Regulations 29 CFR 2510.3–38 provides
that, in order to meet the definition of
investment manager under Employee
Retirement Income Security Act of 1974
section 3(38), a State-registered
investment adviser must register
electronically through a centralized
electronic filing system established by
the Securities and Exchange
Commission or a State investment
authority called the Investment Adviser
Registration Depository.
This information collection is subject
to the PRA. A Federal agency generally
cannot conduct or sponsor a collection
of information, and the public is
generally not required to respond to an
information collection, unless it is
approved by the OMB under the PRA
and displays a currently valid OMB
Control Number. In addition,
notwithstanding any other provisions of
law, no person shall generally be subject
to penalty for failing to comply with a
collection of information that does not
display a valid Control Number. See 5

State unemployment compensation
program, the claimant must meet certain
requirements that demonstrate
attachment to the labor force. The vast
majority of states use past wages for this
purpose, however, a few States use
actual weeks of work. Information
relative to this first test of eligibility,
known as monetary eligibility, is
