Regarding the ’134, ’937, and ’477
patents, the Commission affirms the
following findings: (1) Cypress failed to
prove that the accused products infringe
the asserted claims; (2) Cypress failed to
establish the technical prong of the
domestic industry requirement; and (3)
Respondents failed to establish by clear
and convincing evidence that the cited
prior art references anticipate the
asserted claims. The Commission adopts
the ID and RID in their entirety as
modified and/or supplemented by the
Commission opinion. The investigation
is terminated.
The authority for the Commission’s
determination is contained in section
337 of the Tariff Act of 1930, as
amended (19 U.S.C. 1337), and in
sections 210.42–46 and 210.50 of the
Commission’s Rules of Practice and
Procedure (19 CFR 210.42–46 and
210.50).

Cooperative Research and Production
Act of 1993—Pistoia Alliance, Inc.
Notice is hereby given that, on May
16, 2013, pursuant to Section 6(a) of the
National Cooperative Research and
Production Act of 1993, 15 U.S.C. 4301
et seq. (‘‘the Act’’), Pistoia Alliance, Inc.
has filed written notifications
simultaneously with the Attorney
General and the Federal Trade
Commission disclosing changes in its
membership. The notifications were
filed for the purpose of extending the
Act’s provisions limiting the recovery of
antitrust plaintiffs to actual damages
under specified circumstances.
Specifically, Nicola Fantini (individual),
Zurich, SWITZERLAND; and Ingrid
Akerblom (individual), Lansdale, PA,
have been added as parties to this
venture.
No other changes have been made in
either the membership or planned
activity of the group research project.
Membership in this group research
project remains open, and Pistoia
Alliance, Inc. intends to file additional
written notifications disclosing all
changes in membership.
On May 28, 2009, Pistoia Alliance,
Inc. filed its original notification
pursuant to Section 6(a) of the Act. The
Department of Justice published a notice
in the Federal Register pursuant to
Section 6(b) of the Act on July 15, 2009
(74 FR 34364).
The last notification was filed with
the Department on March 8, 2013. A
notice was published in the Federal
Register pursuant to Section 6(b) of the
Act on April 3, 2013 (78 FR 20141).

Standards
Notice is hereby given that, on May
10, 2013, pursuant to Section 6(a) of the
National Cooperative Research and
Production Act of 1993, 15 U.S.C. 4301
et seq. (‘‘the Act’’), ASTM International
(‘‘ASTM’’) has filed written notifications
simultaneously with the Attorney
General and the Federal Trade
Commission disclosing additions or
changes to its standards development
activities. The notifications were filed
for the purpose of extending the Act’s
provisions limiting the recovery of
antitrust plaintiffs to actual damages
under specified circumstances.
Specifically, ASTM has provided an
updated list of current, ongoing ASTM
standards activities originating between
February 2013 and May 2013 designated
as Work Items. A complete listing of
ASTM Work Items, along with a brief
description of each, is available at
https://www.astm.org.
On September 15, 2004, ASTM filed
its original notification pursuant to
Section 6(a) of the Act. The Department
of Justice published a notice in the
Federal Register pursuant to Section
6(b) of the Act on November 10, 2004
(69 FR 65226).
The last notification was filed with
the Department on February 11, 2013. A
notice was published in the Federal
Register pursuant to Section 6(b) of the
Act on March 7, 2013 (78 FR 14836).
