U.S. Patent No. 7,614,398 (‘‘the ’398
patent’’), U.S. Patent No. 7,938,116 (‘‘the
’116 patent’’), U.S. Patent No. 7,341,060
(‘‘the ’060 patent’’), U.S. Patent No.
8,312,883 (‘‘the ’883 patent’’), U.S.
Patent No. 7,926,487 (‘‘the ’487 patent’’),
U.S. Patent No. 7,178,527 (‘‘the ’527
patent’’), and U.S. Patent No. 7,950,392
(‘‘the ’392 patent’’). The complaint
further alleges that an industry in the
United States exists as required by
subsection (a)(2) of section 337.
The complainants request that the
Commission institute an investigation
and, after the investigation, issue a
limited exclusion order and cease and
desist orders.

section 337 of the Tariff Act of 1930, as
amended, an investigation be instituted
to determine whether there is a
violation of subsection (a)(1)(B) of
section 337 in the importation into the
United States, the sale for importation,
or the sale within the United States after
importation of certain sleep-disordered
breathing treatment systems and
components thereof that infringe one or
more of claims 32–37, 53, 79, 80, and 88
of the ’267 patent; claims 1–7 of the ’398
patent; claim 1 of the ’116 patent; claims
30, 37, and 38 of the ’060 patent; claims
1, 3, 5, 11, 28, 30, 31, and 56 of the ’883
patent; claims 1, 3, 6, 7, 9, 29, 32, 35,
40, 42, 45, 50, 51, 56, 59, 89, 92, 94, and
96 of the ’527 patent; claims 19–24, 26,
29–36, and 39–41 of the ’392 patent; and
claims 13, 15, 16, 26–28, 51, 52, and 55
of the ’487 patent; and whether an
industry in the United States exists as
required by subsection (a)(2) of section
337;

investigation so instituted, the following

The
Survey of Occupational Injuries and
Illnesses is the primary indicator of
national progress in providing every
working man and woman safe and
healthful working conditions. Survey
data are also used to evaluate the
effectiveness of the Federal and State
programs and to prioritize scarce
resources. This ICR has been classified
as a revision, because of minor changes,
such as updating the reporting year
covered by the current edition, to survey
instruments.
This information collection is subject
to the PRA. A Federal agency generally
cannot conduct or sponsor a collection
of information, and the public is
generally not required to respond to an
information collection, unless it is
approved by the OMB under the PRA
and displays a currently valid OMB
Control Number. In addition,
notwithstanding any other provisions of
law, no person shall generally be subject
to penalty for failing to comply with a
collection of information that does not
display a valid Control Number. See 5
CFR 1320.5(a) and 1320.6. The DOL
obtains OMB approval for this
information collection under Control
Number 1220–0045. The current
approval is scheduled to expire on
October 31, 2013; however, it should be
noted that existing information
collection requirements submitted to the
OMB receive a month-to-month
extension while they undergo review.
New requirements would only take
effect upon OMB approval. For
