such responses will be considered by
the Commission if received not later
than 20 days after the date of service by
the Commission of the complaint and
the notice of investigation. Extensions of
time for submitting responses to the
complaint and the notice of
investigation will not be granted unless
good cause therefor is shown.
Failure of a respondent to file a timely
response to each allegation in the
complaint and in this notice may be
deemed to constitute a waiver of the
right to appear and contest the
allegations of the complaint and this
notice, and to authorize the
administrative law judge and the
Commission, without further notice to
the respondent, to find the facts to be as
alleged in the complaint and this notice
and to enter an initial determination
and a final determination containing
such findings, and may result in the
issuance of an exclusion order or a cease
and desist order or both directed against
the respondent.

Investigation Based on Settlement
On the basis of the record 1 developed
in the subject five-year reviews, the
United States International Trade
Commission (Commission) determines,
pursuant to section 751(c) of the Tariff
Act of 1930 (19 U.S.C. 1675(c)), that
revocation of the countervailing duty
order on certain circular welded pipe
and tube from Turkey and the
antidumping duty orders on certain
circular welded pipe and tube from
Brazil, India, Korea, Mexico, Taiwan,
Thailand, and Turkey would be likely to
lead to continuation or recurrence of
material injury to an industry in the
United States within a reasonably
foreseeable time.
Background
The Commission instituted these
reviews on July 1, 2011 (76 FR 38691)
and determined on October 4, 2011 that
it would conduct full reviews (76 FR
65748, October 24, 2011). Notice of the
scheduling of the Commission’s reviews
and of a public hearing to be held in
connection therewith was given by
posting copies of the notice in the Office
of the Secretary, U.S. International
Trade Commission, Washington, DC,
and by publishing the notice in the
Federal Register on January 17, 2012
(77 FR 2318). The hearing was held in
Washington, DC, on May 3, 2012, and
all persons who requested the
opportunity were permitted to appear in
person or by counsel.
The Commission transmitted its
determinations in these reviews to the
Secretary of Commerce on June 28,
2012. The views of the Commission are
contained in USITC Publication 4333
(June 2012), entitled Certain Circular
Welded Pipe and Tube from Brazil,
India, Korea, Mexico, Taiwan, Thailand,
and Turkey: Investigation Nos. 701–TA–

Commission instituted this investigation
on November 8, 2011, based on a
complaint filed by Westinghouse Solar,
Inc. and Andalay Solar, Inc., both of
Campbell, California, alleging a
violation of section 337 in the
importation, sale for importation, and
sale within the United States after
importation of certain integrated solar
power systems and components thereof
by reason of infringement of certain
claims of U.S. Patent Nos. 7,406,800 and
7,987,641. 76 FR 69284 (Nov. 8, 2011).
