This
information collection applies to
employers claiming the overtime
exemption available under Fair Labor
Standards Act section 7(e)(3)(b).
Specifically, in calculating an
employee’s regular rate of pay, an
employer need not include
contributions made to a bona fide thrift
or savings plan or a bona fide profitsharing plan or trust—as defined in 29
CFR parts 547 and 549. Employers are
required to communicate, or make
available to the employees, the terms of
the bona fide thrift or savings plan and
bona fide profit-sharing plan or trust,
and retain certain records.
This information collection is subject
to the PRA. A Federal agency generally
cannot conduct or sponsor a collection
of information, and the public is
generally not required to respond to an
information collection, unless it is
approved by the OMB under the PRA
and displays a currently valid OMB
Control Number. In addition,
notwithstanding any other provisions of
law, no person shall generally be subject
to penalty for failing to comply with a
collection of information if the
collection of information does not
display a valid OMB Control Number.
See 5 CFR 1320.5(a) and 1320.6. The
DOL obtains OMB approval for this
information collection under OMB
Control Number 1235–0013. The current
OMB approval is scheduled to expire on
November 30, 2011; however, it should
be noted that existing information

Assistance
In accordance with Section 223 of the
Trade Act of 1974, as amended (‘‘Act’’),
19 U.S.C. 2273, the Department of Labor
issued a Certification of Eligibility to
Apply for Worker Adjustment
Assistance on October 6, 2010,
applicable to workers of Whirlpool
Corporation, including on-site leased
workers from Career Solutions TEC
Staffing, Fort Smith, Arkansas. The
workers are engaged in the production
of refrigerators and trash compactors.
The notice was published in the Federal
Register on October 25, 2010 (75 FR
65520). The notice was amended on
December 6, 2010 to include on-site
leased workers from Andrews
International. The notice was published
in the Federal Register on December 13,
2010 (75 FR 77665). The notice was
amended on November 7, 2011 to
include several on-site leased worker
firms. The notice will be published soon
in the Federal Register.
At the request of a company official,
the Department reviewed the
certification for workers of the subject
firm. The company reports that workers
leased from Kelly Services, Inc.,
Prodriver, and Arkansas Warehouse,
Inc. were employed on-site at the Fort
Smith, Arkansas location of Whirlpool
Corporation. The Department has
determined that these workers were
sufficiently under the control of
Whirlpool Corporation to be considered
leased workers.
Based on these findings, the
Department is amending this
certification to include workers leased
from Kelly Services, Inc., Prodriver, and
Arkansas Warehouse, Inc. working onsite at the Fort Smith, Arkansas location
of Whirlpool Corporation.
