workers
are not secondarily-affected workers;
and the subject firm was not named by
the International Trade Commission as
required by Section 222(e) of the Trade
Act, as amended.
Pursuant to 29 CFR 90.18(c)
reconsideration may be granted under
the following circumstances:
(1) If it appears on the basis of facts
not previously considered that the
determination complained of was
erroneous;
(2) If it appears that the determination
complained of was based on a mistake
in the determination of facts not
previously considered; or
(3) If in the opinion of the Certifying
Officer, a misinterpretation of facts or of
the law justified reconsideration of the
decision.
The request for reconsideration
identifies a new source of information
regarding a shift of production to India
and Mexico.
The Department has carefully
reviewed the request for reconsideration
and the existing record, and has
determined that the Department will
conduct further investigation to
determine if the workers meet the
eligibility requirements of the Trade Act
of 1974, as amended.
Conclusion
After careful review of the
application, I conclude that the claim is
of sufficient weight to justify
reconsideration of the U.S. Department
of Labor’s prior decision. The
application is, therefore, granted.

Petitions have been filed with the
Secretary of Labor under Section 221 (a)
of the Trade Act of 1974 (‘‘the Act’’) and
are identified in the Appendix to this
notice. Upon receipt of these petitions,
the Director of the Office of Trade
Adjustment Assistance, Employment
and Training Administration, has
instituted investigations pursuant to
Section 221 (a) of the Act.
The purpose of each of the
investigations is to determine whether
the workers are eligible to apply for
adjustment assistance under Title II,
Chapter 2, of the Act. The investigations
will further relate, as appropriate, to the
determination of the date on which total
or partial separations began or
threatened to begin and the subdivision
of the firm involved.
The petitioners or any other persons
showing a substantial interest in the
subject matter of the investigations may
request a public hearing provided such
request is filed in writing with the
Director, Office of Trade Adjustment
Assistance, at the address shown below,
not later than May 9, 2014.
Interested persons are invited to
submit written comments regarding the
subject matter of the investigations to
the Director, Office of Trade Adjustment
Assistance, at the address shown below,
not later than May 9, 2014.

The Department’s notice of
determination was published in the
Federal Register on July 2, 2013 (78 FR
39776).
At the request of the Texas Workforce
Commission, the Department reviewed
the certification for workers of the
subject firm. The workers are engaged in
activities related to the production of
production of servers, storage, and
peripheral equipment.
The investigation confirmed that
workers of EMCOR Facilities Services,
Inc. were employed on-site at the
Austin, Texas facility and that they were
sufficiently under the operational
control of the firm to be considered
leased workers.
The intent of the Department is to
include all workers impacted by the
acquisition of articles from a foreign
country.
The amended notice applicable to
TA–W–82,700 is hereby issued as
follows:
In accordance with Section 223 of the
Trade Act of 1974, as amended (‘‘Act’’),
