Finland, and Nokia, Inc., of White
Plains, New York (collectively,
‘‘Nokia’’); and Research In Motion Ltd.,
of Ontario, Canada, and Research In
Motion Corp., of Irving, Texas
(collectively, ‘‘RIM’’)..
On October 16, 2012, CalTech and
STMicro jointly moved to terminate the
investigation based upon a settlement
agreement between CalTech and
STMicro. On October 26, 2012, RIM and
Nokia filed a separate joint motion to
terminate the investigation based on the
same settlement agreement between
CalTech and STMicro. Neither motion
was opposed.
On November 8, 2012, the ALJ issued
the subject ID (Order No. 9) granting
both motions to terminate the
investigation. The ALJ found no
indication that termination of the
investigation based on the settlement
agreement would have an adverse
impact on the public interest. No
petitions for review of the ID were filed.
The Commission has determined not
to review the ID. The investigation is
terminated.
The authority for the Commission’s
determination is contained in section
337 of the Tariff Act of 1930, as
amended (19 U.S.C. 1337), and in Part
210 of the Commission’s Rules of
Practice and Procedure (19 CFR part
210).
Issued: December 10, 2012.
By order of the Commission.
Lisa R. Barton,
Acting Secretary to the Commission.
