This
information collection comprises the
Unemployment Trust Fund (UTF)
management reports. These reports
assure that UTF contributions collected
are immediately paid over to the
Secretary of the Treasury, in conformity
with Social Security Act (SSA) section
303(a)(4) and Federal Unemployment
Tax Act (FUTA) section 3304(a)(3). The
reports also assure that expenditure of
all money withdrawn from the
unemployment fund of a state is used
exclusively for the payment of benefits,
exclusive of refund.
This information collection is subject
to the PRA. A Federal agency generally
cannot conduct or sponsor a collection
of information, and the public is
generally not required to respond to an
information collection, unless it is
approved by the OMB under the PRA
and displays a currently valid OMB
Control Number. In addition,
notwithstanding any other provisions of
law, no person shall generally be subject
to penalty for failing to comply with a
collection of information if the
collection of information does not
display a valid Control Number. See 5
CFR 1320.5(a) and 1320.6. The DOL
obtains OMB approval for this
information collection under Control
Number 1205–0154. The current
approval is scheduled to expire on
October 31, 2012; however, it should be
noted that existing information
collection requirements submitted to the

Pension
Protection Act of 2006, Public Law 109–
280, section 501(a) amended Employee
Retirement Income Security Act (ERISA)
section 101(f), 29 U.S.C. 1021(f), to
require administrators of all defined
benefit plans subject to ERISA title IV to
provide an annual funding notice to the
Pension Benefit Guaranty Corporation
(PBGC), to each plan participant and
beneficiary, to each labor organization
representing such participants or
beneficiaries, and, in the case of a
multiemployer plan, to each employer
that has an obligation to contribute to
the plan. An annual funding notice
must include, among other things, the
plan’s funding percentage, a statement
of the value of the plan’s assets and
liabilities and a description of how the
plan’s assets are invested as of specific
dates, and a description of the benefits
under the plan that are eligible to be
guaranteed by the PBGC. The EBSA
issued Field Assistance Bulletin 2009–
1 to provide interim guidance on the
requirements.
This information collection is subject

Adjustment Assistance
In accordance with Section 223 of the
Trade Act of 1974, as amended (19
U.S.C. 2273) the Department of Labor
herein presents summaries of
determinations regarding eligibility to
apply for trade adjustment assistance for
workers by (TA–W) number issued
during the period of October 1, 2012
through October 5, 2012.
In order for an affirmative
determination to be made for workers of
a primary firm and a certification issued
regarding eligibility to apply for worker
adjustment assistance, each of the group
eligibility requirements of Section
222(a) of the Act must be met.
I. Under Section 222(a)(2)(A), the
following must be satisfied:
(1) A significant number or proportion
of the workers in such workers’ firm
have become totally or partially
separated, or are threatened to become
totally or partially separated;
(2) The sales or production, or both,
of such firm have decreased absolutely;
and
(3) One of the following must be
satisfied:
(A) Imports of articles or services like
or directly competitive with articles
produced or services supplied by such
firm have increased;
(B) Imports of articles like or directly
competitive with articles into which one
or more component parts produced by
such firm are directly incorporated,
have increased;
(C) Imports of articles directly
incorporating one or more component
parts produced outside the United
States that are like or directly
competitive with imports of articles
incorporating one or more component
parts produced by such firm have
increased;
(D) Imports of articles like or directly
competitive with articles which are
produced directly using services
supplied by such firm, have increased;
and
(4) The increase in imports
contributed importantly to such
workers’ separation or threat of

SUPPLEMENTARY INFORMATION: Pension Protection Act of 2006, Public Law
